Walmart Truck Driver Who Injured Tracy Morgan Wants Criminal Charges Dropped This guy almost killed 2 men and has the nerve to think he shouldn’t face criminal charges? Via PageSix The truck driver who slammed into a limo carrying Tracy Morgan, killing one man and severely injuring the comedian, will ask a judge next week to throw out criminal charges against him. Kevin Roper was driving a Wal-Mart truck in June 2014 when he crashed into Morgan’s limo van. The former “30 Rock” and “Saturday Night Live” star suffered brain trauma, broken ribs and a broken leg, and his friend James McNair was killed. Two other passengers also suffered serious injuries. Within days, Roper was charged in state court with one count of death by auto and four counts of assault by auto, though as of Friday he hadn’t been indicted, said his attorney, David Glassman. Glassman told The Associated Press he will ask a judge in Middlesex County on Tuesday to dismiss the case because Roper is unable to get a fair trial because of negative publicity surrounding Morgan’s federal lawsuit against Wal-Mart. Awwww, poor thang… According to the Roper’s lawyer, the negative publicity surrounding his client after the civil lawsuit was settled has made it nearly impossible for him to get a fair trial. “Civil cases are routinely stayed for criminal cases to proceed,” Glassman said in an email. “Had that occurred and a stay issued in the civil case, a tsunami of negative pretrial publicity would have been avoided and Roper’s right to a fair trial would have been preserved.” We hope not only do the keep the charges, but that they sentence him for as long as they legally can. By Jocelyn Vena Common Photo: MTV News With the Maya Angelou controversy over his song “The Dreamer” cleared up, Common can now drop his newest release, The Dreamer/The Believer , with a clear conscience. The rapper’s latest effort hits the streets on Tuesday. “That’s very special to me, man. I’m excited, man. This is like one of the favorite, one of my favorite albums that I ever been a part of,” he told MTV News on the red carpet at “VH1 Divas,” where he was on hand to introduce the Amy Winehouse tribute . “And I feel like it has that music that we want to hear. So it’s produced by No I.D. and it’s some great music. “I wanted to make hip-hop music. I wanted to make hip-hop that I felt right now and the way that I’ve known it in my years to sound,” he continued. “So it just was about, like, let’s make some real good hip-hop music and make it a great piece of art, so when people hear the album, they can have the complete package of everything.” In addition to releasing new music, Common is also knee-deep into the season of his AMC drama “Hell on Wheels,” in which he plays former slave Elam Ferguson, who is struggling with his identity shortly after the Civil War. “I’m supercharged about that also,” he said. “We’ve been doing really well. Everybody that has been supporting it, thank you very much. And those that haven’t seen it, you got to check it out.” Much like in his music, the show is about storytelling and taking fans on an emotional journey. “It’s a great story about the building of the Transcontinental Railroad, but it’s more about the relationships of the people who were there to build this dream, you know, from freed men, from black freed men, to the Irishmen to Confederates to Union soldiers to the whores of the town and how these lives mesh.” Balancing his acting and musical careers is sometimes a struggle, but it’s a struggle that Common is willing to make. “Once I really got into the acting world, I definitely had to balance it,” he explained. “I love acting — I love it for real and I love music too. I got to give them both attention. I can’t neglect either one. It’s a little easier working on the album, but they both mean a lot to me.” Related Artists Common

Open Thread: The 2nd Amendment as a Civil Rights Issue

Yesterday’s landmark Supreme Court decision overturning the blanket handgun ban in Chicago continues the legacy of the civil rights movement, some commentators argue . Within the text of the 214-page Supreme Court ruling on gun rights is a history lesson on how Americans’ right to keep and bear arms was a major issue in the struggle for black civil rights in the South after the Civil War. To wit, Southern resisters, black codes and lawless lawmen attempted to disarm freedmen (usually in order to make them more vulnerable to racist terrorism), and the federal government came to their rescue by protecting their 2nd Amendment rights. The quotations and detailed references leave absolutely no question that Congress and the ratifiers of the 14th Amendment viewed it — and accompanying post-war civil rights legislation — as a safeguard against state infringement of the 2nd Amendment right of the people to keep and bear arms. It’s not a part of our history that the Left has much stomach for, but fewer people argue against the obvious now that the Democratic Party has all but conceded the gun issue.
