Lindsay Lohan’s lawyer is doing all she can to negotiate the best possible plea deal for a client who, in legal parlance, is up s— creek without a paddle. The troubled star has other ideas about how to proceed, however. Lindsay doesn’t care what Shawn Chapman Holley is trying to work out with the D.A., and is still steadfastly refusing to plea bargain if it involves jail time. DENIAL : The writing is on the wall, but LiLo won’t read it . Facing felony grand theft charges for allegedly pilfering a $2,500 from a jewelry store, and already on probation for her 2007 DUI case, she’s up against it. Nevertheless, Lohan insists on going to trial in the hopes she will win and clear her name. Apparently the train wreck is unaware of how probation works. Holley, D.A. Danette Myers and Judge Keith Schwartz will meet week to get a feel for how much time Lindsay Lohan will be sentenced to with a guilty plea.

But on Thursday, a day after posting bail and being released from jail in the case, the 24-year-old actress defended herself via Twitter. “I would never steal, in case people are wondering,” she tweeted . “I was not raised to lie, cheat or steal.” Lohan also lashed out at detractors who said the clingy white mini-dress she wore to court was inappropriate given the gravity of the situation. She is facing three years in prison if convicted. “What I wear to court shouldn’t be front-page news,” she wrote. “It’s just absurd.” Out on $40,000 bail, the “Mean Girls” actress said she’s just ready to move on and get her career back on track. “I just want to be on set again,” said Lohan, who hasn’t appeared on screen since a brief cameo in last year’s “Machete.” Lohan’s lawyer, Shawn Chapman Holley, told CNN that despite pleading not guilty, her client is willing to cut a plea deal as long as it doesn’t involve any jail time. “Ms. Lohan maintains her innocence, and now that I’ve seen the police reports, I believe the case is entirely defensible,” Holley said of the police account of the January 22 incident. “Having said that, we will entertain a discussion concerning a plea if it means no jail so that she can move forward with her recovery and her career.” TMZ reported on Friday that according to the police report, the store’s owner did not want to get the police involved in the case. The owner “stated that she does not want to press charges,” the report read. “She stated that she only wants her necklace returned.” Though the owner was reluctant, the district attorney reportedly decided that there was enough evidence to warrant a prosecution. Lindsay Lohan Feels D.A. is "Out to Get Her"

Lindsay Lohan is never at fault. She’s just an easy target . So says Lindsay Lohan . The alleged jewelry bandit is complaining to friends and family that members of the District Attorney’s office are “out to get me” and using her to get elected. Deputy District Attorney Danette Meyers, who oversees Lindsay’s probation DUI case, will likely a the felony grand theft complaint against the star this week. The charge relates to the allegation that Lohan stole a $2,500 necklace from a jewelry store in Venice, Calif., which she claims was merely loaned to her . Lindsay’s attorney, Shawn Chapman Holley, the hardest working woman in L.A., met with Meyers on Monday, and the result was another day of freedom. Lohan was believed to be facing arrest yesterday, then today. But now “Lindsay’s fate won’t be decided for at least a day or more,” one source said. “As of right now, the case is still under review.” Holley has been out of town for business, and it’s unlikely that Myers would charge Lindsay with was out of town. She supposedly returns this evening. Meyers disputed Lindsay’s assertion that she’s being targeted , saying: “The D.A.’s Office has been fair and compassionate in prosecuting Ms. Lohan.” “The same fairness and justice will be applied in determining whether or not to file charges in the present manner. I think her lawyer would agree with this statement. I believe justice was administered fairly and equitably.” Meyers is running for District Attorney of Los Angeles, but before Lindsay jumps to conspiracy theories against her, she needs a geography lesson. “Because of where the crime took place, it falls under Meyers’ jurisdiction,” but wouldn’t if the theft took place in the Valley or Malibu, reports say. “Lindsay has no idea the amount of trouble she is in now. The surveillance video is going to be the strongest evidence against her,” the source adds. Nor will returning it help her. “Just because the necklace was returned to cops, and the warrant wasn’t executed didn’t compromise the case.” Another reason to worry: “Meyers doesn’t mess around when it comes to felony charges, and she’s unimpressed with Lindsay’s celebrity status.” Once Lindsay is charged with felony grand theft, she will have to formally surrender, and an arraignment date set. Look for that by week’s end.

Cry Me A River: Montana Fishburne Says The D.A.’s Office Won’t Let Her Be Great

Back in September, when Lawrence Fishburne’s spotty-booty daughter went to rehab, we thought she was genuinely trying to get her life together. It turns out her rehab was part of a plea deal which the L.A. Attorney is now trying to renege on, TMZ reports . TMZ has learned Montana’s lawyer, Shawn Chapman Holley, filed blistering legal papers in L.A. Wednesday, claiming last June, prosecutors who filed the assault case agreed to allow Montana to enter a rehab program for 90 days, and in return she’d get no jail time. Holley says Montana, relying on the L.A. City Attorney’s offer, entered a rehab facility, where she’s been since September. According to Holley, prosecutors did an about-face in November and told her they wanted Montana to serve 120 days in jail. Now Holley has gone to the judge, asking her to enforce the deal her client relied on. TMZ has learned … Montana has now decided to spend 180 days in the rehab facility. She better be in there getting some guidance and healing and not just trying to duck a sentence! You know… so her dad doesn’t have to suffer through any more Black Men’s spreads. SMH.

Richie was put on probation that year in connection with DUI charges she received after being pulled over while driving the wrong way on a Los Angeles freeway. Richie’s lawyer, Shawn Chapman Holley, went to court Wednesday morning (December 29) to present the judge with proof that her client had completed the terms of her probation. The verification included a report from the alcohol-education program that the reality-TV star had been attending for the last 18 months. Richie was supposed to end her probation in February 2011, but the judge agreed to terminate it early after ruling that all the terms were been met sufficiently. Earlier this month, Richie and her longtime beau, Good Charlotte rocker Joel Madden , finally tied the knot after dating for four years and having two kids together. The wedding took place in California at the home of Nicole’s dad, Lionel Richie. An array of stars helped the celebrate the nuptials, including No Doubt frontwoman Gwen Stefani, celebrity DJ Samantha Ronson and Madden’s twin and Good Charlotte bandmate, Benji. Reverend Run presided over the ceremony. The couple have a 1-year-old son, Sparrow, and an almost-3-year-old daughter, Harlow. The pair made headlines last February when they announced their engagement. Richie broke the news during an appearance on “The Late Show With David Letterman,” while Madden took to Twitter to let the world know. In October 2009, Richie opened up about being a parent. “I couldn’t be happier,” Richie explained to People . “The only thing you want is for your kids to be healthy and happy, and they are. I’m right where I belong.”
