Update: Judge Resentences Teacher Rapist Who Got 30 Days In Jail After 14-Year-Old Victim Killed Herself

Judge Resentences Teacher After Victim Kills Herself Via NewsOne reports: An embattled Montana judge is poised on Friday to try to undo his lenient sentence in the case of a teacher who raped a student, despite warnings from both prosecutors and the defense that he doesn’t have that authority. District Judge G. Todd Baugh stoked a furor when he sent former Billings Senior High School teacher Stacey Rambold to prison for just 30 days. The 71-year-old judge suggested in court that the 14-year-old victim shared responsibility in the case. The girl committed suicide in 2010 while the case was pending. After apologizing for his comments, Baugh now says a two-year minimum prison sentence appears mandatory and that his original sentence appears to be illegal. On the judge’s order, Rambold was returned from Montana State Prison for a Friday resentencing hearing in Billings. But the state already has appealed the case, and both prosecutors and the defense say only the Montana Supreme Court has the power to fix any mistakes made at the sentencing. On Thursday, the Montana Attorney General’s Office submitted an emergency petition asking justices to block the Friday resentencing. State attorneys said the hearing would “cause a gross injustice to an orderly appeal.” Baugh said earlier in the week that he intended to hold the hearing even if he was the only one who shows up. His office said late Thursday that the hearing would proceed. The reason we have laws to protect children is because their minds and bodies are not fully developed. Therefore they can make decisions that are not always in their best interests. A 14 year old girl, no matter how mature she looked and acted, is still a child. Continue reading

Chris Brown Hit-and-Run Case: DISMISSED!

Chris Brown’s hit-and-run case was just dismissed by a judge, marking a much-needed and somewhat surprising legal victory for the embattled R&B star. Prosecutors argued that Chris deserved to be punished, and severely at that, for his alleged vehicular law-breaking earlier this summer. Not happening. Chris’ hit-and-run victim struck a civil compromise with him; she didn’t want any money and the damage was so minor, she just wanted the case dismissed.  The L.A. City Attorney objected, arguing to the judge today that Brown was very aggressive toward the victim after the accident, which she did claim. Officials also argued that Brown was on felony probation and therefore his alleged misconduct was all the more serious, but the judge was not persuaded. The case was officially dismissed as of this morning. Brown’s lawyer, Mark Geragos said, echoing what Chris has said all along about this and other issues, “The case never should have been filed in the first place. “It’s unfortunate he was being prosecuted for who he is rather than what he’s done.” Team Breezy would concur. It’s nice they were at least able to hug. Tameka Loses In Custody Hearing Tameka and Usher have been through a lot…Usher saying Tameka’s not a good mom and vice versa. It’s a step forward for these two to embrace….maybe it’s a sign of a much needed truce. According to TMZ After a bitterly contentious hearing and drama surrounding the near-death of their son, Usher showed an unbelievably classy move in court Friday — hugging his ex-wife Tameka after the judge dismissed her request for primary custody. Pretty shocking … especially considering the painfully awkward silence that preceded the hearing. Tameka filed an emergency request for primary custody after her and Usher’s 5-year-old son Usher Raymond V nearly drowned in a pool on Monday. Usher currently has primary custody of their two boys. In court Friday, Tameka used the pool accident as an example of Usher being an inattentive father, who employs incompetent caretakers — in this case his aunt Rena — to look after their children. Usher’s lawyer shot back, insisting Usher’s a great dad and the children are thriving with him, despite the recent pool accident … which, Usher argued, could have happened to anybody. During questioning, Tameka broke down in tears talking about her son’s accident, saying she didn’t know if her child suffered permanent brain or heart damage. FYI, Usher Raymond V is still in the hospital — Tameka claimed it’s because of lingering complications, including a low heart rate. Usher said it’s because he doesn’t want his son discharged before doctors are 100% sure he’s okay. In the end, the judge sided with Usher, ruling the current custody order should stay in place … meaning Usher keeps primary custody, and Tameka gets a little. Peep the video below. Finally someone to save Amanda from herself. Amanda Bynes’ Parents Granted Temporary Conservatorship Even though her mom told her she never looked better than when she was 100 pounds, her parents seem to be the only ones with her best interest at heart. Hey if it worked for Britney, it could work for Amanda. According to TMZ The judge in the Amanda Bynes case just granted a temporary conservatorship to her parents. The judge based his decision in no small part on the findings of an investigator he appointed to evaluate Amanda’s mental health. As we first reported … Amanda was not in court, because doctors at the psychiatric hospital got a 1-month extension on her psych hold … because she’s “gravely disabled” with mental illness. Amanda’s lawyer told the judge … she’s spoken with the actress several times and Amanda opposes the conservatorship, believing it’s not necessary. The conservatorship not only covers Amanda’s personal well-being, it gives her mom the ability to manage her finances. Amanda’s $4 million savings have been rapidly depleted, though it’s unclear what she’s been spending money on. The judge cautioned the parents not to make any significant deals without consulting with Amanda’s lawyer. The judge said he’d like to have some face-to-face time with Amanda, so he can make a firsthand evaluation. The temporary conservatorship will last until Sept. 30. At that time the judge will hold a formal hearing on whether to make it permanent. Sounds a little fugazi that Amanda put in all that work and only has $4 million to show for it. Judge Revokes Chris Brown’s Probation, Breezy Is A Free Man…For Now

Isht is about to get real Chris . Chris Brown’s Probation Revoked A black man can’t catch a break in America. It’s like Chris does his best (in his mind) to stay out of trouble, but still gets phucked in the end. According to TMZ That was quick — the judge just REVOKED Chris Brown’s probation in the Rihanna beating case, but the singer will remain a free man … for now. Brown showed up at court today to fight the L.A. County D.A.’s motion to revoke his probation in the wake of hit-and-run charges stemming from a car accident in May … but the judge granted the motion anyway, paving the way for a probation violation hearing in August. If the judge determines Chris violated his probation, the singer could be sentenced to 4 years in prison. In the meantime, Brown has been released on his own recognizance. At least he’s free for now. If he can stay out of trouble until August, maybe the court will take it easy. Somewhere Frank Ocean is laughing. Continue reading
