New York City officials are already teed off over Ken and Sarah Burns documentary The Central Park Five — but just wait until they see the poster for the headlines-generating film. The stark, black-and-white image simply, effectively — and immediately — communicates the idea that the scales of justice did not work for the five men who were convicted and later cleared in the racially charged 1989 Central Park jogger case that rocked the city. As I reported in early October, lawyers for the city of New York have subpoenaed notes and outtakes from the documentary, which Burns directed with his daughter Sarah Burns and her husband David McMahon, in order to determine whether the material can help them fight a federal civil rights lawsuit that five men filed nine years ago as a result of their experience. (Each of the five men is seeking $50 million.) The documentary, which was shown at the Cannes, Telluride and Toronto film festivals, scrutinizes the initial convictions of the Central Park Five — Yusef Salaam, Antron McCray, Kevin Richardson, Raymond Santana, and Kharey Wise — noting, for instance that the five men did not appear to be in the area of the park where the rape occurred, that their DNA was not found on the victim and that their confessions did not jibe with one another’s. As I also reported, the filmmakers are fighting the subpoena . Sarah Burns told me, “We’re not sure the city can subpoena us because we believe we’re protected by the shield laws” that allow journalists to protect their sources and research. In 2009, on the 20th anniversary of the incident, the lawyer for the five men, Jonathan Moore called their experience “the most racist prosecution that occurred in the City of New York. The city maintains that that cops and prosecutors acted appropriately. “We believe that based on the information that the police and prosecutors had at the time, they had probable cause to proceed, and the confessions were sound,” a city spokeswoman told the New York Times. There’s only one movie this week that’s both new and nude, but based on the buzz surrounding Looper (2012) after preview screenings at Toronto and Fantastic Fest, it’s the only movie you’ll need. Piper Perabo breaks a ten-year nude drought as a showgirl who does the horizontal tango with star Joseph Gordon-Levitt 24 minutes in, and trust us– when it comes out on DVD, we’ll be looping this one. But this morning, in an interview with Ryan Seacrest on KISS FM, the singer revealed that the track “Supernatural” was penned about a specific sexual experience. Between Ke$ha and a ghost. “I don’t know his name,” she said of her partner. “He was a ghost! I’m very open to it.” Ke$ha appeared on the talk show in promotion of her new album “Warrior,” which comes out on December 4. “There are so many weird topics on this record, from having sexy time with a ghost to getting hypnotized and going into past lives,” she teased. “I just really wanted the theme of this record to be the magic of life.” The artist continued, saying she drew on some more earth-bound endeavor as well: “I went on a spirit journey by myself. No security guard. No managers. I just went around the world and lived on a boat. “I was in Africa rehabilitating baby lions. I went diving with great white sharks, and just went on this crazy spirit quest. I got hypnotised, and I just really wanted this record to be really positive, really raw, really vulnerable.”

The Collection Set for Screamfest Opener Marcus Dunstan’s horror The Collection will open the 12th annual Screamfest, taking place October 12 – 21 in Los Angeles. Starring Josh Stewart, Emma Fitzpatrick and Christopher McDonald, the film centers on a traumatized man forced to help rescue a beautiful woman who has become the latest obsession of a crazed killer who “collects” humans in a booby-trapped house of horrors. Both Dunstan and Melton will be in attendance for the opening night screening . Ginger & Rosa Heads to U.S. Theaters New distribution outfit A24 picked up Telluride and Toronto festivals’ Ginger & Rosa , starring Elle Fanning. Set in 1960s London, the film centers on two teen girls who rebel against their mothers against the backdrop of the Cuban missile crisis and nuclear fear. A24 will do a 2012 qualifying run for awards season, followed by a theatrical release in 2013. It will screen at the upcoming New York Film Festival. Alain Resnais’ You Aint Seen Nothin’ Yet Heads to Theaters U.S. rights to the film have been picked up by Kino Lorber and will have its North American premiere October 2nd at the 50th New York Film Festival. The film opens with a who’s-who of French acting royalty being summoned to the reading of a late playwright’s last will and testament. There, the playwright (Denis Podalydès) appears on a TV screen from beyond the grave and asks his erstwhile collaborators to evaluate a recording of an experimental theater company performing his Eurydice. But as the video unspools, instead of watching passively, these seasoned thespians begin acting out the text alongside their youthful avatars, looking back into the past rather like mythic Orpheus himself. The film will open in early 2013. Michael Walker’s Price Check Heads to North American Theaters IFC Films will open the comedy starring Parker Posey will open on VOD October 11th and theatrically on November 16th. The film revolves around Pete Cozy, who is having trouble with rising debt and hates his job. His new boss comes along and pulls Pete into a maelstrom and is made to work harder than before. He suddenly is finding opportunities, but may pay a price. Around the ‘net… President Obama Calls Innocence of Muslims a ‘Crude and Disgusting Video’ at U.N. On September 14, Disick was in Toronto to host a party at Tryst nightclub… … but the reality star went above and beyond his duties, Life & Style claims, asking for cocktail waitresses’ phone numbers so he could invite them to his hotel room and continue raging deep into the morning. “The girls arrived around 11 p.m. and partied with Scott and his business partner until security asked them to shut it down around 2 a.m. due to noise,” a source tells the tabloid, adding that Disick was at it again the very next night. Scott and his friends ended up at a club called Bloke & 4th on September 15. “He began throwing back Heinekens like they were going out of style,” says an anonymous fellow attendee, adding that Dicisk and his party left the club at 3:15 a.m., and that male and female voices were heard in his hotel room until 4:30 a.m. While she deals with these alleged actions, E! viewers were forced to deal with Kourtney Kardashian giving birth on the season finale of her family’s reality show. Yunel Escobar has issued an apology for one of the stranger scandals we’ve seen recently in the world of sports. The Toronto Blue Jays shortstop donned eye black for his team’s game against the Boston Red Sox on Saturday, scribbling Spanish words across the outside that translate roughly to “faggot.” The ball player was suspended three games for the action. “I feel bad,” he told the media this afternoon in response to the incident. “I’m leaving my team for something I didn’t intend to do. I have nothing against the gay community and honestly I’m sorry… It was just a joke and it wasn’t directed to anyone in particular… “It’s just something that’s been said around amongst Latinos. It’s not something that’s meant to be offensive. For us, it didn’t have the significance to the way it’s being interpreted right now. It’s a word used often within teams. … I agree with the suspension and don’t have any problem with it.” Escobar, who is hitting only .251 this season, will forfeit about $92,000 as a result of the suspension. A portion of those funds will go to GLAAD.

The Italian magazine Chi has vowed to publish more of the infamous nude and topless Kate Middleton photos that the British royal family is suing over. France’s Closer magazine ran a whole spread devoted to Kate Middleton topless last week, prompting a stinging rebuke and a lawsuit from the Duchess. Chi claims it has 200 images of the future queen sunbathing nude or at least topless, and will proceed with plans to print a 26-page, 50-photo article. The Chi cover was unveiled Saturday in Italian newspapers and TV under the headline ‘Court Scandal: The Queen is Nude!’ Check that out below … Chi is published by the same media group as Closer . Alfonso Signorini, the defiant editor of Chi , has Tweeted that “not even a direct call from the Queen” would stop him from publishing the trove of nude pictures: “I am convinced by this scoop that Chi will be publishing on Monday because that is what we are talking about. These pictures are not offensive or in poor taste.” “They are not morbid and they do not damage the dignity of anyone. Instead the [ Prince Harry naked pictures ] published in Britain were exactly that.” “If I didn’t recognize the journalistic value of what I had then if I did not publish them I would be better off in a market selling artichokes.” See more photos of Kate Middleton after the jump … “These pictures were taken while the couple were on a terrace and they were taken from a public place so there is no suggestion of an invasion of privacy.” Meanwhile, Prince William has vowed to see the people responsible for taking the pictures of his wife put behind bars or at least sued for all they’re worth. William has told pals that he will not just sue for invasion of privacy in the French civil courts but will also pursue criminal action against those responsible. Only time will tell if he has any success, or if any more photos actually do come out. Rumor has it there are more revealing shots, but we have our doubts.
