Victory In Washington: Jury Finds Medical Marijuana Patient Not Guilty

By Steve Elliott in Toke of the Town Once again, a jury has seen through the lies and distortions and found a medical marijuana patient not guilty. ​Washington state jurors Thursday afternoon found Cammie McKenzie, who grows marijuana to treat her chronic back pain, not guilty of all charges in a case where prosecutors tried to portray her as a drug dealer. The prosecution’s unsuccessful case was notably nasty, even for a medical marijuana arrest in a state where some law enforcement officials have been slow to adjust to the legalization of medicinal cannabis passed by voters in 1998. “This case is not about medicine. This case is about money,” Snohomish County Deputy Prosecutor Matthew Baldock said in his opening statements Tuesday. “The defendant was masquerading as a marijuana patient and was in reality a drug dealer, no question.” One can only imagine the incensed reaction of Snohomish County’s good voters when they realize their scarce tax dollars are being wasted on foolishness like this. Prosecutors and narcotics detectives claimed McKenzie, 24, was using her medical marijuana authorization as a front for an illegal pot farm at her home in Bothell, Washington, reports Diana Hefley of the Everett Herald Net . McKenzie said that prosecutors based their case on the word of her former roommate, a “known drug dealer” who was promised he wouldn’t be prosecuted if he testified against McKenzie. Jurors ultimately didn’t buy the prosecution’s claims and declared McKenzie not guilty of manufacturing marijuana, which is a felony. Baldock called two witnesses, both detectives with the Bellevue-based Eastside Narcotics Task Force in his case against McKenzie. Defense attorney Natalie Tarantino asked the judge to throw out the charge against McKenzie due to a lack of evidence, including the state’s failure to prove beyond a reasonable doubt that her client is, in fact, the person charged with the crime. Superior Court Judge George Appel denied that motion, instead allowing Baldock to bring a detective back on the stand to testify to the defendant’s identity. Jurors were shown a copy of a driver’s license picturing Cameron Scott Wieldraayer. That was the defendant’s name before she changed her gender and her name. The detective identified the person on the driver’s license as McKenzie. McKenzie herself took the stand Wednesday, testifying at length about marijuana growing methods. She currently runs an Internet business selling growing equipment. The defendant explained how medical marijuana alleviates her symptoms. Marijuana “stops the brain from acknowledging the pain,” allowing her to function, she said. McKenzie told jurors she consumes up to a quarter-ounce a day. She adamantly denied that she was selling marijuana or using her grow operation to make a profit.

On Wednesday (February 17), the 17 remaining semifinalists were unveiled. Now, you can reacquaint yourself with those singers before next week’s live shows kick off: Andrew Garcia While Garcia’s story about his parents’ gangbanger past and trying to make a better life for his kid earned him some audition-round screen time, his Hollywood Week performances are what set him apart from the pack. His acoustic reworkings of female-fronted songs — Paula Abdul’s “Straight Up” and Adele’s “Chasing Pavements” — earned him a ride to the top 24. Katie Stevens The precocious 16-year-old caught our attention with her old-soul vocal chops and compelling backstory. She backed up the positive first impression with Stevie Wonder’s “For Once in My Life” and her group performance of Alicia Keys’ “No One.” Her age begs the question: Will she be the next Jordin Sparks and go all the way or Lisa Tucker and flame out? Janell Wheeler Wheeler’s Hollywood Week was filled with ups and downs, between nailing her acoustic take on Estelle’s “American Boy” and choosing the “wrong song” (according to Simon) with Taylor Swift’s “Love Story.” But the judges must have kept her silky-smooth “House of the Rising Sun” audition into account, keeping her around for the semifinals. John Park Guest judge Shania Twain praised Park’s “bottom end” during his audition performance of Gary Moore’s “I’ll Love You More Than You’ll Ever Know.” The 20-year-old college student was able to show off all the other facets of his voice during Hollywood Week, earning a coveted spot in the top 24. On tonight’s show, seven contestants officially made the cut into the Top 24, and from talented future superstars to earnest underdogs to overachieving rookies, the eyes of the world are now upon them. Here’s our breakdown of the names announced tonight: Michael Lynche – A big man with a big heart, Michael is a new father with new hopes for superstardom thanks to his “Idol” success. Blessed with great guitar-playing skills to go along with his voice, Michael’s story isn’t without scandal — reports indicate that ,link type=”content” id=”1630479″> his father has spoken with the press , and in doing so committed a major “Idol” no-no. Will it result in his disqualification? Katelyn Epperly – Boasting a beautiful smile and bouncy blond hair, Katelyn has been performing in public since she was knee-high to a grasshopper. The product of a broken home, this Des Moines student brought the house down with Duffy’s “Syrup & Honey” — and is now looking at a future that seems mighty sweet. Didi Benami – Inspired by her deceased friend Rebecca, Didi also plays guitar and is somewhat reminiscent of Season 7 contestant Brooke White in both skill-set and emotional nakedness. If she continues to make the cut, look forward to lots of tears — and perhaps a sponsorship deal with Kleenex. Casey James – The chicks dig him. He’s a bad boy with a murky past — ’nuff said. Aaron Kelly – Our own Jim Cantiello calls him “Countryleta” and, sure enough, this 16-year-old high school student has the potential to be a country version of David Archuleta. The judges love a great story, and it’s hard to beat his: Adopted by his aunt after his parents could no longer care for him, Aaron won the “American Idol Experience” at Disney World and got a boost to the executive-producer round. Sounds like a true Cinderella story, from the very studio that gave us the big-screen tale. Lee Dewyze – Considered a dark horse, the guitar-playing balladeer with the sensitive eyes and poor man’s Mike Nesmith wool cap has solid stage presence and is intent to do “good things” in music. Is he a sleeping giant? We’ll find out soon enough. Russell Simmons, Jermaine Dupri Aren’t Mad At John Mayer For Playboy Interview

By Shaheem Reid Russell Simmons Photo: MTV News John Mayer has apologized for his multiple controversial comments in his recent Playboy interview — one of which involved a racial slur — and rappers like N.O.R.E. and Talib Kweli took Mayer to task for his statements last week. But Russell Simmons and Jermaine Dupri said during NBA All-Star weekend that they aren’t mad at him — in fact, Simmons even gave Mayer “a pass” (although he didn’t mean ‘hood pass). “He’s a nice guy. He don’t know,” Simmons said on the red carpet at Jay-Z and LeBron James’ “Two Kings Dinner and Afterparty” presented by Bing and Sprite. “If you live in Beverly Hills, you might think there’s a post-racial society and the pain is gone. A lot of black people use that word, all the time — myself included — kind of as a way to ease the pain from it. You sort of forget that it even existed. We can do that. But when you see people outside of the community do that, it’s more hurtful. He didn’t mean anything by it. I give him a pass. He’s hard on his girls [Jessica Simpson and Jennifer Aniston], though, ain’t he? On the black community, it’s not so hard. That’s my opinion.” Jermaine Dupri had a different but related take on Mayer’s comments. “I thought it was a funny-ass interview,” Dupri said on Sunday at the NBA All-Star game. “I personally think he thought he was talking to Playboy and it wasn’t gonna get to the rest of the world. I guess he underestimated his power and how famous he is and people took it the wrong way. Not to say what he said was cool, but I thought it was a funny interview. It’s his private parts and whatever he wants to do with ’em, that’s what he wants to do with ’em. That’s not for us to judge. I think we in his business too much. It’s a golden age for one Golden Girl. Over the past year, Betty White has co-starred in a hit movie ( The Proposal ); appeared in a Super Bowl commercial; and received a lifetime achievement from the Screen Actors Guild. The 88-year old is suddenly in a more sought after commodity than Megan Fox nude photos. Nowhere is this more evident than on Facebook: Over 330,000 users have signed an online petition that aims to get White as a host of Saturday Night Live . What does the actress think of this movement? “I don’t even know where that came from,” she told People . “That just came out of left field. It’s ridiculous. I don’t think Lorne Michaels even knows about it, so we won’t worry about it.” The prospect of White as on the SNL stage raises two questions, the first being: Do you want this to happen? Spencer: Heidi Montag Upset with Plastic Surgery

Heidi Montag is very upset, or at least was very upset initially, with her recent round of plastic surgery, husband/pimp/publicist Spencer Pratt claims. The Hills star famously had 10 plastic surgery operations in one day , and despite claims that she loves the results, Spencer says she was not happy. “She came out of the hospital and the only thing she was saying was that the doctor better hide,” Pratt said at Pure nightclub inside Caesars Palace. “She wasn’t happy,” Spencer reiterated. The aspiring pop star says she had “no idea” how painful all the ridiculous cosmetic procedures would be. Eh, you asked for it, now live with it, girl. On a recent trip to a Sin City club, The Hills star Spencer Pratt poses with a low-rent Vegas stripper. Oh, wait, that’s Heidi Montag! Didn’t even recognize her! “The worst pain was actually my ears. 30 Seconds To Mars Talk Upcoming North American Tour

Next leg of Into the Wild Tour begins in Las Vegas on April 9. On February 19, they’ll head to the U.K. to begin the first leg of their Into the Wild Tour, which will have them touring all over Europe. But American fans need not worry, as lead singer Jared Leto told MTV News that they’ll be back in North America on April 9 for a show in Las Vegas. “From Elvis to Cirque du Soleil to 30 Seconds to Mars — you’ve got your pick,” Leto says dryly of the band’s visit to the Entertainment Capital of the World. Despite their decade-long existence, the thrill of touring hasn’t waned for Leto and his cohorts. “We did a lot of shows to 20 people in a bar who were more interested in cheap drinks than they were the band,” Leto says. “We’re really excited and we’re grateful for it, and we don’t take it for granted at all.” “I remember just a few years ago there was a show where we sold 800 tickets and we couldn’t believe it,” Leto adds. “The very first show on this tour is 8,000 people, and the next day there’s gonna be 11,000 people there. I’m going to have to get my voice in shape!” “We’re about to go on our first arena tour — we’re crazy excited,” says guitarist Tomislav Milicevic. The inspiration for the name of the tour comes from a lyric from “The Mission,” a song that Leto wrote back in 1999 that appeared on the group’s self-titled debut. “When you go out on the road, it is kind of a venture into the wild. You’re with this group of pirates, from your crew to your bandmates, and you share this insane journey around the world. My chat with President Obama: Face off on clean coal, nuclear energy, and oil drilling

Last night, I went to hear what President Obama had to say at a Gen44 event organized by the Democratic National Committee (note that I took time off from 1Sky to attend the event because 1Sky is a 501(c)(3) organization and we can’t — and don’t — do any electoral work). Anyway, I happened to catch President Obama on a rope line and decided on the fly to challenge him on the mythology of clean coal since our base has been so concerned about his repeated calls for clean coal (and nuclear and oil drilling) alongside real renewable energy solutions. My partner Louis captured the exchange on his iPhone. Here is what happened and a transcript as best as I can put it together since the audio isn’t great, especially on my voice — although Obama comes through loud and clear and we have our work cut out for us! We shake hands, I grab President Obama’s hands with both of mine and look him straight in the eye: Me: It’s got to be renewable energy. No more clean coal. [Inaudible: It’s a unicorn. It doesn’t exist.] Obama: I disagree with you. I disagree with you. We are not going to get all our energy from wind and solar in the next 20 years… Me: Let the market do it. Let the market do it. Can’t the market make the investment? [Inaudible: It’s hundreds of billions of dollars (we’d be investing in “clean coal” in the House version of the bill)] Obama: They can’t do it. The technology’s not there. I’ve got a nuclear physicist in my Department of Energy who cares more about climate change than anyone and he will tell you you can’t get it done just with that — so you’ve got to have a transition period to do all this other stuff. Don’t be stubborn about it! Me: It’s about getting the votes [inaudible: in Congress isn’t it?] Obama: This is not a votes matter, This is a technological matter. It really is. I have looked into it. Me: We’re running a national campaign and people are really upset about this – Obama: I know everybody’s….listen, if I could do it all with wind and solar I would! We can ramp it up. That’s what we’re working on. So what was really going on here in this brief exchange between me and President Obama with the noisy bugles in the background? We were talking past each other, for one thing. President Obama was making two points: * We can’t kick our dirty coal habit right away. It’s going to take some time — he has said at least 20 years. * Because we aren’t going to get rid of coal immediately, it’s worth it for the federal government to invest in carbon capture and sequestration (CCS) technology , to make coal cleaner for now. Generally speaking, we agree with his first point. Some persuasive arguments have been made that we can get rid of coal in the next 10-20 years but right now almost half of our electricity comes from coal, and retiring those old dirty plants won’t happen overnight. That’s why we agree with the President that our clean energy transition must start immediately. As President Obama has said, “it means passing a comprehensive energy and climate bill with incentives that will finally make clean energy the profitable kind of energy in America.” However, we disagree strongly with the President’s assertion that the federal government needs to help bail out America’s aging coal industry by footing the bill for carbon capture and sequestration technology as they limp into the 21st century.
