By Gil Kaufman Lindsay Lohan at her court hearing on July 6 Photo: David McNew/ Getty Images As if further proof was needed, Lindsay Lohan cemented her bad-girl status Tuesday during a probation violation hearing by writing the message “f— u” on her fingernail . But did the profane memo on the nail of her middle finger land the formerly promising actress a harsher sentence? Legal experts contacted by MTV News don’t think so but all agreed that, at best, it was bad form, and at worst, it was another example of a young Hollywood starlet who appears to be out of control and not seriously considering the repercussions of her actions. New York attorney Benjamin Brafman — who defended Diddy in his 2001 Club New York gun case, New York Giants receiver Plaxico Burress in his 2008 gun case and was on the defense team for the 2004 Michael Jackson child-molestation trail — said sometimes celebrities are their own worst enemies in court. “If this happened the way it did, the lawyer needs to take charge,” he said. Brafman, who is not involved in the Lohan case and has no firsthand knowledge of what happened in court Tuesday, added that Lohan doesn’t seem to be doing herself any favors with these kinds of outbursts. “I don’t think that influenced [the sentence] … and [it should have] no role in the proceedings, but it’s bad form, childish and at some point, you need to grow up about stuff like this,” he said. “When you’re in a position of begging for your freedom, you don’t need to do anything to antagonize the judge who has that power over you.” Lohan, 24, was sentenced to 90 days in jail to be followed by 90 days in rehab after judge Marsha Revel determined that the “Mean Girls” star had violated her probation from a 2007 DUI case by missing weekly alcohol-education classes . Closeups of photos taken by The Associated Press revealed that Lohan had the message “f— u” imprinted on the rainbow-airbrushed nail of her middle finger, which she frequently pressed to her lips and cheek during Tuesday’s hearing. At press time, it was unclear if Lohan entered the courtroom with the profane nail tat or if she scribbled it on during the course of the nearly daylong hearing. “She’s like anybody else and she has the right of free speech,” said attorney Stacey Richman, who defended rapper Lil Wayne in a New York gun case that sent the MC to prison for a year but does not have firsthand knowledge of the Lohan case. “But you should have respect for the forum. It’s unclear who it was meant for, but the judge is a logical person and not vindictive. So whatever the judge’s decisions are, they should have to do with the violations [not the message on the nail].” If it comes out that it was meant as a coded message to the judge, Richman said there could be sanctions. “But if someone let her do that, they should know better,” she said. As the actress faces a 90-day jail sentence, industry veterans are divided on what it means for Lohan’s career. By Eric Ditzian Lindsay Lohan in “Georgia Rule” Photo: Universal Pictures Lindsay Lohan’s 90-day jail sentence caps a long history of legal issues reaching back at least to her 2007 DUI arrest and comes at a time when the 24-year-old actress is trying to piece her career back together. The jail time, which is to be followed by a 90-day in-house stay at a substance-abuse clinic, will prevent Lohan from publicizing an upcoming movie and delay production on another one. What’s more, Lohan will be unable to continue promoting her new fashion line, 6126, which is expected to begin shipping to stores this month. So just how much will Lohan’s professional life suffer now that her ability to jumpstart new projects and promote existing ones has been compromised? Will the actress — once a rising star with box-office hits like “Freaky Friday” and “Mean Girls” — survive her current woes and make a Hollywood comeback? “The simple stroke is that she already destroyed her movie career,” said David Poland of MovieCityNews.com. “Is she insurable on a film right now? Probably not. What was a bad reputation has turned into a legally defined problem.” To wit, Lohan has already lost at least one job because of her public notoriety, having been fired from “The Other Side” in April. Writer/director David Michaels explained it this way at the time: “The producers of the movie have reported that financiers have been resistant to finance the movie with Lindsay in the lead role,” adding that Lohan was simply “not bankable.” Still, the director of “Inferno,” a biopic in which Lohan is set to star as 1970s porn star Linda Lovelace, has came out in support of the embattled actress. “I am 100 percent behind Lindsay and can say the same for everyone involved in the production of ‘Inferno: A Linda Lovelace Story,’ ” Matthew Wilder told MTV News in a statement after her jail sentence was announced on Tuesday. “Indeed, we are proud to have this remarkable artist work on our film.” Other producers shared the sentiment. The Associated Press reported that Lohan is in negotiations for a part in the upcoming Willie Nelson movie “The Dry Gulch Kid,” and that production would be postponed if she wanted the role. “We’re behind her,” producer Kerry Wallum said. “We’ll wait until all of this blows over.” How long will that take? And will Lohan be able to step back into the limelight? That depends on how she handles herself, both in private and in public, in the weeks and months ahead, according to one Hollywood PR vet. “She can take this and she can learn from it and it becomes a cathartic event in her life,” said Howard Bragman, founder of publicity firm Fifteen Minutes. “The one thing we haven’t heard from Lindsay is, ‘I’m sorry, I have a problem, I’m going to resolve it.’ She doesn’t have PR problems, she has life problems. You can’t fix your problems until you admit you have them. I think she needs a lot of therapy. She needs to let her career be second and her life be first.” Before she can get her life back, though, Lohan is headed to prison, and Bragman maintained that if she deals with it appropriately, she has a shot at resurrecting her career. “I would [tell her to] shut up until she gets of jail,” Bragman said of an ideal approach for the actress. “I would be working quietly on my post-jail career plans and life. Robert Downey Jr. was certainly one who’s overcome some demons and come back in a big way. I think it’s possible for Lindsay. This town is full of people who have overcome problems.” At least one industry insider thinks the widely viewed footage of Lohan sobbing as the judge laid out her sentence will actually help her fortunes. “Is Lohan more marketable now?” wrote Jeff Wells of Hollywood-Elsewhere.com . “Will raising the dough for ‘Inferno’ be a tad easier? I would think so.” “There’s also the matter of LiLo’s acting talent — which she has a fair amount of — and the fact that her addictions have been taking her down and that she really needed a combination wake-up and face-slap,” Wells wrote. “I know that the lives of people who make constant whoopee always turn tragic — hurt careers, disease, early death, financial issues. That judge did LiLo a huge favor.” “Has she hit bottom yet?” Movie City News’ Poland wondered. “Doesn’t seem like it. And once she does, she’ll still have to be in ‘movie jail’ for years before she is allowed a comeback. If she comes back, it will have to be ironic. It’s not like she has a big personality, like Downey. Cute is over. Sexy is already wearing too much makeup. Lohan, 24, who was sentenced to 90 days in jail to be followed by 90 days in rehab for violating her probation from a 2007 DUI case by missing weekly alcohol-education classes . Close-ups of photos taken by The Associated Press revealed that Lohan had the message “F— U” written on the airbrushed nail of the middle finger on her left hand, which she frequently pressed to her lips and cheek during Tuesday’s hearing. At press time, it was unclear if Lohan entered the courtroom with the profane nail art or if she scribbled it on during the course of the nearly day-long hearing. It was also unclear for whom the message was intended. Lohan’s lawyer could not be reached for comment. “As far as I knew, I was in compliance with my programs. … I wasn’t trying to get special treatment,” said Lohan, whose crying jag instantly became a ubiquitous image on the Internet within minutes of the sentencing. “I have to provide for myself. I have to work. Having said that, I did everything to balance my jobs and showing up. … I’m not taking this as a joke; it’s my life and career. … I take responsibility for my actions. I’ve tried to do the best I can. It’s been such a long haul. I don’t want you to think I don’t respect you and your terms.” A legal analyst for the “Today” show, Dan Abrams, said on Wednesday morning that the sentence handed down was a “very stiff” one that was most likely meant to send a message to Lohan, as well as to the rest of the community looking on. “If she’d been anyone else, she’d be serving less time than anyone else in this case,” Abrams said. Lohan is scheduled to surrender on July 20 to begin serving her jail term and is likely to only serve a quarter of her sentence due to jail overcrowding, meaning she could be out after serving less than 25 days. Carter Lindsay Lohan in court Tuesday Photo: MTV News Lindsay Lohan was sentenced to 90 days in jail and 90 days in a drug rehab center on Tuesday (July 6) for violating probation, but it was hardly the actress’ first brush with the law. MTV News takes a look back at Lohan’s legal issues, as well as her trouble with drugs and drinking: February 2, 2005 : A personal-injury suit is filed against Lohan by Eddie Pamilton and Ilex Harris, who claim the actress injured them in a traffic accident that took place the year before. October 4, 2005 : Lohan is transported to a hospital for minor injuries after she crashed her car into another vehicle in West Hollywood, California. The then-19-year-old actress collided into the passenger’s side of a van that was turning in front of her, which then collided with a parked van. A passenger in Lohan’s car and the driver of the van suffered moderate injuries and were transported by ambulance to an undisclosed hospital. January 2006 : Vanity Fair reports that Lohan admitted she had bulimia during an interview, but Lohan denies that she has an eating disorder . The article quotes Lohan as saying, “I was sick. Everyone was scared. And I was scared too. I had people sit me down and say, ‘You’re going to die if you don’t take care of yourself.’ ” January 2007 : Lohan checks into rehab for the first time. “I have made a proactive decision to take care of my personal health,” the singer says in a statement. “I appreciate your well wishes and ask that you please respect my privacy at this time.” In December, Lohan’s publicist revealed that Lohan had been voluntarily attending Alcoholics Anonymous meetings. May 26, 2007 : Lohan gets arrested on suspicion of driving under the influence after her Mercedes convertible strikes a curb in Los Angeles. Police reported that they found a substance they believe to be cocaine at the scene. May 28, 2007 : Lohan checks into rehab again . “Lindsay admitted herself to an intensive medical rehabilitation facility on Memorial Day,” a representative for the singer/actress says in a statement. “Because this is a medical matter, it is our hope that the press will appreciate the seriousness of the situation and respect the privacy of Lindsay as well as the other patients receiving treatment at the facility.” June 14, 2007 : Lohan is accused of being drunk when she crashed into a parked van in Beverly Hills in October 2005, according to a lawsuit. Raymundo Ortega claims Lohan — who was 19 years old at the time — “consumed alcohol and became intoxicated” at the Ivy restaurant before the accident. July, 14, 2007 : Lohan checks out of Promises rehab facility after more than six weeks and celebrates the end of her 45-day stay by soberly partying with some friends at Pure nightclub in Las Vegas. July 24, 2007 : Less than two weeks after leaving a rehabilitation facility, Lohan is pulled over by police early in the morning and arrested on five counts, including driving under the influence of alcohol, driving on a suspended license and possession of narcotics. Lohan checks into an undisclosed rehab facility hours after the arrest. August 14, 2007 : Lohan gets sued again , this time for assault and negligence by one of the passengers who was traveling in the car the actress allegedly chased the month prior while driving under the influence. August 23, 2007 : Lohan gets charged with seven misdemeanor counts for her two DUI arrests earlier that year. She reaches a plea deal, saying she would spend one day in jail, serve 10 days of community service and complete a drug-treatment program. Lohan is placed on 36 months’ probation and required to complete an 18-month alcohol-education program and pay hundreds of dollars in fines. She also is to finish a three-day county coroner program that required her to visit a morgue and talk to victims of drunken drivers. “It is clear to me that my life has become completely unmanageable because I am addicted to alcohol and drugs,” Lohan writes in a statement released to MTV News. October 5, 2007 : Lohan leaves a two-month rehab stint at the Cirque Lodge Treatment Center in Utah. She is also seen with her estranged father, Michael, who was carrying her suitcases. December 31, 2007 : In a video posted on TMZ, Lohan drinks straight from a bottle of champagne while partying in Italy. October 16, 2009 : Lohan shows up more than an hour late to a probation hearing in Beverly Hills for a progress review on her two DUI cases. She gets another year of probation tacked on due to failure to complete alcohol-education classes as required. April 26, 2010 : Lohan is asked to leave the film “The Other Side.” The director says Lohan was fired because she is not “bankable.” June 8, 2010 : A Beverly Hills judge issues an arrest warrant for Lohan and orders her to post $200,000 bail after she violates a court order to not consume alcohol while wearing a SCRAM alcohol-monitoring ankle bracelet . The warrant is recalled after bail is posted . July 6, 2010 : Lohan is sentenced to 90 days in jail and 90 days in rehab for violating her probation.
