Gary Giordano Sues to Collect Robyn Gardner Insurance Policy

Gary Giordano, the suspect in travel companion Robyn Gardner’s disappearance in August, is suing to collect on an insurance policy he took out on her. Giordano, 51, filled the lawsuit last week against American Express for $3.5 million for failing to pay him the death benefit he says he is entitled to. Gardner presumably died after her August 2 disappearance but has not been found. Giordano says the accidental death policy was part of regular travel insurance that not only gave him coverage, but covered his traveling partner as well. Robyn Gardner’s policy is worth $1.5 million. “When somebody takes out a policy and there is no body, they are required to wait 365 days before making a claim,” American Express told ABC News. That means Giordano won’t be eligible to collect until August 2012. Giordano tried to collect on the policy two days after he notified authorities about Gardner’s disappearance , for which he was detained for months in Aruba . “My lawyer at the time, Michael Lopez, said you need to call insurance immediately,” Giordano said, claiming he was just following the standard protocol. “I’ve purchased it [travel insurance] many times before. I have children. If I go traveling and I disappear, I want them to be covered, OK?” An American Express employee who spoke to Giordano, however, later told police: “[Giordano] sounded excited, like he was about to win something.” Richard Forester, Gardner’s boyfriend at the time of her disappearance, says the new lawsuit only makes him more suspicious of Gary Giordano. On an unrelated note, he was arrested for indecent exposure last month.

Gary Giordano, Robyn Gardner Murder Suspect, Released By Aruban Officials

Gary Giordano, the businessman who continues to be the prime suspect in the strange disappearance of Maryland woman Robyn Gardner in Aruba, has been released. The decision to cut Giordano loose came just hours after Gardner’s cousin said the family was “disappointed” by Aruban authorities’ fruitless effort to find her body. Gardner is presumed dead and Giordano is believed by many to be involved in her mysterious vanishing this summer. But proving it has been a different matter. “Needless to say, our family is very disappointed that after all this time, we are no closer to finding out what happened to Robyn,” Kelly Reed said in a statement . Gary Giordano, also of Maryland, had been in police custody for almost four months, and authorities insist that he’s lying about the fate of his traveling companion. He was freed after a judge ruled prosecutors didn’t have enough evidence to hold him there any longer. Giordano issued no comments as he departed the facility. Gardner, 35, met Giordano, 50, through an online dating site and the pair took a vacation to the Caribbean island on July 31. Soon after, things went horribly awry. Giordano reported Robyn Gardner missing just two days later. He said Gardner was pulled out to sea by a strong current as they snorkeled near the shore. Three days after her mysterious disappearance, Giordano was locked up as witnesses disputed his story, and after graphic photos were found on his camera. But the body of Robyn Gardner has yet to be discovered. “The case does not end here,” Aruba’s Solicitor General Taco Stein vowed. “Mr. Giordano will remain our prime suspect. We know he is lying; His story is not true.” Prosecutors said they will continue to build a case and will seek his extradition from the U.S. if an appeals court issues a reversal and orders him back behind bars.

Graphic photos found on the camera of a man Robyn Gardner was with have deepened the mystery surrounding the Maryland woman’s disappearance. Robyn was supposed to be in Orlando with her parents – or so she told her boyfriend, Richard Forester. In reality, she went on a vacation to Aruba. Now the 35-year-old is missing and presumed dead. Gary Giordano , a 50-year-old Maryland businessman with a disturbing past, remains in custody. The mystery has only deepened as authorities in Aruba begin releasing details from the investigation, such as images that are “beyond pornographic.” No other information about the photos has been revealed, and it’s still not known exactly when the pictures – on Gary Giordano’s camera – were taken. It is also difficult to determine whether the acts are consensual, says Julia Renfro, editor-in-chief of Aruba Today, the island’s English language daily. “You only see organs,” Renfro tells People Magazine , disturbingly. “You don’t know if she is awake. There are other pictures where she is posing naked.” It’s the latest surprise in a case that had already gained notoriety because of its parallels to the unsolved disappearance of Natalee Holloway, 18. The suspect in that case, which captivated the nation in 2005, is Joran van der Sloot, who is being tried this fall in Peru for another murder. As far as Robyn Gardner is concerned, leads have been provocative. Along with the photos, authorities are looking into a $1.5 million accidental death insurance policy Giordano reportedly took out on Gardner before the trip.
