Hillary Clinton: Gay Rights Are Human Rights

Obama, Clinton vow to defend gay rights, adding 'it's not who we are as Americans' By Elise Labott, CNN Senior State Department Producer June 23, 2010 1:48 a.m. EDT Washington (CNN) — President Obama and Secretary of State Hillary Clinton pledged to end violence and discrimination against gays and lesbians at home and abroad Tuesday, as the Obama administration moves to extend further benefits to gays working in the federal government. “It's not right, it's not who we are as Americans, and we're going to put a stop to it,” Obama told a raucous White House reception honoring Gay and Lesbian Pride Month. Earlier, Clinton received several standing ovations from a standing-room only crowd of several hundred during her address at an event co-hosted by the State Department's Office of Civil Rights and GLIFAA, the organization for Gays and Lesbians in Foreign Affairs Agencies. “We are moving together in the right direction,” said Clinton. “We reaffirm our commitment to protect the rights of all human beings.” The White House event invited politicians and government officials as well as lesbian, gay, bisexual and transgender American from across the country, including young people “who have stood up for equality,” said White House spokesman Shin Inouye. At a similar event last year, six months after Obama took office, participants expressed frustration over what they called a lack of progress in confronting discrimination issues that the president had promised to resolve. This time, Obama received loud applause, cheers and whistles as he cited steps his administration has taken, including a new hate crimes law, extending federal benefits to gay employees and a push for an employee discrimination bill. The Obama administration is expected to announce Wednesday that gay workers will be able to take medical leave to care for the sick or newborn children of their same-sex partners as part of the Family and Medical Leave Act, which generally allows those working for companies with 50 or more employees to take 12 unpaid weeks off to care for newborns or children with serious health issues. “And finally, we're going to end “don't ask, don't tell,” Obama said Tuesday of the policy that prohibits openly gay and lesbian soldiers from military service. A bill that would repeal the policy after a Pentagon review is completed in December is before Congress, the president noted. “We have never been closer to ending this discriminatory policy, and I'm going to keep on fighting until that bill is on my desk,” he said to cheers. Attending the event was Janice Langbehn of Lacey, Washington, who was denied hospital visitation rights when her partner of 18 years, Lisa Pond, was stricken with a fatal brain aneurysm while on vacation in Florida. Obama mentioned her story on Tuesday, calling the way she was treated “wrong” and “cruel.” Earlier, Clinton said she is asking embassies in Africa and elsewhere to report on rights of the local lesbian, gay, bisexual and transgender communities. The State Department also is placing more attention on ensuring gays around the world have access to HIV/AIDS prevention and treatment, and providing grants to human rights activists who are persecuted either because they are gay or defend gay rights, she said. “These dangers are not gay issues. This is a human rights issue,” Clinton said. She drew more rousing applause when she declared “human rights are gay rights and gay rights are human rights,” a variation on the phrase she famously delivered in Beijing 10 years ago declaring “women's rights are human rights.” Clinton said she is equally concerned about creating an environment at the State Department in which gay employees feel valued and “can give 100 percent.” That is why, she said, she supported offering equal benefits to same-sex partners of State Department employees, a move that encouraged Obama to authorize such benefits for gays throughout the federal government. She noted the State Department also has made it easier for transgender people to change their passports and, for the first time, the agency's “equal opportunity statement” will include gender identity. Two Marines Charged With Assaulting Gay Man

Two Marines were arrested early Saturday in Savannah, Ga. and charged with misdemeanor battery after they beat a gay man they claimed was “harassing” them with a wink. According to the Savannah Morning News, police chased down Joseph Cronauer (pictured) and Christopher Charles Stanzel around 4 A.M. in downtown Savannah as friends performed first aid on Kieran Daly, who lay unconscious on the ground. “Cronauer and Stanzel told police they were being harassed by a gay man and wanted to get away from him. But witnesses painted a different picture, according to the report. They told police one of the men grew angry because he thought Daly was winking at him and struck Daly in the back of the head with his fist, knocking him unconscious.” Daly was admitted to Memorial University Medical Center, where doctors diagnosed him with bruises to his brain. He suffered seizures and was expected to remain hospitalized for several days. He denied winking at his attackers, the Morning News reported. Cerebral Palsy Victim Sues City Over Medical Marijuana

Malinda Traudt may be blind and wheelchair-bound but she and her mother are fighters. So, when the City of Dana Point threatened to shut down the collective where they get the medical marijuana Malinda needs to stay alive and manage her pain, they filed suit. Malinda was born with cerebral palsy, epilepsy, total blindness, and severe cognitive delays. Now 29 years old, she has been in a wheelchair her entire life. Recently, she was diagnosed with severe osteoporosis, a degenerative bone disease. Malinda's doctor gave her pain medication but, within hours, her kidneys began shutting down, her lungs filled with fluid causing pneumonia, she developed a high fever, and vomited for 3 straight days. Malinda's physician recommended that her mother contact hospice to arrange for Malinda's final hours. In a last-ditch effort to keep Malinda alive while managing her pain, Malinda's mother and her pain specialist replaced the pain medication with medical marijuana. Almost immediately, Malinda's fever subsided, she stopped vomiting, and her suffering lessened. Within days, she began to recover. Malinda's kidneys regained function, she was able to eat, and she began smiling again. Her pain became manageable and her quality of life improved significantly. Malinda is a medical marijuana patient and member of the Beach Cities Collective in Dana Point. Malinda's mother pushes her, in her wheelchair, to the collective to obtain her life-saving medicine. Unfortunately, Dana Point is trying to close Beach Cities Collective, along with all collectives in that City. Although numerous lawsuits have been filed by dispensaries, Malinda's is the first by a patient alleging that the ban unconstitutionally interferes with her fundamental rights to life and safety, under the California Constitution. According to Malinda's attorney, Jeff Schwartz, “When a dispensary challenges a ban, the city simply has to show that the ban serves a legitimate purpose, such as reducing crime, loitering, or traffic. Cities always win that battle. However, when a city interferes with a person's fundamental, constitutional rights, it must prove that the ban serves a compelling public interest and is narrowly-tailored to avoid interfering with other civil rights. Deputy Resorts to "Identity Theft" of a Patient in Marijuana Sting

A California deputy has admitted using a doctor's recommendation and stolen identity from a legal medical marijuana patient in order to buy pot in a drug sting. Deputy Steve Avila of the Calaveras County Sheriff's Department said during questioning that he had used the patient's recommendation, with a falsified birthdate, to persuade a dispensary owner to sell marijuana to an officer. Avila claimed he obtained the medical marijuana recommendation “from an investigation we conducted,” but also claimed he “did not recall” which officer obtained it, or how it was obtained. Jay Smith of K Care Collective, the dispensary owner who was tricked into selling marijuana to an officer, said Calaveras County is waging a war against medical marijuana, and is doing so using unethical means, reports Dana M. Nichols of the San Joaquin County Record. Robert Shaffer, the medical marijuana patient whose identity was stolen, tells the same story. According to Shaffer, Deputy Avila violated his privacy by using his identity and documents in the sting operation. Smith, Shaffer and several medical marijuana patients and providers pleaded for help this week from the Calaveras County Board of Supervisors. “I also fear my identity is being used in another of Avila's illegal ruses,” Shaffer told the supervisors. “It just smacks of entrapment and sleaziness to me,” said Dr. Philip A. Denney, who issued Shaffer's medical marijuana recommendation. Denney said his office got a call from dispensary operator Smith, and that his staff confirmed that Shaffer had a valid medical marijuana recommendation, not knowing that Deputy Avila had stolen Shaffer's identity. “I think the cops have better things to do,” Dr. Denney said. “It was completely deceptive, because they never did talk to me. They did not have Mr. Shaffer's authorization for any of this.” At Smith's preliminary hearing May 10, Deputy Avila admitted that he had used Shaffer's recommendation. Shaffer was arrested last November on felony marijuana transportation and sales charges. Investigators said they found Shaffer through a Craigslist ad for medical marijuana.
