Was the verdict fair? Black Teen Who Shot Baby In Stroller Found Guilty An African-American teenager has been convicted of murder in the killing of a 13-month-old toddler in Georgia. Via The Grio reports: De’Marquise Elkins was found guilty of shooting Antonio Santiago in the face at point-blank range in a botched robbery on March 21 in Brunswick. It took the jury took about two hours to convict the 18-year-old. He was convicted on all 11 counts, including two counts of felony murder and one count of malice murder. Because he was 17 at the time of the shooting he will not face the death penalty under the state law. Elkins now faces a life behind bars. Prosecutors say Elkins and an accomplice, 15-year-old Dominique Lang, stopped Sherry West and the older teen pointed a gun at her and demanded money before shots were fired. Lang testified against Elkins during the trial and said the older teen fired the weapon. The 15-year-old is to be tried later. Elkins’ attorney, Glynn County Public Defender Kevin Gough, said during the trial that it can’t be ruled out that “one or both parents” may have been involved in their son’s death. West has a history of mental illness and there were no eyewitnesses to the killing except West’s version of events. During the two-week trial the West’s adult daughter, Ashley Glassey, testified against her mother. She was uneasy West phoned her the day her brother was killed for advice on cashing in on his insurance policy. She also testified her mother’s account of what happened on the day kept on changing. The killing of Santiago on March 21 drew national attention and exposed simmering tension in the coastal city of Brunswick, with opinion sharply divided along racial lines. The court case was moved to Marietta because of the extensive publicity surrounding the case. At the start of the trial lawyer Gough objected to the racial makeup of potential jurors. After the verdict, Gough issued a statement that he plans to appeal. He told reporters the all-white jury could be one basis for requesting a new trial. “That was not a jury of his peers,” he said. Elkins’ mother, Karimah Elkins, was on trial alongside him and was found guilty of tampering with evidence but acquitted of lying to police. Do you think the teens were unfairly judged?

Come on, America! We have got to do better! Atlanta police are launching an internal investigation into the case of a woman who was arrested by mistake and held in jail for nearly two months, Channel 2 Action News reports. Police are seeking to determine what happened and if any policies or procedures were violated in the arrest of Teresa Culpepper, who spent 53 days wrongfully incarcerated in Fulton County Jail because she had the same name, Teresa, as a woman wanted by authorities. “I didn’t know what to do. I didn’t know how to get out this situation,” Culpepper told Channel 2. The woman’s nightmare began Aug. 21, when she called police to report her truck had been taken from in front of her Hawkins Street home. She ended up being arrested for an aggravated assault allegedly committed by another woman named Teresa. “Her birth date didn’t match. Her address didn’t match. Her description didn’t match. Other than the name Teresa, nothing matched,” said Culpepper’s attorney, Ashleigh Merchant. Channel 2 tracked down the Teresa actually wanted by police, and the woman told the TV station she had never been arrested for the alleged offense. Culpepper finally was released Oct. 12 after her public defender got the crime victim to come to court and say the woman in custody was not the attacker. “I was like real rejoiceful, glad and happy that it came to an end and that somebody was out there, out there trying to help me,” Culpepper said. An 18-year-old college student died from a bullet to his chest as he chased three teens who robbed him and his girlfriend when he was buying a computer advertised on Craigslist for $600, a prosecutor said Friday. Details of the killing emerged at an arraignment for three 17-year-old males who were charged as adults with murder, robbery and shooting at an occupied vehicle. Superior Court Judge Joseph Brannigan entered not guilty pleas on their behalf and set bail at $5 million each — $3 million higher than the amount sought by prosecutors. Prosecutors have said Garrett Berki died late Wednesday after he and his girlfriend met suspects Rashon Abernathy, Seandell Jones and Shaquille Jordan in San Diego to buy an Apple MacBook Pro. One teen pulled a gun and robbed the couple of cash and their cell phones, authorities said. A car chase followed, with Berki pursuing the assailants on a freeway and city streets before he was shot as he tried to box them in on a dead-end street, prosecutor Kristian Trocha told reporters. Abernathy is suspected of firing a single shot from the back seat, shattering Berki’s windshield, Trocha said. Police said Berki, a San Diego community college student, was trying to read his assailants’ license plate during the pursuit. Officers found him slumped over the steering wheel, and he died less than an hour later at a hospital. All three suspects were arrested within minutes of the shooting, hiding in back yards after crashing their car in a cul-de-sac about two blocks from the shooting scene, authorities said. Patricia Dykes, Jordan’s mother, told reporters her son was “hurting” because someone got killed. She said he was a straight-A student preparing to graduate from high school. She emphasized that he was not accused of pulling the trigger. “He told me he’s going to write a letter to the (victim’s) family that he’s sorry for whatever happened, but that he didn’t … do anything violent to anyone,” Dykes said. Shearese Johnson, the mother of Jones, said her son didn’t kill anyone and called the charges unfair. Jones is suspected of being the getaway driver after the robbery. “All I’m going to say is I love my son, and I’m here, and this just isn’t fair,” Johnson said. If convicted, the three teens could face maximum sentences of life in prison, prosecutors said. Trocha told reporters all three were equally responsible for the death, even though Abernathy is the only one accused of firing a gun. “All of them participated in the robbery. The murder was part of this robbery in trying to escape,” Trocha said. “It’s as if they pulled the trigger themselves.” Trocha said all three defendants were gang members — a claim met with skepticism by the two mothers. Kevin Milmoe, a public defender, said Abernathy and Jordan had no criminal record. The judge said he would appoint a public defender for each of the three teens. Source 1 Source 2

Gabrielle Giffords was in critical condition Sunday as investigators filed five charges against the man suspected in the shooting rampage that killed six and injured 14. Jared Loughner is charged with one count of attempted assassination of member of Congress, two counts of killing an employee of the federal government and two counts of attempting to killing a federal employee. Heather Williams, the first assistant federal public defender in Arizona, says the 22-year-old suspect doesn’t yet have a lawyer, but that her office is working to get a lawyer appointed for Loughner. FBI Director Robert Mueller, who was sent by Attorney General Eric Holder to Arizona to help coordinate the investigation, said the shooter’s motive was still unknown. Investigators say they seized evidence suggesting Loughner planned ahead. Investigators said they carried out a search warrant at the suspect’s home and seized an envelope from a safe with messages such as “I planned ahead,” “My assassination” and the name “Giffords” next to what appears to be the man’s signature. Court documents also show that Loughner had contact with Giffords in the past. Other evidence included a letter addressed to him from Giffords’ congressional stationery in which she thanked him for attending a “Congress on your Corner” event at a mall in Tucson in 2007. Authorities don’t know his motive, but said he targeted Giffords at a public gathering around 10 a.m. Saturday outside a busy Tucson supermarket. Agents are “working around the clock to gather the facts to determine why someone would commit such heinous acts,” Mueller said earlier Sunday. Source
