Open Thread: Arizona Guilty of Enforcing the Law

There are, contrary to popular belief, a number of states with immigration laws similar to Arizona’s. They are not, of course, being sued by the Justice Department. Why ? California is NOT being sued by the Federal Government for it’s law regarding illegal immigration and law enforcement cooperation with detaining suspects who may be illegal aliens. California’s law forbids ANY entity from interfering with the enforcement of this law, but California does not enforce this law, instead Los Angeles is boycotting Arizona and the Obama administration is spending million in taxpayer dollars to tell a court that States cannot enforce Federal laws, despite Federal laws that urge and seek local and state cooperation. Why isn’t California being sued? THE ANSWER IS SIMPLE- California has no intention of enforcing this law while Arizona does. What’s your reaction?

Feds suing to stop Ariz. immigrant law

The U.S. Justice Department is filing a lawsuit challenging the constitutionality of Arizona's tough new law targeting illegal immigrants. The planned lawsuit was confirmed to The Associated Press by a Justice Department official with knowledge of the plans. The official didn't want to be identified before a public announcement planned for later Tuesday. The lawsuit will argue that Arizona's new measure requiring state and local police to question and possibly arrest illegal immigrants during the enforcement of other laws, like traffic stops, usurps federal authority. Tuesday's action has been expected for weeks. President Barack Obama has called the state law misguided. 100 foot long Narco Sub seized in S. America

The U.S. government announced on Saturday afternoon that for the first time ever a fully operational submarine used by drug traffickers has been seized in the waters of South America. The craft, which could move multi-ton loads of cocaine, was seized in a jungle tributary of Ecuador leading to the Pacific Ocean by Ecuadoran authorities using Drug Enforcement Administration intelligence. The sub is diesel-powered, has a periscope and air conditioning and measures 100 feet long and 9 feet tall. At least one person was arrested and an investigation continues, according to a news release from DEA. Although traffickers have used so-called “narco subs,” low-slung boats that are fully covered and ride low in the water, this is the first full-on submarine ever found in their hands. added by: Stoneyroad

L.A. Police Officer Charged With Distributing Meth

A Los Angeles police officer has been charged with selling methamphetamine, the U.S. Attorney's Office in San Diego announced Wednesday. Yoshio Romero, 28, was arraigned Tuesday in federal court on the charge of distributing meth, reports Andrew Blankstein of the Los Angeles Times. The five-year LAPD veteran faces up to 10 years in federal prison if convicted. The arrest followed a months-long investigation, according to the U.S. Attorney's Office. Romero arranged to sell 111 grams of meth in December 2009 for $4,200, according to the federal criminal complaint from U.S. Drug Enforcement Administration agents. The police officer allegedly told an undercover agent that he “could supply him with any quantity of methamphetamine that he wanted,” according to the affidavit. (more @ link) added by: Omnomynous

Therefore, few drivers are identified, prosecuted, or convicted for DUID. Law enforcement personnel usually cite individuals with the easier to prove driving while intoxicated (DWI) alcohol charges. Unclear laws provide vague signals both to drivers and to law enforcement, thereby minimizing the possible preventive benefit of DUID statutes. Fifteen states have passed laws clarifying that the presence of any illegal drug in a driver's body is per se evidence of impaired driving. ONDCP will work to expand the use of this standard to other states and explore other ways to increase the enforcement of existing DUID laws. Here are the states President Obama would like the others to emulate: 1. Arizona: Zero tolerance for cannabis metabolites, mandatory 24 hours jail, up to 6 months upon conviction. 2. Delaware: Zero tolerance for cannabis metabolites. 3. Georgia: Zero tolerance for cannabis metabolites, mandatory 24 hours jail, up to 12 months upon conviction. 4. Illinois: Zero tolerance for cannabis metabolites, up to 12 months upon conviction. 5. Indiana: Zero tolerance for cannabis metabolites, up to 60 days upon conviction. 6. Michigan: Zero tolerance for cannabis metabolites, up to 93 days upon conviction, vehicle immobilization for up to 180 days. 7. Nevada: 15 ng/ml for cannabis metabolites. 8. Ohio: 15 ng/ml for cannabis metabolites, mandatory 72 hours in jail, up to 6 months upon conviction, 6 month to 3 year license suspension. 9. Pennsylvania: DUID for cannabis metabolites, amount unclear. 10. South Dakota: Zero tolerance for cannabis metabolites for persons under the age of 21. 11.
