Today, according to a TMZ report, Elliott will be cleared of all charges after the prosecutors found major inconsistencies with the woman’s story. The woman initially told investigators of 5 different incidents (July 15-22) where she was assaulted by Elliott Although they are not calling the unidentified woman woman an outright liar, they ARE saying there isn’t enough evidence to blame Ezekiel for the bevy of injuries depicted in the photographs they collected. According to The Sun Sentinel: A South Florida naturalist, arrested on charges that he helped take freaky photographs of his three young daughters and shared them with other men, is putting on an unusual defense. Brian Martens, 53, who was living at a nudist colony in Palm Beach County, is arguing that there is nothing freaky about the pictures and that they are regular family portraits of a naturist family. Federal prosecutors say they believe several of the photographs are clearly inappropriate and the final judgment call should lie with a trial jury. A grand jury has already voted there was enough evidence to indict Martens on one count of producing child pornography and one count of receiving child pornography. U.S. Magistrate Judge Bill Matthewman agreed with the U.S. Attorney’s Office after reviewing the photographs during a hearing Wednesday in federal court in West Palm Beach. “Several of these photos the court has reviewed are lascivious. … They are, in the court’s opinion, sexually explicit,” Matthewman said. The judge ordered Martens detained without bond pending his trial — on the grounds that he is a serious flight risk and poses “a clear risk of danger to the community, and specifically to his daughters.” Marten’s attorney James Eisenberg agreed that one of the photographs is inappropriate — one the judge described as a close-up shot of one of the girl’s genital area — but said his client did not know the photograph was taken and never gave his permission for it to be shot. Martens hired a professional family photographer to take family portraits, Eisenberg said. “The girls have no clothes on … but they’re not doing anything of a sexual nature,” Eisenberg said. “If they were young ladies who had clothing on, no one would consider them freaky.” “Totally au naturale … is the normal state of all the people who live there,” Eisenberg said. “In the context that everybody in this family are naturists … these photos are not lewd or pornographic in any way.” Martens, who was arrested Oct. 29, would face between 15 and 30 years in federal prison if convicted of the child pornography charge, and five to 20 years if convicted of receiving child pornography. An unsettling and unusual story today out of Arizona, as a man has admitted to murdering his wife and adult son because he was concerned he had contracted HIV from prostitutes many years ago and may have spread it to his spouse. Eugene Maraventano owned up to these horrific crime in a probable cause statement filed in court, police said Monday. The 63-year old says he stabbed his wife, Janet, with a 14-inch kitchen knife when she slept and then killed his 27-year old child, Bryan. There’s no official word on whether Eugene or Janet had the AIDS virus, but the former told authorities he often frequented hookers while working in New York. His fear that he passed it along to his wife caused him to kill her, while he admitted to taking his son’s life because he didn’t think Bryan – who he believed to be mentally disabled – could cope without his parents. Maraventano called 911 on Saturday to report the crimes, which detective say were committed Thursday. Maraventano also says he tried – and obviously failed – to commit suicide on several occasions.

The gibbon featured in the photographs is an infant and should be with his mother at all times. “Besides the emotional trauma that he has undoubtedly suffered as a result of the separation, his delicate immune system is still developing, and he is susceptible to illnesses that humans carry. “All the animals in the photographs are endangered and should be protected, rather than being treated like props.” Miami’s Zoological Wildlife Foundation provided the gibbon in question, however, and a spokesperson tells E! : “Our animal our not taught to do tricks. They simply are raised with dignity, much love and respect. PETA’s comment about them being ‘ripped off their mothers from the wild’ is at best ludicrous.” Moreover, it’s clear at least one one unusual animal is a fan of Upton: Wolverine point guard Spike Albrecht Tweeted at the Michigan native yesterday!
