Suit: Teacher fired for having premarital sex

A Florida teacher's lawsuit against her old school says she was fired because administrators found out her baby was conceived before her wedding. Jarretta Hamilton, a former fourth-grade teacher at Southland Christian School in St. Cloud, said she approached administrators in April 2009, shortly after her wedding, to tell them she was pregnant and request maternity leave for the coming fall, WKMG-TV, Orlando, reported Wednesday. “That's when the question was posed to her, 'Did you conceive prior to marriage?'” said Edward Gay, Hamilton's lawyer. He said Hamilton told administrators the truth, the baby was conceived about three weeks before the wedding, and she was fired one week later without being allowed to finish the school year. Gay said he received a letter from Southland Christian School administrator Julie Ennis explaining the reasons for the termination. “Jarretta was asked not to return because of a moral issue that was disregarded, namely fornication — sex outside of marriage,” Ennis wrote. “We request that Jarretta withdraw her complaint and consider the testimony of the Lord.” The letter said Hamilton was aware of the school's “standards, values, and purposes,” but Gay said the morality clause does not override state and federal discrimination laws. The lawsuit alleges violations of a federal pregnancy discrimination law and a state marital status discrimination law. Kanye West To Perform At The BET Awards

June 27 show will be West’s first awards-show appearance since the 2009 VMAs. By Mawuse Ziegbe Kanye West Photo: MTV News Kanye West is set to hit the stage at the BET Awards ’10 on June 27, according to an update posted on the BET website . The performance will mark his first return to an awards show since he interrupted Taylor Swift at the 2009 MTV VMAs . West is also nominated for two BET Awards , including Video of the Year for his work on Jay-Z’s “Run This Town,” which also features Rihanna. The multiplatinum rapper and producer has been making a gradual return to the spotlight in recent months. On Tuesday, Kanye treated students at three different high schools in Chicago to private concerts. He was joined by fellow Chi-town MCs Common and Lupe Fiasco, who performed for the students as part of the Kanye West Foundation’s annual Stay in School event. In May, Yeezy made a surprise appearance at a Manhattan nightclub, where he held an impromptu listening session of a few songs from his upcoming album Good Ass Job. Then, earlier this month, West’s latest track “Power” hit the Internet . At press time, West has not announced what song he will perform at the BET Awards. Former NYT Editorialist Cohen Insists First Amendment Free Speech Protection Is ‘Vague’

In his June 9 “case study” feature for Time.com, Adam Cohen, formerly of the New York Times editorial board and Time magazine, tackled the question “Are Liberal Judges Really ‘Judicial Activists’?” Cohen’s short answer: yes, but so are conservative judges, and it’s the conservatives on the Supreme Court that have been on an activist kick lately. To bolster his argument, Cohen complained that judges must of necessity make judgment calls about vague elements of U.S. law and the Constitution. You know, vague stuff like, wait for it, the First Amendment (emphases mine): Roberts and the rest of the court’s five-member conservative majority have overturned congressional laws and second-guessed local elected officials as aggressively as any liberal judges. And they have been just as quick to rely on vague constitutional clauses. Earlier this year, in the Citizens United campaign-finance case, the court’s conservatives struck down a federal law that prohibited corporations from spending on federal elections. Once again, they relied on a vaguely worded constitutional guarantee. That “vaguely worded constitutional guarantee” reads as follows: Congress shall make no law… abridging the freedom of speech, or of the press. What part of that is vague? Congress has no business abridging the freedom of speech, or of the press. The amendment says nothing about whose freedom of speech, and congressional attempts to fence in that freedom of speech to individuals alone, and not corporate entities, is a pretty clear violation of the text of the amendment’s prohibition against speech abridgement. Indeed, as the majority in Citizen’s United made clear: Speech restrictions based on the identity of the speaker are all too often simply a means to control content….The First Amendment protects speech and speaker, and the ideas that flow from each. Cohen also considers “vague” the 14th Amendment’s equal protection clause: In a 2007 case, the conservative majority overturned voluntary racial integration programs in Seattle and Louisville, Ky. Good idea or bad, the programs were adopted by local officials who had to answer to voters. But the conservative Justices had no problem invoking the vague words of the Equal Protection Clause to strike them down. In that controversy, the two school systems involved were purposefully engineering the racial demography of schools within their districts to correct what was perceived as racial imbalance. In other words, some schools were too white, others too black, in the eyes of policymakers. Whereas Brown v. Board ruled that de jure segregation was a violation of the 14th Amendment protections because segregation by law was inherently unequal, liberal proponents of the Seattle and Louisville plans defended the respective school districts’ obsession with the skin color of its school populations.  Here’s how Washington Post reporter Robert Barnes recorded the logic of Chief Justice Roberts in the Court’s opinion in Parents Involved in Community Schools v. Seattle School District No. 1 et al. : “Before Brown, schoolchildren were told where they could and could not go to school based on the color of their skin,” Chief Justice John G. Roberts Jr. wrote for a plurality that included Justices Antonin Scalia, Clarence Thomas and Samuel A. Alito Jr. “The school districts in these cases have not carried the heavy burden of demonstrating that we should allow this once again — even for very different reasons.” He added: “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race.”  Those crazy conservative justices and their radical activism, upholding the implications of Brown v. Board of Education!

Media Hype Obama’s H.S. Commencement Speech — But Ignore That Students Had to Show Papers

In the middle of a typical Full House rerun on Teen Nick this morning, the network ran a 90-second promo for their website Get Schooled.com  promoting Barack Obama, and how students at Kalamazoo Central High School were overjoyed and amazed to meet him. Students hugged and yelled and held their hands out like they’d never touch anything again after meeting Obama.  Greg Pollowitz at NRO’s Media Blog reported there was an overlooked, inconvenient fact in the hoopla over Kalamazoo Central students meeting the president. The Secret Service required each student’s citizenship status : KALAMAZOO — The White House appears to be laying the groundwork for President Barack Obama to shake the hand of each senior at Kalamazoo Central High School’s commencement ceremony next month. Seniors are being asked to provide their birthdates, Social Security numbers and citizen status to the Secret Service so background checks could be performed. Such a check is required for anyone who gets within an arm’s length of the president, students were told at their senior breakfast Friday. Pollowitz asked: “What’s good enough for President Obama should be good enough for Arizona, no?”

President Obama Praises Kalamazoo Central Students’ ‘Sense Of Community’

President Barack Obama surprises students at Kalamazoo Central High School Photo: MTV News President Barack Obama made some new friends on Monday, when he delivered the commencement address at Michigan’s Kalamazoo Central High School, the winning school among thousands of entrants to the White House’s “Race to the Top High School Commencement Challenge.” Before delivering his speech, the president surprised the class of 2010 with an unannounced informal meeting, where he shook hands and exchanged one-on-one words with the impending graduates. “It was the most amazing thing ever that could ever happen to anybody,” one particularly enthusiastic student gushed, while another classmate chimed in, “That moment right there changed my life, just meeting the president.” During the surprise meeting, Obama praised the high school for its strong sense of community and its promising ideals. “If you carry with you the sense of community you’ve got here in your hometown, there is nothing you can’t accomplish,” he told the students. The president’s words touched Kalamazoo’s graduates greatly. As one student put it, “Giving our school so much praise and saying how much he loved the community and everything, him talking about education [and] going further — it was just really good.” But Obama didn’t even have to open his mouth to thrill the crowd, as his mere presence earned him instant rock-star status with Kalamazoo Central’s nearly 300 graduating seniors. Several students leapt up and down screaming at the top of their lungs, others were left in awe after shaking Obama’s own hand, while some even found the time to share the good news on social networking sites. “I just updated my Facebook status: ‘Just met Barack Obama and made friends with the Secret Service,’ ” one girl happily revealed. Although the reactions to Obama’s appearance varied from student to student, the overall vibe of excitement and pride hanging in the air at Kalamazoo Central High School was palpable. “This is the biggest moment in history and we’re all a part of it,” said one overjoyed classmate. “The whole class of 2010, I’m so excited to just be here in the moment.” “The biggest moment in history” might be something of an overstatement, but Obama’s arrival at Kalamazoo certainly armed the students with an emotional touchstone to look back upon as they move forward with the next phase of their lives. As one graduate astutely observed: “It’s incredible how one man can bring everyone together like that.” Get Schooled is a national program aimed at increasing high school and college graduation rates and promoting the importance of education, developed by Viacom in partnership with the Bill & Melinda Gates Foundation. President Obama Surprises High School Contest Winners — Watch Now!

By James Montgomery, with additional reporting by Sean Lee Kalamazoo Central High School are visited by President Barack Obama on Monday Photo: MTV News On Monday (June 7), hours before he was set to deliver the commencement address for Kalamazoo Central High School’s class of 2010 , President Barack Obama gave those graduating students the surprise of their lives, bringing the already energized group to a frenzy with an unannounced meet-and-greet at an intimate, pre-commencement ceremony. MTV News was there exclusively, and we’ve got the footage for you right now! Backstage, in the moments prior to their commencement — which was held at nearby Western Michigan University, due to the overflow crowd — Kalamazoo Central Principal Von Washington Jr. brought the nearly 300 graduating seniors together in an adjoining holding area for what they only assumed to be little more than a quick pre-commencement pep talk. After some initial comments from U.S. Secretary of Education Arne Duncan, Washington announced that he had another special guest he’d like to introduce. The seniors in the room were shocked to see none other than President Obama himself bound out into the center of the floor. The room erupted in excitement and stayed charged throughout Obama’s brief-but-encouraging words on the hard work Central’s students had put in and the school’s embrace of diversity. Then he flashed his megawatt smile and began shaking hands with the still-stunned students, working the room with an enthusiasm reminiscent of his days back on the campaign trail. For the soon-to-be-graduates, the unexpected moment capped a week of excitement, one that kicked off with the announcement that Central had won the White House’s inaugural Race to the Top Commencement Challenge video competition (co-sponsored by education organization Get Schooled) aimed at finding the school that best exemplified academic excellence and college readiness. It was, needless to say, a day they won’t soon forget. “He took the time to shake everyone’s hand and looked everyone directly in the eye,” one student shared.
