Former Gossip Girl star Kelly Rutherford has lost her legal battle with ex-husband Daniel Giersch, with whom she has been battling over their two kids. The stakes were high. Helena and Hermes live abroad with their German-born father per a judge’s order, and despite Kelly’s efforts, it will stay that way. Although they have joint custody, Daniel has been denied the ability re-enter the U.S., and the court has ordered the children to live with him abroad. The rationale was that Kelly was able to freely travel, so she could go visit them. The actress has contested this but her legal challenge was denied. Not even dating Matthew Settle in real life can soften that blow. She said recently: “My children, not only were they taken away, but they were sent to a foreign country. I don’t know how you even explain to someone what it feels like.” “I could sit here and tell you how often a cry. I can tell you how it feels to leave my kids in a foreign country. ‘I told my son…’You know, mommy is still fighting for you.'” “To go see them after not seeing them for weeks on end … not being able to take them to school, pick them up from school, dress them, smell them, hug them.” It’s confusing, but Giersch was ordered to apply for another visa, but hasn’t done so. Kelly tried to go to federal court, but they said that since the children hadn’t been deported, they couldn’t intervene. Giersch’s attorney said in a statement: “Daniel Giersch continues to protect the children from any negativity and therefore will continue to not engage in any of these unfortunate and false media fabrications.” Fabrications, he says, “which only served one person, but clearly not the children.” This legal fight has been so long and costly that Kelly Rutherford is bankrupt or close to it as a result of the attorneys’ fees and time spent not working.
