Georgia Man Wins $25,000 Lawsuit After Cop Lies To Have Him Wrongfully Arrested via WALB News Georgia A multi-million dollar federal lawsuit against the Albany Police Department has been settled, after attorneys said officers jailed a man for 16 months, knowing he was innocent. Attorney James Finkelstein, who represented Richard Hayes, said they were pleased with the outcome. Court documents showed the suit was settled for $25,000. Hayes was 17 when he was arrested and charged with aggravated assault and gang participation in September 2009. The suit filed against Albany Police officer Charles Flowers said Hayes was unjustly held in the Dougherty County jail for one year and four months. Hayes agreed to a $25,000 settlement from the city on the day his $2 million lawsuit against Albany Police Officer Charles Flowers was to begin. On October 22nd, 2009, Flowers charged then 17-year old Hayes, a confessed Southside Blood gang member, with aggravated assault for a gang shootout on South Madison Street. Flowers remained in jail until March 9, 2011 when the charges were dropped. “We felt like we had a good position, but the litigation is protracted. Drags on and on. And we felt it was just in the best interest of a settlement at that level,” said Albany City Attorney Nathan Davis. Hayes’ attorney Jim Finkelstein said he and his client are “pleased” with the settlement. Hayes also asked for a jury trial in the lawsuit, which initially sought more than $2 million dollars in general and punitive damages.
