Should a grandmother’s home be taken over a positive test for marijuana? (Updated) Examiner.com

I decided to include the full story here to clarify some confusion by readers. Please go to my link on Examiner and click follow to get future updates. Marc Anthony Laquinn Buchanan, 27, was arrested Wednesday after testing positive for marijuana use, according to court records. Buchanan was out on bond after being arrested in 2009. Buchanan's grandmother had posted the $50,000 property bond. Buchanan is awaiting trial on charges of attempted murder, first-degree assault, fleeing and evading police, possession of a handgun by a convicted felon, possession of a controlled substance and tampering with physical evidence. These charges stem from an incident where Buchanan is accused of shooting and causing “serious physical injury” to Officer Nicholas Whitcomb during a footchase. The Commonwealth Attorney's Office wants Judge Ishmael to revoke his bond. This would most likely lead to the loss of Buchanan's grandmother's home. Judge Ishmael has refused to do this and, I believe, rightly so. Mr. Buchanan stands accused but is presumed innocent until proven guilty. I don't know all of the details of the case, however, bonds are set to make sure the accused show up for their court date. I believe the bond was appropriate and efficient. Should a grandmother's home be taken because Buchanan tested positive for marijuana while awaiting pre-trial? I could argue for days about mis-information regarding marijuana. However, I'll just point out that the last thing marijuana would do is make Buchanan violent or dangerous. I'll leave it up to the comments section to debate the pros and cons of marijuana and whether or not it should be legalized. Judge Ishmael made the right decision by weighing the issues and making a calm, level-headed ruling. Buchanan knew the rules of his release, yes. Testing positive for marijuana was a violation of his release. However, did the marijuana make Buchanan dangerous or more likely to evade prosecution? No. Would justice be served by taking away the home of his grandmother? No. Would the judge be causing more pain, grief and heartache for the grandmother, family and friends of Buchanan by doing this? Yes. I tend to be critical of the Lexington courtrooms and the legal community due to past and present experience. Today, I praise Judge Ishmael for realizing that sometimes rules and laws are not written in stone. Justice is best served with a touch of wisdom. An Open Letter to President Obama

Mr. President, I write this letter as a patriot, a taxpayer, a lifelong resident and as concerned citizen of what I consider to be the greatest nation ever known to man, the United States of America. I am Caucasian, so let’s get the racial aspect out of the way to start with.  This letter has nothing to do with your race. I lived through the cruelty of Jim Crow and segregation and learned early on in my life that the color of my skin does not make me better or worse than any other man. We all remember Martin Luther King, Jr.’s statement about judging people, not by the color of their skin, but by the content of their character, and I believe that with all my heart. I believe that America is an exceptional country.  We have been liberator, benefactor and leader of the free world for centuries.  America is an example of what can be achieved by free people living under the free enterprise system. We have led the world in technology, industry, science and medicine for a long time. Our capitalist system guarantees that those who explore new worlds and bring us new products and better techniques are amply rewarded for their efforts, and this is as it should be. A person who is the first one to get there and the last one to leave, who burns the midnight oil and never gives up until they realize their goals, are a boon to humankind.  They’re the ones who discover new cures, start new industries and create jobs. These people deserve to be rewarded for their hard work and for the products and services they bring to make life better for all mankind. Mr. President, it is my personal opinion that you want to take the well-earned rewards of these people and give it to those who have done nothing to deserve them. It’s really redistribution of wealth, and it’s nothing new. It’s been tried many places before and it has miserably failed in every one of them.  It’s called socialism. Am I calling you a socialist?  Yes, I am.  I firmly believe that you are a socialist and a globalist, and that you think America should have a comeuppance and have our playing field leveled to match those of other countries not as industrious or as innovative as we are. Mr. President, how can you support the building of a mosque in the very same area where Islamic radicals murdered so many Americans? Just who’s side are you on? Am I accusing you of being a Muslim?  No I’m not, but the jury is still out a little bit on that subject in my mind, because many times your sympathies seem to lean in that direction.  You need to watch who you bow to Mr. President. You have betrayed a whole generation of African-Americans who voted for you because they really believed all that junk about “hope and change,” they really thought you were going to do something great and the only thing you’ve done is to make their jobs disappear and their health insurance go up. You and your party have corrupted duly elected officials in an effort to get your legislative agenda passed.  Remember the “Louisiana Purchase” and the “Cornhusker Kickback,” and that’s just a couple we know about, but you bought off a bunch of congressmen and senators, knowing that you were going against the will of the majority of Americans, because you think that you and your arrogant friends know more about what’s good for America than the citizens your disastrous actions effect. Am I accusing you of being an elitist?  You bet. I don’t believe you take the Islamic threat to America nearly as seriously as you should. You use semantics like “Overseas Contingency Operation” and “Man Caused Disasters” to soften your rhetoric toward people who would like nothing better than decapitate the entire population of America. And Mr. President, if you’d really like to know the kind of warriors who are fighting the “Overseas Contingency Operation,” and you would like to really know about what kind of enemies they’re fighting, you should read a book called Lone Survivor by a brave, young Navy Seal named Marcus Lutrell who went to hell and back for his country, and is still a dedicated patriot.  I think you’d find it enlightening, Mr. President and after you finish it would you pass it on to Janet Napolitano?  And by the way, tell her that my invitation to take her to Iraq and show her some “Man Caused Disasters” is still open. Am I calling you naïve?  Absolutely. You seem to think that America has an endless supply of tax dollars for you to waste and give away, and the debt you’ve piled up could well bankrupt the greatest nation on earth. Am I calling you a failure, Mr. President? With all due respect that’s exactly what I’m doing.

Lyfe Jennings Reportedly Sentenced To Three Years In Jail

R&B singer was arrested in 2008 for fleeing the scene after a dispute with the mother of his child. The artist was due to perform in Seattle on Tuesday, but the show was abruptly canceled before Jennings was sentenced to three and a half years in Atlanta on Wednesday (September 22), according to Seattle Weekly. The sentence stems from an altercation Jennings had with the mother of his child in 2008 . The singer kicked down the door of a house in Smyrna, Georgia, in an attempt to find Joy Pound and later fired a gun outside. Smyrna police saw a red 2005 Corvette fleeing the scene, and Jennings was caught after a high-speed chase that ended when the singer smashed the vehicle. He refused a sobriety test. Jennings was handed misdemeanor charges of criminal trespass, discharging a firearm near a public highway and refusal to take a DUI test, in addition to two felony counts of attempting to elude an officer and possession of a firearm by a convicted felon. Jennings’ label offered no comment by press time. On Tuesday, Jennings posted a vague message on his Twitter account announcing he would no longer be writing on the micro-blogging site. “This will be my last post. To everyone who gave me a chance I am forever in your debt. I have had a fabulous career because of you. All I can say in parting is that I have been honest with yaw. I didn’t sugarcoat a word didn’t hold back a single sylible of my life from yaw,” Jennings said. “I’ve lived a hundred lives in these 6 yrs so I not only won’t, I don’t have the right to complain. I would like to think that I’ve changed lives by changing my own, tho I can’t be sure. But one thing I am sure of is God gives and takes away in measure. He is fair, just and forever. Amen from aman… Smile, it’s contageous:)” Jennings was sentenced to 10 years for felony arson before gaining acclaim after his wins at the famed amateur night at New York’s Apollo Theater. His 2004 debut, Lyfe 268-192, went platinum, and he’s known for hits like “S.E.X.” and “Never Never Land.” He released his latest LP, I Still Believe, in August, a project he dubbed his “final” album. Disgraced Governor-Turned CNN Host Spitzer Credits Liberals for Health Insurance Across State Lines Initiative

A governor forced to resign for patronizing call girls will probably have a hard time landing a job making pronouncements on politics, right? But there, on CNN, is former New York Gov. Eliot Spitzer.  Spitzer will co-host a show with pseudo-conservative Kathleen Parker called “Parker Spitzer,” which is set to debut on Oct. 4. But in the meantime, Spitzer has been making regular appearances on CNN programming to offer the liberal perspective on issues. On CNN’s Sept. 20 “Anderson Cooper 360,” that’s what he did, carrying water for the Democratic Party – even though his argument was factually leaky. In the wake of the GOP’s nomination of Christine O’Donnell as the Delaware candidate for U.S. Senate, Spitzer took on conservative talker and blogger Dana Loesch over what issues the Tea Party movement was really interested in taking a stand on – fiscal or social. Loesch argued that the movement isn’t just about opposing this Congress’ policy endeavors, but is also offering solutions, as was the case with ObamaCare. The Tea Party supporters may differ on some issues, leading to some vague positions, but, “I think that means for the amounts of issues, perhaps, when you get into social issues,” Loesch said. “But, for things like health care, the movement has been incredibly clear. Some of the things that they have put out are – let’s be able to buy insurance across state lines. Let’s – have health insurance companies compete. We’ve taken on everything from health care, to education, to foreign policy, and not just general.” And according to Loesch, the Democrats have offered a series of platitudes on these policy issues, which she claims they could have offered some more specifics. “I mean, we have isolated specific issues within the realm of each of these topics and we have gone at it,” Loesch continued. “When you talk about people being general, where we have seen people be general is from the Congress currently in Washington, D.C. We’ve seen broad generalizations on a number of different policies. We would actually like to see congressional Democrats be a little bit more – just be a little bit more precise with things.” Spitzer was in agreement over a policy point, but he wanted to credit the Democratic Party, which controls both chambers of Congress and the White House with an idea that it hasn’t been noted for championing, and that it was unable to implement. “Well, you know, because I’m always looking for points of agreement, I agree with you about the ability to purchase across state lines, competition across state lines,” Spitzer said. “Those have been perspectives taken primarily by the liberal wing of the Democratic Party and opposed by the Republican Party. So, if you want to ask, why…” However, it was the Republican Party that fought for the ability for consumers to purchase insurance across state lines. This had long been a policy point offered by the GOP, even at the height of the ObamaCare debate, as shown in a Feb. 25 post on the GOP House Conference blog . Spitzer’s erroneous assertion led to this back-and-forth with Loesch: LOESCH: That came out in the Patients’ Choice Act. SPITZER: … why that – why that has not been permitted… LOESCH: No. SPITZER: What do you mean? You can’t say no. Facts are facts. The reality is … LOESCH: Patients’ Choice Act – the fact is the Republicans came out with a Patients’ Choice Act. I have to correct you on that point. SPITZER: Talking over somebody isn’t going to change the facts. The reality is… LOESCH: Well, I had to point out the facts. SPITZER: … the opposition to interstate competition has come from the Republican Party. And that remains to be the case. A 2009 study showed that health insurance premiums would be reduced by 61 percent for Massachusetts residents if they were allowed to purchase insurance in North Carolina,  which, as the GOP conference blog pointed out, is something that could have easily been put into the Democrat’s health care reform legislation. And as Loesch explained, it was House Minority Whip Eric Cantor, R-Va., who was at the forefront of this push – not the “liberal wing of the Democratic Party,” as Spitzer claimed. “No. That is – that’s – that’s an error. That’s a factual error – Patients’ Choice Act. It came out. Eric Cantor, a number of congressional Republicans came out,” Loesch said. “And that was one of the main talking points, the patients’ bill of rights.”
