Via Washington Post “President Obama on Thursday signed a memorandum requiring hospitals to allow gays and lesbians to have non-family visitors and to grant their partners medical power of attorney. The president ordered the Department of Health and Human Services to prohibit discrimination in hospital visitation. The memo is scheduled to be made public Friday morning, according to an administration official and another source familiar with the White House decision. An official said the new rule will affect any hospital that receives Medicare or Medicaid funding.” In the memo the President said “Every day, all across America, patients are denied the kindnesses and caring of a loved one at their sides whether in a sudden medical emergency or a prolonged hospital stay.” UPDATE: On Anderson Cooper 360, Janice Langbehn discussed how her story inspired the White House to make this order. Langbehn received a call from President Obama today, who apologized for the ordeal that she had gone through at a Jackson, Florida hospital. She was denied access to her partner her, despite having power of attorney and other legal documents that should have granted her medical access. Langbehn's was not allowed to see her partner until just moments before her death. Langbehn says that Lisa, her partner's death, “was not in vain.” She appreciates the apology from President Obama despite not having received an apology from the hospital, which announced this week that they have changed their access policy to include LGBT families. The Human Rights Campaign, a lobby group that specializes in LGBT issues has stated that they have been “working on the request––” with the White House “for months.” Full Body of the Memorandum: MEMORANDUM FOR THE SECRETARY OF HEALTH AND HUMAN SERVICES SUBJECT: Respecting the Rights of Hospital Patients to Receive Visitors and to Designate Surrogate Decision Makers for Medical Emergencies There are few moments in our lives that call for greater compassion and companionship than when a loved one is admitted to the hospital. In these hours of need and moments of pain and anxiety, all of us would hope to have a hand to hold, a shoulder on which to lean — a loved one to be there for us, as we would be there for them. Yet every day, all across America, patients are denied the kindnesses and caring of a loved one at their sides — whether in a sudden medical emergency or a prolonged hospital stay. Often, a widow or widower with no children is denied the support and comfort of a good friend. Members of religious orders are sometimes unable to choose someone other than an immediate family member to visit them and make medical decisions on their behalf. Also uniquely affected are gay and lesbian Americans who are often barred from the bedsides of the partners with whom they may have spent decades of their lives — unable to be there for the person they love, and unable to act as a legal surrogate if their partner is incapacitated. For all of these Americans, the failure to have their wishes respected concerning who may visit them or make medical decisions on their behalf has real consequences. It means that doctors and nurses do not always have the best information about patients' medications and medical histories and that friends and certain family members are unable to serve as intermediaries to help communicate patients' needs. It means that a stressful and at times terrifying experience for patients is senselessly compounded by indignity and unfairness. And it means that all too often, people are made to suffer or even to pass away alone, denied the comfort of companionship in their final moments while a loved one is left worrying and pacing down the hall. Many States have taken steps to try to put an end to these problems. North Carolina recently amended its Patients' Bill of Rights to give each patient “the right to designate visitors who shall receive the same visitation privileges as the patient's immediate family members, regardless of whether the visitors are legally related to the patient” — a right that applies in every hospital in the State. Delaware, Nebraska, and Minnesota have adopted similar laws. My Administration can expand on these important steps to ensure that patients can receive compassionate care and equal treatment during their hospital stays. By this memorandum, I request that you take the following steps: 1. Initiate appropriate rulemaking, pursuant to your authority under 42 U.S.C. 1395x and other relevant provisions of law, to ensure that hospitals that participate in Medicare or Medicaid respect the rights of patients to designate visitors. It should be made clear that designated visitors, including individuals designated by legally valid advance directives (such as durable powers of attorney and health care proxies), should enjoy visitation privileges that are no more restrictive than those that immediate family members enjoy. You should also provide that participating hospitals may not deny visitation privileges on the basis of race, color, national origin, religion, sex, sexual orientation, gender identity, or disability. The rulemaking should take into account the need for hospitals to restrict visitation in medically appropriate circumstances as well as the clinical decisions that medical professionals make about a patient's care or treatment. 2. Ensure that all hospitals participating in Medicare or Medicaid are in full compliance with regulations, codified at 42 CFR 482.13 and 42 CFR 489.102(a), promulgated to guarantee that all patients' advance directives, such as durable powers of attorney and health care proxies, are respected, and that patients' representatives otherwise have the right to make informed decisions regarding patients' care. Additionally, I request that you issue new guidelines, pursuant to your authority under 42 U.S.C. 1395cc and other relevant provisions of law, and provide technical assistance on how hospitals participating in Medicare or Medicaid can best comply with the regulations and take any additional appropriate measures to fully enforce the regulations. 3. Provide additional recommendations to me, within 180 days of the date of this memorandum, on actions the Department of Health and Human Services can take to address hospital visitation, medical decisionmaking, or other health care issues that affect LGBT patients and their families. This memorandum is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person. You are hereby authorized and directed to publish this memorandum in the Federal Register. The Republican rhetoric sounded tough on financial regulatory reform early this week. “Shame on the president,” said Sen. Scott Brown (R-Mass.), who complained that President Barack Obama was derailing bipartisan negotiations on Wall Street reform for short-term political gain. But behind such tough talk is a realization within Republican ranks that several of their own may find themselves voting with Obama when the final Wall Street reform deal comes together. “Some feel like you need to vote for it, just because it’s a popular measure,” said Sen. Lindsey Graham (R-S.C.). What’s striking about the potential GOP “yes” votes is how they differ from the usual suspects who were the focus of such heated speculation during the health care debate. In addition to such perennial GOP maybes as Graham and Sens. Susan Collins and Olympia Snowe of Maine, lobbyists are also talking about Republican senators closer to the core of the party who might side with Obama, including Bob Bennett of Utah and perhaps even John McCain of Arizona. Call them the unusual suspects. Democrats need at least one GOP vote, and the speculation is intensifying as Senate Majority Leader Harry Reid (D-Nev.) says he wants to bring the bill to the Senate floor as early as next week. But one Republican financial lobbyist predicts a domino effect if Republicans get on board: “If one goes, 20 will go. It will be ‘open the floodgates.’” READ MORE AT LINK added by: HowdyDo

Exit Through the Gift Shop is the first and perhaps the last movie to be made by the mysterious English street artist Banksy, and although it’s partly about himself and his fellow night marauders — among them Shepard Fairey, now most famous for that ubiquitous red, blue and cream Obama poster, but also the creator of the Andre the Giant sticker campaign of the late 1980s — there’s nothing self-aggrandizing about it. Or perhaps everything about it is self-aggrandizing. The picture strives to capture the spirit and style of street art, and to make a bold statement about its commodification: Banksy’s work, in particular, is prized by collectors and fetches high prices in the art market. But if Banksy is getting rich, he doesn’t seem to be too happy about it. And so he has framed his film as a rags-to-raggedy riches story in which an enthusiastic street-art fan — a nutball Frenchman transplanted to Los Angeles named Thierry Guetta — first becomes a Banksy disciple and then surpasses his teacher, launching a mega-million-dollar art career of his own.

Even for the cast members of Glee , who are coasting through an Emmy award-winning freshman year, last week’s appearance on the Oprah Winfrey Show was special. But for Harry Shum, Jr., who plays Mike Chang, the episode was his introduction to America via Matthew Morrison, who when summoned to show off his dancing abilities, turned the attention onto 25-year-old co-star: “This guy is incredible, and I’m so happy there is a show called Glee that can showcase the talents of someone who just breathes dance.” For those who were unfamiliar until last week, Shum, Jr. starred in the iconic iPod “silhouette” campaign, appeared in two Step Up movies and co-choreographed a number during this year’s Academy Awards. In anticipation of the show’s mid-season premiere tonight, Harry Shum Jr. phoned Movieline to discuss his whirlwind week performing for the Obamas and Oprah, his days dancing for Beyoncé and the unlikely companion he found on the set of Glee

Barack Obama wasn’t a big fan of Sarah Palin’s uninformed criticism of his nuclear arms treaty with Russia this week. But at least the President, along with all rational human beings, can take solace in Palin’s existence for one reason only: it’s enabled Tina Fey to deliver the best satire television has seen in years. The actress was at it again last night, impersonating the former Alaskan Governor (and current professional, paid speaker of BS) on Saturday Night Live . Fey introduced viewers to The Sarah Palin Network, which is comprised of the following programs: Are You Smarter Than a Half-term Governor? Tea Party Wheel of Fortune (Example of a puzzle: Obama is a Terrist) Hey, Journalist, I Gotcha! (Where “I re-edit my interviews with journalists to make it look like they were the ones that were woefully unprepared.”) Man in a Helicopter with a Sniper Rifle vs. Wild It takes a lot to upstage Justin Bieber on the show , but Fey did it with this great skit. ‘He was one of the babies in ‘Baby Mama,’ Fey jokes about teen sensation. By Josh Wigler Justin Bieber performs on “Saturday Night Live” Photo: NBC Justin Bieber was this week’s musical guest on “Saturday Night Live,” but the teen sensation’s appearance went far beyond that. In fact, Bieber practically acted as a co-host for Tina Fey by energetically participating in several of the show’s skits. Bieber made his debut during Fey’s opening monologue. The “30 Rock” star joked that she’d noticed an unusual amount of young female fans throughout the week’s preparations for the show. “I must be more of a role model than I thought,” she deadpanned before acknowledging that the fan base had actually gathered for Bieber. “He was one of the babies in ‘Baby Mama’ — two years ago,” she joked about her past association with the singer. Bieber then joined Fey on stage for a brief rendition of “I’m Every Woman” (a hit for both Chaka Khan and Whitney Houston), which was used to comically demonstrate how Fey juggles her responsibilities on “30 Rock,” “Date Night” and other creative endeavors, including her guest stint on “SNL.” Later, Bieber starred in a skit as Jason Deeps, a C+ student in Tina Fey’s fictional high-school science class. Fey’s teacher character constantly fantasized about Bieber’s character, a student she described as “a dreamy Christmas elf” who looked like “a baby bunny sniffing a tiny flower.” In response, Bieber’s Deeps flirted with Fey — presumably setting young hearts aflutter across the country — and sang her a variety of fantasy songs, during which he promised to “buy her a Panini and some spanks to make her teeny.” Immediately thereafter, Bieber hit the stage for an energetic performance of “Baby,” the hit single from his My World 2.0. LP . Accompanied by a group of dancers, Bieber did a solid job on the song’s rap section , performed by Ludacris on the record. For his second performance, Bieber sang “U Smile.” At the end of the song, Bieber told Fey that every time she smiles, he smiles. In addition to Bieber’s contributions, the “Saturday Night Live” gang lampooned several hot topics including Jesse James’ alleged infidelity towards Sandra Bullock, Tiger Woods’ recent return to golf and President Barack Obama’s 2010 Census Form. Fey also reprised her famous impersonation of Sarah Palin, pretending to launch an Oprah Winfrey-inspired television network with programs such as “Are You Smarter Than a Half-Term Governor,” “That’s So Palin” and “The Tonight Show With Jay Leno.” The Fey-Bieber lovefest concluded with a big hug during the show’s finale.
