Teacher Sentenced To 30 Days In Jail After Raping Student Who Committed Suicide This judge CAN’T be serious with this sentence … via AOL News Attorneys for a former Montana teacher who raped a 14-year-old student argued Friday that his 30 days in prison were enough punishment, even as a judicial oversight panel sought the censure of the judge in the case over what it called an unlawful sentence. Prosecutors want to send freed rapist Stacey Dean Rambold of Billings back to prison. They said in an appeal of his sentence that he should have served a minimum of four years after pleading guilty last year to sexual assault without consent. [Defense attorneys] suggested the girl bore some responsibility for the rape, and referenced videotaped interviews with her before she committed suicide while the case was pending. Those interviews remain under seal by the court. “The citizens of Montana have determined that persons as young as 12 years of age will be held accountable and responsible for their actions in regard to certain types of sexual offenses,” Rambold attorney Jay Lansing wrote. “There is no rational basis to conclude that if the person is 14 years of age, the person can only have responsibility if they are the offender.” We’re speechless.

Maybe if Chris actually went to jail, he would get his isht together. Chris Brown Avoids Jail Time In D.C. Case Chris has been given so many chances and can’t seem to get right. A seat on “Fix My Life” awaits. According to TMZ: Chris Brown would have gone to jail today if L.A. prosecutors had their way … because they asked a judge to send him directly to the pokey. Chris appeared for a hearing on the D.C. assault case, where he stands accused of beating up a guy last October. The hearing was held by the judge in the Rihanna beating case, who will decide if Chris violated his probation by allegedly committing the assault. Prosecutors asked the judge to throw Chris in jail immediately and set a probation violation hearing. Prosecutors claim “Brown’s violent behavior continues to increase in severity and frequency” and he poses “an increasing danger to society.” The D.A. claims they have now reviewed the D.C. case — interviewing witnesses and examining evidence — and they say there is reason to believe Chris is guilty as charged. The judge, however, ruled Chris was better off completing his 90-day rehab for anger management than being thrown in jail, so he shut down prosecutors. Hopefully, Chris can complete his rehab without anymore angry outbursts. TMZ

The woman loses her son and they want her to pay? That’s cold. AEG Asks Judge To Pay Court Costs Katherine has to deal with AEG not be held liable and now this. According to TMZ reports: Katherine Jackson is irate that AEG is asking her to pay more than $1.2 million in costs associated with the Michael Jackson wrongful death trial … claiming many of the so-called “expenses” are bogus. AEG — which won the case — is asking the judge to sock Katherine with court costs. But according to new docs, obtained by TMZ, Katherine is blanching at a bunch of them, including: – $540,000 in models and blow-up court exhibits – $20,000 for 1,000 pages of jury instruction paper and other stuff – $53,000 for process servers – $118,000 unnecessary depositions Katherine is even grousing about the $9 parking fees tacked on for court reporters to show up for the trial. A judge hasn’t decided what, if anything, Katherine will have to shell out. Michael must be turning over in his grave.

Charlie Sheen has gone off regarding his custody case in epic fashion, weighing on the ruling that awarded custody of his two sons to Brooke Muller’s brother. Calling the judge in the case Mr. “Italian judge anus-brain,” the actor threatened him if his kids, twins Bob and Max, are hurt in the newest custody setup. Brooke Mueller’s Brother Gets Custody of Charlie Sheen’s Twins The Warlock is not pleased, to say the very least, that Brooke Mueller’s brother Scott was given temporary guardianship of the boys in court Friday. “So lemme see if I got this straight,” Charlie Tweeted yesterday. “My twin boys are now in harm’s way and in grave danger, being ‘raised’ by a gaggle of incompetent and lascivious marionettes all ruled and fooled by an Adderall snorting husk called Brooke.” Oh, and it gets better yet … “And guess what CPS and ‘I’m Italian’ judge anus-brain,” he says. “You may have gagged me temporarily, but mark my unspoken words, anything happens to my boys, and you will get to know me, know who I truly am, a loving father. “Tag. I’m it.” The judge also allowed Scott and the children to live with Brooke so they could be close to school, which effectively gives Charlie’s ex-wife full custody back. The boys had been under guardianship of Denise Richards, Charlie’s other ex-wife, but she also has two little daughters by the actor, so she’s bowing out. Denise says Charlie is a great dad , and was proud to care for the kids, but believes Bob and Max have behavioral issues and it just got to be too much. Charlie adamantly wanted to keep the two boys away from Brooke, who is recovering from her latest bout with drug abuse. He feels she’s a danger to them. Other classic outraged Sheen quotes in response to the ruling: “This pig circus overflowing with buffoons, sycophants and heretics cannot be trusted to safely raise a colony of ferrets.” “Brooke will fail and her brother [who lives by the beach] will be selling his ass under a pier and the evil nanny will die from ugly.” “When, not if, this psychotic and desperately irresponsible sham goes sideways, DCFS will burn to the ground, topped off with the smoldering robe of the judge.” The best part? In court a few days ago, the judge slapped him with a restraining order and gag order and threatening him with jail if he blabbed like this again. He joked to the actor not to mess with him, saying “I’m Italian,” which is why Charlie worked that into his rant. As for the gag order, Sheen does not care. At all. “If this means being jailed for loving and trying to protect my children,” Charlie Tweeted with an asterisk at the end of his tirade, “then go for it.” Your move, Mr. Italian judge.

According to TMZ reports : Two prominent Beverly Hills doctors once featured on “Dr. 90210″ are locked in a child custody war involving wild allegations of abuse — and it all comes to a head this morning … as the 3 youngest kids will be separated from their older brother … TMZ has learned. Plastic surgeon Dr. Brian Evans and dermatologist Dr. Susan Evans’ nasty divorce took a dark turn last month when their oldest child filed legal docs, accusing his father of sexually abusing his younger siblings. According to a request for a temporary restraining order, filed by Brian and Susan’s 12-year-old son on Oct. 15 … Brian touched his 6-year-old son’s penis — and also touched the genitals of their 8-year-old twin daughters. Further, the eldest son claims Brian “hit me in the face, dragged me for 2 rooms” and threatened to kill the kids and their mom. According to the TRO request, this went down in Oct. 2012 … a full year before the TRO was filed. Attorneys for Brian flatly deny the allegations, and say authorities investigated and disproved them. In fact, on Oct. 24 the court issued a major modification of child custody … granting Brian legal custody of all 4 children, and physical custody of the three youngest ones. The handoff is scheduled to happen this morning in L.A. County Family court. The order also prohibits Susan from having any contact — “in person, by telephone, text, email, or otherwise” — with the 3 kids for the next 30 days. The oldest son will continue living with Susan. After the 30 days, Susan can have 4 monitored visits with the kids — but no overnights — and a month after that … she can ask to modify the custody order. Sources connected to Susan tell us she is perplexed as to why the judge ordered such a drastic change … especially in the wake of her son’s allegations of abuse. Something doesn’t sound right. It’s rare for a father to receive custody over an able mother in the first place but especially considering what he’s been accused of we gotta wonder what kinda dirt the judge heard about Susan Evans. Childhood friends Mark Ballas and Julianne Hough may be in a little bit of a tiff after last night’s Dancing With the Stars , in which she guest judged. After performing as a dance pro for five seasons, Julianne filled in for Len Goodman Monday, and weighed in on Ballas’ foxtrot with Christina Milian. Christina Milian and Mark Ballas – Dancing With the Stars Week 4 “There were moments where I felt like choreography-wise, I felt like it was two people dancing side-by-side rather than together,” she said on the show. “So I really want to see [Milian] shine. I’ve danced with Mark.” “You have to stand in front to make sure you’re seen.” Afterward, Ballas didn’t sound too thrilled with that. “The one comment to me that was a little funny is that I make it all about me… all the critiques were at me, not [Milian]. So I thought that was a little hypocritical,” he told Us . He had plenty of praise for Julianne Hough , however: “I think she was very insightful and gave great tips on lines and how to express. We’ve had a lot of guest judges and I thought out of all of them she was one of the best.” “So that, I love,” he said of the two-time Dancing With the Stars Mirror Ball champion. I was the one who kind of got the heat, but that’s OK! It’s fine.” The two go back a long way. She and brother Derek Hough moved to London to train with Ballas’ famous parents, dance champions Shirley and Corky Ballas. Julianne and Mark paired up for the Junior Olympics and both won medals for ballroom dancing. The two of them and Derek all went on to join DWTS . But Hough claimed she was “mentally and physically abused” while training in London, sparking rumors that she was pointing her finger at the Ballas family.

The photographer accusing Kanye West of battery at LAX Airport this summer won’t guarantee that he’ll stay away from ‘Ye, despite a judge’s request. Kanye West Attacks Photographer The judge overseeing the criminal battery charges against Kanye told the prosecutor to get in touch with the alleged victim, paparazzo Daniel Ramos. The goal was clear: ask him to stay clear of Kanye and not provoke him. Similarly, the judge also ordered West to stay 10 yards away from Ramos. Not a problem from West’s point of view. If he had his way, he’d never see these people again, least of all at his home at 4 a.m. But it’s not that simple. His lawyer, Blair Berk, told the judge that Ramos had been “stalking” and “harassing” Kanye in the past, and fears he will keep right on doing it. That appears to be the impetus for the judge asking the prosecutor to reach out to Ramos , who is being represented by civil lawyer Gloria Allred. Yes, Gloria is repping the man who badgered Kanye at LAX. Ramos claimed he had to consult with Allred before responding to the request, then offered only a “no comment” when contacted after doing so. Long story short? Dude may not even oblige. The interesting part, as TMZ notes, is that in Ramos’ civil suit against ‘Ye, he claims the attack caused him “physical and nervous pain and suffering.” So much pain that he won’t even agree to refrain from stalking Kim Kardashian ‘s baby daddy until after the pending case against him is resolved? He may still agree. But if he doesn’t, it’s telling.

Luckily, the courts feel otherwise. via NBC Philadelphia Former Penn State assistant football coach Jerry Sandusky should not get a new trial after being convicted of sexually abusing 10 boys, a Pennsylvania appeals court ruled Wednesday. The unanimous decision by a three-judge Superior Court panel came barely two weeks after they heard oral arguments by Sandusky’s lawyer and a state prosecutor. Defense lawyer Norris Gelman said he planned to ask the state Supreme Court to review the case. Sandusky had argued his trial lawyers did not have sufficient time to prepare, a prosecutor made improper references to him not testifying on his own behalf and the judge mishandled two jury instructions. The opinion by Judge Jack Panella said trial judges have discretion about whether to allow pretrial delays, and that in Sandusky’s case the judge carefully considered the continuance requests.
