A Florida judge delayed his decision today on whether to let George Zimmerman out of jail on bond a second time. Meanwhile, both prosecutors and the man accused of murdering Trayvon Martin and laid out elements of their case at the bond hearing. Judge Kenneth Lester revoked Zimmerman’s $150,000 bond earlier this month, believing the defendant and wife Shellie Zimmerman intentionally tried to mislead the court about their financial situation in April so he would be granted bond. Zimmerman denies lying and wants the $150,000 reinstated. George Zimmerman Bail Bond Hearing The pair did not disclose more than $100,000 raised through a legal defense fund website; Zimmerman’s wife was also charged with perjury. In a two-hour-plus hearing on Friday, Zimmerman asked for his re-release, which led to the defense and prosecution conducting a mini-trial of sorts. The state argued that Zimmerman is a criminal who should not be released, while the defense put forward evidence that he acted in self defense. The defense played the Trayvon Martin 911 call from February 26, the night he was killed. In April, Zimmerman was charged with second-degree murder. “There’s someone screaming outside. It sounds like a male. I think they’re yelling help,” a woman says in the call, as someone screams for help. Zimmerman’s lawyer Mark O’Mara then called his father, Robert Zimmerman, to the stand. He identified the screams heard on the call as his son’s. “It was absolutely George’s,” he said. In cross examination, prosecutors said Zimmerman claimed Martin had covered his mouth, contradicting his assertion that he screamed for help. O’Mara did not put Zimmerman on the stand. He briefly drew the ire of the judge when he asked whether Zimmerman could make a statement to him without facing cross examination. Lester called it a “backdoor” tactic and refused the request. At his first bond hearing, Zimmerman apologized to Martin’s family in open court.

George Zimmerman failed to identify himself twice and missed opportunities to defuse a confrontation with Trayvon Martin, a detective says in a newly released report. Zimmerman, a neighborhood watch volunteer, is charged with second-degree murder in the February 26 shooting death of Martin, 17, in Sanford, Florida. The report, which Florida prosecutors released Tuesday, includes a video of Zimmerman showing injuries he said he suffered in the altercation with Martin. Zimmerman, 28, told police he shot the teen in self-defense, but many feel he racially profiled Martin and ignored a 911 dispatcher’s advice not to follow him. Among the documents released was a report from a police officer who conducted computerized voice stress analysis tests on Zimmerman following the incident. “Mr. Zimmerman was subjected to two exams, and was found to be classified as No Deception Indicated,” the report said. Also released was an unredacted capias request, a request that someone be taken into custody, prepared by the lead police investigator in the case. Christopher Serino wrote in the report: “Investigative findings show that (Zimmerman) had at least two opportunities to speak with (Martin) in order to defuse the circumstances surrounding their encounter.” “On at least two occasions (Zimmerman) failed to identify himself as a concerned resident or a neighborhood watch volunteer.” The detective also said Zimmerman’s actions “are inconsistent with those of a person who has stated he was in fear of another subject.” In the same report, Serino wrote that Zimmerman’s injuries were “marginally consistent with a life-threatening violent episode as described by him.” The report is one of several key pieces of information, including the Trayvon Martin autopsy report , to be released in advance of the trial. Zimmerman’s defense attorney, Mark O’Mara, filed a motion Wednesday asking that his client be allowed to appear at a Friday bond hearing in “civilian clothing instead of a prison uniform and without restraints.” Zimmerman’s bail was revoked this month after after a judge said he misled the court about his finances. He had been released in April. Video and photos of Zimmerman shackled and wearing jail garb could prejudice prospective jurors, which is a serious concern, O’Mara said. In response to the document release, O’Mara said Tuesday it will be up to a judge and jury to interpret what Serino’s report means to the case. “His suggestion that it’s marginally consistent, again, is up for review. Those people will have to look at it, whether it’d be Judge (Kenneth) Lester in a motion hearing where the jury will also make that determination,” he said. He said a jury will decide “whether or not those injuries give rise to a reasonable belief in George’s mind that he was a victim of great bodily injury or death.” Martin’s family attorney, Benjamin Crump, said he agrees with the detective. http://www.cnn.com/2012/06/27/justice/florida-teen-shooting/index.html

Lawyers for George Zimmerman, the killer of Trayvon Martin, will ask a judge to release him from jail again after Zimmerman’s bail was revoked last week. The announcement comes as Zimmerman, 28, returns to a cell in the Seminole County jail in central Florida, after a circuit court judge revoked his bond. Judge Kenneth Lester Jr. yanked his $150,000 bond, posted in April, after prosecutors said both he and his wife had lied about their financial status. Free on bail or not, he faces trial on second-degree murder charges . They had failed to tell the court about at least $135,000 that anonymous donors had contributed to help bankroll Zimmerman’s legal defense in the case. “Mr. Zimmerman knew a sum had been raised … we feel the failure to disclose these funds was caused by fear, mistrust and confusion,” his lawyers said. “The gravity of this mistake has been directly illustrated, and [Zimmerman] understands this has undermined his credibility, which he will have to work to repair.” They also withheld one of two valid passports issued in George Zimmerman’s name, prosecutors said at a hearing. The judge pulled his bail as a result. The murder case has grabbed widespread media attention and sparked debate about U.S. race relations, profiling, media, guns and self-defense laws. Defense lawyers said in a statement posted on their website on Monday that Zimmerman, who went into hiding because of death threats after his previous release on bond, was unfairly “thrust into the national spotlight as a racist murderer.” The motion to re-post bail is expected to be filed Tuesday.
