Could Breezy be facing some serious slammer time following his fade with Frank Ocean ? BOSSIP spoke with a legal expert who says Chris Brown could be looking at a whole lotta time! “It is my understanding that there have been reports that the altercation between Mr. Chris Brown and Mr. Frank Ocean involved more nefarious issues than a parking space,” Atlanta based lawyer Kevin T. Connor told BOSSIP. “Specifically, it has been suggested that the incident was motivated and fueled by Mr. Brown’s anti-gay sentiments. If it could be established that, indeed, the brawl was motivated by the actual or perceived sexual orientation of the victim, it could be prosecuted as a hate crime in the State of California and/or under federal law.” Here’s the definition of a hate crime: Generally speaking, a “hate crime” is one where the accused uses force or threatens the use of force to injure, intimidate, or interfere with another’s exercise of constitutional rights if motivated by the actual or perceived membership in a protected class, including race, religion, gender, and sexual orientation. The litmus test is the motivation of the aggressor, which may be established by the nature of the accused’s prior statements and conduct, including through those exhibited through social media. In other words — Breezy’s past comments, on Twitter and offline can be used to establish a hate crime motivation. What’s worse is that the fight happened in California which happens to be the first state to pass legislation specific to hate crimes. Connor also says that even if the L.A. County prosecutor chooses not to pursue the case, he could still face a civil lawsuit. “The commission of a hate crime might also expose Mr. Brown to civil liability,” Connor added when discussing the case with BOSSIP. “In such a case, the circumstances do not require the violence be extreme or motivated by hate, or even that the acts constitute a crime.” And if you’re wondering what a criminal charge would mean for Breezy, let’s just say if he does end up in a criminal court, he might as well cancel any tour plans: “Prosecution under a hate crime statute provides for an enhanced punishment beyond the normal maximum sentence for the underlying crime,” Connor told BOSSIP. “In California, for example, should Mr. Brown be charged and convicted of felony assault in this case, his 2-4 year sentence could be enhanced (increased) under the hate crime statute by another 1-4 years, depending upon whether he is found to have acted in concert with others. Additionally, because Mr. Brown is on probation for his previous assault on Rihanna, he is subject to having the balance of his probation revoked, which is to say that he could go to jail for the remainder of his probationary period in addition to any new sentence.” Connor added that while it’s unlikely, it is possible that the case could be certified by the US Attorney General. Shawn has kept Lindsay out of jail for over five years now and she has no idea how good she has had it. Shawn is extremely respected by judges and prosecutors and that has benefited Lindsay greatly. Lindsay’s new criminal attorney, Mark Heller, isn’t even based in Los Angeles and certainly doesn’t have the revered reputation that Shawn does.” As previously reported, Lohan is currently on probation for stealing a necklace from a Venice jewelry store. Meantime, she will be back in court on January 15 to be arraigned on her latest charges. Lohan is required to be in court for the arraignment, at which time she will be required to enter a plea. A date will also be set for a probation violation hearing, and if the troubled actress is found to be guilty, she could be sent to jail for up to six months. “I suspect that Lindsay’s new attorney is either representing her for a reduced fee, or not charging her at all,” the source says. “I think Mark wants the publicity that representing Lindsay Lohan can bring.” What an ungrateful lil beyotch Blohan is! Designer Tory Burch Sued For Racial And Sexual Discrimination According to TMZ reports : A black, bisexual woman has sued her former employer — the company run by high-end fashion designer Tory Burch — claiming her manager and co-workers put a big fat target on her head because of her race and bisexuality. Jessica Jones filed the lawsuit, claiming she worked at the billionaire designer’s flagship store in Bev Hills from July 2011 to July 2012 — and during that time, Jones claims she was called everything from a “disgusting” homosexual to a “n***er.” In the docs, Jones says her manager and co-workers treated her like dirt, telling customers and clients not to work with Jones because she was gay. Jones says her manager referred to Jones’ girlfriend as “that thing that comes to visit her at work.” On her lunch breaks, Jones says her manager would regularly ask if Jones was getting fried chicken. Jones claims she was eventually forced to resign because of the treatment she received. Jones is suing Burch’s company — as well as her manager and others — for unspecified damages. Burch was not accused of wrongdoing herself in the the lawsuit and she is not named as a defendant. Via RadarOnline reports : Aubrey Ireland, a 21-year-old music theater major at University of Cincinnati’s College-Conservatory of Music, convinced a judge to sign a TRO against David and Julie Ireland, claiming that they stalked her, accused her of using illegal drugs, promiscuity and suffering from emotional woes. Despite their daughter routinely making the dean’s list, the overly protective pair would regularly make the 600 mile drive from Kansas to Ohio to check up on her unannounced at school and informed her department head she had mental issues that could force them to go to court to have her treated. “It’s just been really embarrassing and upsetting to have my parents come to my university when I’m a grown adult and just basically slander my name and follow me around,” Aubrey said in an October 9 court hearing. The Irelands even went so far as to spy on her by installing monitoring software on her laptop and cellphone so that they could read her messages and know exactly who she called or texted. It was “like I was a dog with a collar on,” she said. The school clearly took the threat seriously and even went so far as to hire special security guards to keep the talented musician’s “helicopter” parents out of her performances, and when the Ireland’s stopped paying her tuition because she’d cut off all contact with them, the school gave her a full scholarship for her final year. Finally Aubrey could take no more, and took legal action to keep them away and the judge finally granted the stalking order stating they must stay at least 500 feet away and have no contact with her until September 2013. “I never wanted this to happen, that’s the last thing I wanted,” she told ABCNews.com. “But I wasn’t in control of my life at all anymore. I knew that they were holding me back emotionally, mentally, and professionally and that it got to the point where that was basically my last option.” However, her mom Julie still doesn’t think there is a problem. “We’re not bothering her.” We’ve heard of overbearing parents but these folks take the cake!
