Earlier today, Kelly Rutherford was ordered to bring her children to an emergency court hearing so that they could be returned their father, Daniel Giersch, in Monaco. Rutherford showed up, but didn’t bring the kids , which led a judge to inform her that she would face criminal charges if she continued in her refusal to comply with the court’s order. Lawyers for Giersch had already accused Rutherford of child abduction , so perhaps realizing that it’s hard to fight a custody battle from behind bars, she delivered her 8-year-old son and 6-year-old daughter to Giersch’s mother for transportation back to Europe. TMZ reports that the children are currently at the airport awaiting a flight back to Monaco, where they’ve lived with Giersch since 2012. The kids spent the past two months in LA with Rutherford for an extended visitation period. When their time together came to an end last week, however, the actress initially refused to surrender them to Giersch’s family. At first, it seemed as though she planned to fight to keep them in the US permanently. But with the threat of jail time looming and courts in both LA and Monaco determining that the kids belong in Monaco with Giersch, Rutherford wisely decided to give in. Rutherford will likely appeal the custody decision, but her recent act of disobedience is unlikely to help her chances.

Actress Kelly Rutherford has been fighting for custody of her two children for six years, and it now appears that she may have lost the battle for good. The children’s father, Daniel Giersch, is not an American citizen and is unable to legally reside in the US. As a result, a judge determined that the kids should live with him in Monaco, as he would be unable to visit them in the States. Rutherford has gone bankrupt battling the decision, and for a brief period back in May, it looked as though her efforts would be successful. Rutherford was awarded sole custody and immediately made plans to fly the children to LA, where they would live with her permanently. Before she was able to do so, however, Giersch appealed the decision and Rutherford was blocked from bringing the kids home . Now, the 46-year-old television star best known for her work on Melrose Place and Gossip Girl has been dealt another crushing blow, and her fight to regain custody of her children may be over. A California judge threw out Rutherford’s case today after determining that the matter had already been settled by a court in Monaco. As a result, Giersch will retain full legal custody of 8-year-old Hermes and 6-year-old Helena. Rutherford will no doubt appeal the decision, but at this point, it appears that she has little legal recourse.
John Nash, the Nobel Prize-winning mathematician whose life inspired the acclaimed 2001 film A Beautiful Mind, was killed in a car accident in New Jersey on Saturday. He was 86 years old. Nash’s wife, Alicia, was also killed in the crash. Police say the couple was riding in a taxi without seatbelts and were thrown from the vehicle when it struck a guardrail. Nash was best known for his work with game theory and he was awarded the Nobel Prize for Economics in 1994. The Ron Howard-directed biopic about Nash’s life depicted not only his mathematical brilliance, but also his lifelong struggle with schizophrenia. A Beautiful Mind went on to win four Academy Awards, including Best Picture. Moments ago, Russell Crowe, who portrayed Nash in the film, tweeted, “Stunned…my heart goes out to John & Alicia & family. Beautiful minds, beautiful hearts.” In their later years, the Nashes devoted themselves to working with mental health advocacy groups. Jennifer Connelly won an Oscar for her her portrayal of Alicia Nash in the movie that made the couple household names outside of the mathematics community. After a long, ugly legal battle, actress Kelly Rutherford has been awarded sole custody of her two children. A California judge has ordered that Rutherford’s son Hermes, 9, and daughter Helena, 5, be immediately returned to Los Angeles. The children have been living with their father, Daniel Giersch, in Monaco since 2012. Last month, it looked as though Rutherford had lost the legal fight to have her kids relocated to the States after a court ruled that the children should live with their German-born father, as Giersch is legally prohibited from entering the US, and thus would not be able to visit them in LA. The former Gossip Girl star refused to give up, however, and she reached out to her fans and famous friends to help her cause. A petition to bring Rutherford’s kids home recently reached 100,000 signatures. Kim Kardashian supported Rutherford on Twitter and publicly pleaded with President Obama to get involved in the custody battle. Sources say Rutherford is now bankrupt after spending over $2.5 million in lawyers’ fees in hopes of having her children returned to the States. Needless to say, the 46-year-old actress has considerable cause for celebration today. Unfortunately, Giersch is almost certain to appeal the judge’s decision, and Rutherford’s legal war is likely far from over. View Slideshow: Gossip Girl Cast: Then & Now
Desperate to bring her kids home from Europe, where they live with her estranged husband, Kelly Rutherford is taking her plight to the people. Kelly’s We the People petition asking for the government to intervene in her epic six-year custody case reached the 100,000-signature mark. That means the White House will review her request and issue a response … the question is whether it will matter at all in achieving her goal. The former Gossip Girl cast member said of the petition: “I feel so blessed to have so much support for me and my children. I am optimistic that the Obama administration will step in and rescue my children.” Listing off some of her famous supporters, she added: “I want to mention Ed Westwick, Kris Jenner, Kim Kardashian, Melanie Griffith, Selma Blair, Francis Fisher, Marianne Williamson and so many others.” Name-checking Kim Kardashian in a public plea to be taken seriously regarding a serious subject? Interesting strategy to say the least, Kelly. Recently Rutherford lost her legal fight to return Hermes, 8, and Helena, 5, to the U.S. from France, where they live with her ex Daniel Giersch. A California judge ruled that because his work visa had been revoked, the children would reside with him, and Rutherford must fly to go visit. Rutherford, ironically, is believed to be responsible for keeping him out of the U.S. after she reported him for dealing drugs and weapons. She adamantly denies this, and says that in their custody agreement, the judge told Giersch to reapply for his visa … which he has not done. So does Rutherford’s petition have a shot? A State Department spokesperson anonymously said that U.S. intervention would be unlikely. Rutherford’s attorney, Wendy Murphy, says a California family court judge violated Kelly’s constitutional rights and those of her children. “How on earth can two utterly innocent and defenseless American children be shipped like luggage to live in a foreign country?” she said. But a family lawyer not involved in the dispute argues that Rutherford would stand a much better chance in the international legal system. Her petition may be a powerful public cry and earn a lot of attention, but this is not a kidnapping case and Giersch was granted custody. In other words, it’s an uphill battle at best for Kelly. Best. Tabloid. Cover. EVER!!! The latest issue of Life & Style has taken this magazine to either a new high or a new low (depending on your perspective), screaming on its cover that not only are Miley Cyrus and Selena Gomez both pregnant… … but they are pregnant by the same man! What are the odds, huh?!? The affiliated article claims to state how each “found out about” the other, along with their “fight over the baby daddy” and the “desperate decisions that changed their lives forever.” Incredibly, this isn’t even the first time Life & Style has claimed Miley and Selena were pregnant . The question now, of course, is which man knocked up both stars. Cyrus us openly dating Patrick Schwarzenegger , while Selena is less openly dating DJ Zedd. The wild card, however, remains Justin Bieber . We all know his history with Selena, and he’s at least friendly with Cyrus. Might the three superstars have had too much to drink one night, thrown naked caution to the wind and there will soon be a pair of tiny little Beliebers running around?!? No? You don’t think so? Neither do we. View Slideshow: 43 Hilariously Untrue Tabloid Stories
After months of rumors, it looks like it’s officially over between Leah Messer and Jeremy Calvert. Messer moved out on Calvert last week and today, In Touch is reporting that Calvert has filed for divorce at a West Virginia courthouse. Sadly, Leah’s problems don’t end there. Messer’s pain pill addiction has been the stuff of tabloid fodder for over a year, and now, sources say the troubled Teen Mom is finally seeking help. “She’s confessed to Jeremy that she has a problem, and knows she has no other choice than to go to rehab immediately,” a source says. “She won’t say she has a drug problem or needs rehab. She’s saying she’s going to go away to a ‘therapy intervention’ place for three or four weeks so she can find herself and help herself be a better person.” Insiders say they don’t believe Leah’s addiction was the final straw for Jeremy, as the two of them have been struggling for quite some time. Earlier this month, Leah and Jeremy spent their wedding anniversary apart , and Jeremy was photographed not wearing his wedding band. The difficulties reportedly began when Calvert accused Messer of cheating on social media. Though she later convinced him to give her a second chance, sources say the damage was already done, and Jeremy enjoyed the attention he received from other women while they were on a break. Former Gossip Girl star Kelly Rutherford has lost her legal battle with ex-husband Daniel Giersch, with whom she has been battling over their two kids. The stakes were high. Helena and Hermes live abroad with their German-born father per a judge’s order, and despite Kelly’s efforts, it will stay that way. Although they have joint custody, Daniel has been denied the ability re-enter the U.S., and the court has ordered the children to live with him abroad. The rationale was that Kelly was able to freely travel, so she could go visit them. The actress has contested this but her legal challenge was denied. Not even dating Matthew Settle in real life can soften that blow. She said recently: “My children, not only were they taken away, but they were sent to a foreign country. I don’t know how you even explain to someone what it feels like.” “I could sit here and tell you how often a cry. I can tell you how it feels to leave my kids in a foreign country. ‘I told my son…’You know, mommy is still fighting for you.'” “To go see them after not seeing them for weeks on end … not being able to take them to school, pick them up from school, dress them, smell them, hug them.” It’s confusing, but Giersch was ordered to apply for another visa, but hasn’t done so. Kelly tried to go to federal court, but they said that since the children hadn’t been deported, they couldn’t intervene. Giersch’s attorney said in a statement: “Daniel Giersch continues to protect the children from any negativity and therefore will continue to not engage in any of these unfortunate and false media fabrications.” Fabrications, he says, “which only served one person, but clearly not the children.” This legal fight has been so long and costly that Kelly Rutherford is bankrupt or close to it as a result of the attorneys’ fees and time spent not working.
