That’s one dirty kitty… Woman Sues Doctor For Attaching Intestines To Private Parts Via CourthouseNews Doctors must face a trial after attaching a woman’s intestine to her vagina, an appeals court ruled, finding no need for an expert to testify about defecation. “It requires no expert testimony to understand that feces are not meant to be excreted from the vagina and that such an injury does not ordinarily occur in the absence of a negligent act or omission during a surgical procedure,” the ruling states. Linda Robinson had undergone surgery at Duke University Medical Center after she presented with severe constipation and colonic inertia. The doctors were supposed to remove part of her small intentine and reattach it to her rectum with a surgical stapler. One day later, Robinson complained that bloody fluid was coming out of her vagina. It was then discovered that her small intestine had been attached to her vagina, rather than her rectum. A second surgery corrected the issue, but Robinson was left with blurry vision, speech difficulty, erratic hand movement and weakness on her left side. She was diagnosed with conversion disorder, a psychiatric problem related to conflict or stress. After Robinson and her husband sued Duke University Health Systems for medical malpractice, a judge in Durham found that the case must be dismissed because of the lack of a prefiling review by a medical expert. The Robinsons appealed, arguing that the res ipsa loquitur doctrine makes such an expert finding unnecessary in this case. A three-judge panel of the North Carolina Court of Appeals agreed and remanded the case for trial. “Defendant’s argument that res ipsa is inapplicable in the present case because it does not involve either a foreign object left in the body following surgery or an injury to and area far away from and completely unrelated to the zone of surgery is without merit,” Judge Doug McCullough wrote for the court. The ruling also bars the Robinsons from seeking punitive damages because the defendants’ actions were not “willful, wanton, malicious or fraudulent,” according to the ruling. So basically this lady gets her oochie-coochie reconnected, but no dough. Sean Kingston Accused of Gang Rape By Carissa Capeloto, Insists Sex Was Consensual

Sean Kingston, his bodyguard and a band member raped teenager Carissa Copeloto in 2010, she claims – and the singer denies – in a new lawsuit. Capeloto, 22, claims she was forced to have sex with Sean, his bodyguard and a member of Sean’s band at a Seattle hotel three summers ago. She says she had smoked pot and downed 7-10 shots of vodka at the time. Capeloto, who is suing all three men , alleges she’d been invited to Kingston’s hotel room following a Justin Bieber concert where Kingston had also performed. When she showed up for a “meet-and-greet,” he was waiting … naked. She says the bodyguard picked her up and “placed her on top” of Sean. At that point, all three of the men proceeded to gang rape the girl while she was “obviously intoxicated, incapable of consent,” the lawsuit alleges. Capeloto says her friend eventually entered the room and rescued her, the cops were called, and she was taken to the hospital to receive treatment. For injuries consistent with rape, she notes. She says her life has been ruined by the trauma she has endured as a result of the alleged gang rape and she wants $5 million minimum in damages. Kingston has filed legal documents insisting the sex was 100 percent consensual, and criminal charges against the singer were dropped in 2010. Police concluded Capeloto wasn’t credible enough to make a legitimate case against him then, a point he will surely bring up in fighting this lawsuit. If this is true, the 23-year-old musician has much bigger problems than his alleged drinking, driving and texting habit. His trial is set for November.

Kanye, time to give up those coins. Kanye Sued For Attacking Photographer At LAX Kanye beat the criminal case, but he’s about to get robbed ski-mask style. According to TMZ Kanye West left an innocent photog in crutches after a brutal assault at LAX last month — when Kanye attempted to wrestle away the pap’s camera — so says the photog himself, and now he’s filed a lawsuit against the rapper. Daniel Ramos appeared with his lawyer Gloria Allred at a news conference Wednesday, where Gloria announced the lawsuit for assault, battery, and interference with Daniel’s civil rights (in this case free speech). Daniel — who called himself a “filmmaker” — says he spent two weeks on crutches after the attack, and has been walking with a cane for some time. He says he’s still in pain. Gloria argued the attack sets a dangerous precedent for celebrity-on-photog violence, especially now that various celebs are actually celebrating unprovoked attacks on photogs. Gloria says she’s also asking the court to issue a restraining order against Kanye. Ramos is suing for unspecified damages. Kanye has to learn to not let these dudes get to him. You big dummy. Police Detective Sues Ryan Leslie Diddy stole his girl then he finds a new girl, breaks up with her and then gets sued for a song he made about her. Damn. According to Mail Online Rapper Ryan Leslie is being sued by a New York Police Department detective for using the cop’s voice in a break-up song about his supermodel ex-girlfriend without permission. Australian bombshell Nicole Trunfio called the police on the musician in 2011 after he allegedly refused to stop calling her or knocking on her door. Detective Luis Mortimer followed up the complaint, leaving a voicemail on Leslie’s phone asking him or his lawyer to return his call. A year later, his message was being broadcast across the world in Leslie’s rap song ‘Joan of Arc.’ Now Mortimer is now taking Leslie to court after, claiming his career was damaged by the hip-hopper’s tune, which ends with the 15-year police veteran’s voicemail. According to The New York Post the jilted rapper was never arrested but he still claimed in the song to have been thrown in a holding cell for ‘messin’ wit pretty females.’ Other lines in the song include: ‘I wake up to detec’ messages in my e-mail,’and ‘since when a birthday gift is harassment/a rose gold bracelet nothing subliminal/You called your lawyer up said my actions were criminal. Girls play the victim so well — Joan of Arc.’ Mortimer only learned of his starring role a few months ago, when he started getting calls about it. ‘The song has caused him embarrassment and has damaged his credibility as a detective,’ his lawyer, Monica Kipiniak, told The Post. Mortimer claims Leslie’s unauthorized use of his voice is exploitation and violates his civil rights. He is seeking unspecified damages in a lawsuit filed with the Manhattan Supreme Court last week. In 2010, Leslie reneged on a $1 million reward he offered for the safe return of his missing laptop. The computer was found by a German man walking his dog. Lawsuits: Judge Takes Rihanna’s Side In Court Battle With TopShop Over Unapproved T-Shirts Bearing Her Image

Via MailOnline reports : Pop superstar Rihanna today won a High Court fight with clothing giant Topshop over a T-shirt they sold with her face on it in a case that could be worth £3million. The singer claimed the ‘unendorsed’ white T-shirt with a photograph of her in a bra top may have damaged her image because fans could have thought it was genuine merchandise. The Barbadian star, who sued under her real name Robyn Rihanna Fenty, claimed she is entitled to damages from Arcadia Group Brands Ltd, which operates Topshop, over the unauthorized use of her picture. Topshop disputed her claim but Judge Mr Justice Birss ruled in her favor today after a hearing in London, but will decide on damages at a later date. Justice Birss said Topshop’s sale of a Rihanna T-shirt at the center of the dispute was an act of ‘passing off’. But he said the ‘mere sale’ of a T-shirt bearing the image of a famous person was not necessarily an act of ‘passing off’. ‘A substantial number of purchasers are likely to (have been) deceived into buying (the) T-shirt because of a false belief that it has been authorized by Rihanna,’ he said. The judge said that was damaging to her ‘goodwill’ and represented a loss of control over her reputation in the ‘fashion sphere’. He said it was for the singer not Topshop to choose what garments the public thought were endorsed by her. The superstar’s team asked the high street clothing chain run by billionaire Sir Phillip Green to stop selling them. The legal threat came despite the What’s My Name singer having dined with Sir Philip and music mogul Simon Cowell while on her Christmas break to Barbados in 2010 . The star tweeted about the Boxing Day meal they had together, saying: ‘Just had dinner w/ Simon Cowell Philip Green @ Sandy Lane! Great night!’ She has also spent time with Sir Philip’s daughter Chloe while holidaying at the same time in the Caribbean two years ago. It was even rumored she might follow in the footsteps of Kate Moss and design a range for Topshop, but the two parties ended up in court. Last year Topshop released a T-shirt featuring a picture of Rihanna from her ‘We Found Love’ music video, which sold out quickly afterwards. This month the court heard that while the singer was claiming the top blighted her image it had not stopped her entourage contacting Topshop to ask for clothes for Rihanna half a dozen times since the lawsuit was launched, the retailer’s lawyers said. A barrister at London’s High Court claimed Rihanna’s representatives had asked Topshop for products for the singer on ’10 recent occasions’, and said her ‘shopping habits’ were testament to the retailer’s own considerable reputation. Of those 10 occasions, six came after Rihanna launched proceedings against Topshop, said Geoffrey Hobbs QC. The T-shirt in question is printed with a snap of the star wearing a bra top, which she says was ‘very similar’ to images used on one of her album covers. She claimed sales of the shirt amounted to ‘passing off’ and may have led to her reputation being tarnished with her fans, had they bought the garment thinking it was ‘genuine’ endorsed merchandise with ‘an emotional connection to their heroine’. Lawyers for Topshop maintained the retailer did nothing wrong, and accused the pop star of making an unjustifiable bid to establish a ‘free standing image right’ over use of her picture in the UK. Mr Justice Birss, sitting at London’s High Court, heard that Topshop bought a license to use the image on the T-shirt from the photographer who took it, during the video shoot for Rihanna’s single We Found Love which was filmed in Belfast and Bangor, Northern Ireland, in November 2011. Teen Victim Of Alleged Cleveland Serial Killer Was ‘A Good Girl’ According to NBC News All three women whose bodies were found wrapped in trash bags in a dilapidated northeast Ohio neighborhood have been identified, families and authorities said. The last two victims were identified Tuesday. One of them was 18-year-old Shirellda Helen Terry, the teen’s grandmother told The Associated Press. Officials identified the other victim as Shetisha Sheeley, 28, of Cleveland. Their bodies were found last week along with that of another woman in a dilapidated East Cleveland neighborhood dotted with abandoned houses. Rosetta Terry said authorities notified the family Tuesday that her granddaughter was one of the victims. She said Shirellda was last seen July 10, leaving a Cleveland elementary school where she had a summer job. Rosetta Terry described her granddaughter a caring person who would frequently attend Bible study groups and called and texted her mother. “She was a good girl; she was a hugger,” said Rosetta Terry. “We used to tease her that we were gonna put her on a hug diet.” The county medical examiner’s office did not confirm Shirellda Terry’s identity, saying the family had asked for time to inform relatives. Earlier Tuesday, East Cleveland Mayor Gary Norton identified Sheeley as among the victims. The identification was made through fingerprints and information from the tattoos, which “permitted the comparison” that led to her identification, said Thomas Gilson, Cuyahoga County’s medical examiner. Gilson said his office hoped to release information on how the women died within a few days. Shetisha Sheeley was arrested June 30, 2012, on a charge of firing a weapon from a vehicle but the case was dismissed three months later. Her court-appointed attorney, Michael Nelson, said there were no witnesses who saw her firing the weapon. Nelson told The Associated Press that Sheeley came from a troubled family background and never got help posting her $1,000 bond, keeping her locked up while the case moved through the courts. “She lived on the edge,” said Nelson, who recalled her as unemployed, living in an apartment alone and vulnerable as she struggled to make a life. The first known victim was identified by police on Monday as Angela Deskins, 38, of Cleveland, whose body was found Saturday. Norton said in brief remarks that he realized on hearing her name that he knew her family and went to school with some of her relatives. The Deskins’ family supported Angela and provided a place for her to live, the mayor said. “She always had a place to rest her head, they always assured that she had money to live with,” Norton said. “And just when she trusted herself — she was a very trusting person — entrusted herself to someone who had the worst of intentions, then and only then did this fate befall her.” Michael Madison, 35, is in custody facing preliminary charges of aggravated murder and kidnapping in the slayings. He is a registered sex offender who served four years in prison beginning in 2002 for attempted forced sex and attempted possession of drugs. Madison was moved from the East Cleveland jail Tuesday to Cuyahoga County Jail. East Cleveland police responded to a call about a foul order on Friday and discovered a body in a garage. Within hours they identified Madison as a suspect and went to his mother’s house where he was arrested after a brief standoff. They found the additional bodies Saturday after their questioning of Madison led them to renew their search. Authorities searched again Sunday but called it off without finding additional bodies. According to Rhymes With Snitch In what’s being called the first Instagram defamation lawsuit against a celebrity Karen Monroe is suing the Game claiming he cost her her present job and destroyed her ability to find work in the industry. In his post Game accused Karen of neglecting his children, smoking and drinking excessively around them and leaving a used condom in his daughter’s bedroom. Game warned other celebrities about letting Karen watch their children, including one of her other clients, Nas and Kelis. To make sure everyone knew who he was talking about, Game attached a picture of Karen to the post with the tagline “Beware if this person is watching your children! She is a very dangerous babysitter.” Karen is seeking unspecified damages. He should have just kept her name and picture out of it and now that ninja has to lose some of those coins. This is probably why 50 kicked him out of G-Unit…ninja has no loyalty and likes to put people on blast.
