Kevin Clash: Accusers Have No Right to Sue Given Statute of Limitations

Former Elmo puppeteer Kevin Clash is trying to get all three of the lawsuits alleging sexual misconduct by him dismissed, citing statutes of limitations. He stands accused of inappropriate sexual relations with boys under the age of 18; Clash previously denied all of the allegations against him. Clash attorney Michael Berger wrote in a brief Friday: “There are two applicable types of statutes of limitations , a six-year one based on when the right of action has accrued, and a three-year one based on when the alleged victim turned 18 and was therefore no longer under the disability of being a minor.” According to Clash’s camp, both have lapsed. Cecil Singleton , the first to file suit against the former Sesame Street staple, said in court documents that his interaction with Clash occurred in 2003. He was 15 at the time. He stated that he wasn’t “aware he had suffered adverse psychological and emotional effects from Kevin Clash’s sexual acts and conduct until 2012.” The second plaintiff, who filed as John Doe, said in his suit that he was 16 when he had an inappropriate sexual relationship with Clash in 2000. A third plaintiff, identified only as S.M., charged in a complaint that he was “16 or 17” when he had sexual contact with Clash in the mid-1990s. Yet another man, Sheldon Stephens , accused Clash of similar behavior before settling out of court … then saying he wishes he hadn’t settled. Berger states in today’s filing that the three men suing Clash would have needed to file suit, respectively, in 2009, 2006 and 2001 to be within six years. Or, based on their respective ages, in 2009, 2003 and 2000, respectively as the latest possible dates to be within three years of them turning 18. All three suits were filed in November and December of 2012. Jeff Herman, who represents all three plaintiffs, tells E! News he doesn’t think a motion to “avoid liability on technical grounds” will be successful. “It should be noted his motion does not say the abuse did not happen, just that it is too late to file the complaints,” Herman told the network in response. “The law we are proceeding under recognizes the rights of victims to bring their lawsuits within six years from the time they connect their injuries to the abuse.” “We are hopeful the Court will see it our way, however, by being able to bring their claims forth publicly the victims are already further along in the healing process.”

Ice-T Disrespected By Coco, Lashes Out on Twitter Over AP.9 Pics

Ice-T understandably felt disrespected by his wife, Coco, when pictures of her canoodling with rapper AP.9 hit the web courtesy of celeb gossip site Media Takeout. Naturally, Ice responded by going OFF on Twitter. “Don’t get it twisted, I’m not happy about this s–t,” he wrote. “Most of [the pictures are] disrespectful and in bad taste. She’s made me look and feel like s–t.” Coco responded by apologizing completely and sincerely. “Ice is right, the pics I took with this man were in poor taste & I disrespected my husband,” she admitted. “However the pics were the only thing that happened.” “I feel so sad,the bottom line is I love Ice & I can understand why he’s upset theres no excuse for my actions. I’m so sorry baby & to everyone else.” Ice-T has since deleted his missive, so we’re assuming he accepts the apology. We also assume Coco’s right, and that there was nothing more to this. Anyone who has watched Ice Loves Coco knows that they have a loving, stable and surprisingly normal relationship for a couple that stars on an E! show. Coco may have made an error in judgment and disrespected Ice-T, but if there were a real affair going on, she’d obviously be more careful about it. Hopefully she makes it up to her man in ways only Coco possibly can, and all will be right with the world again. Cross your fingers, fans. Cross your fingers.

Kevin Clash Accuser #4 Alleges Underage Sex With Elmo Puppeteer, Files Lawsuit

A fourth – yes, fourth – accuser has come forward with a lawsuit against Sesame Street’s former Elmo puppeteer Kevin Clash, who he accuses of sexual misconduct. The unidentified man says he was 16 or 17 in the ’90s when he met Clash in Miami Beach. Afterward, Clash “lured the boy to visit him in New York, with promises to pay for his plane ticket, be a ‘dad’ to him in New York and give him cash and a free place to stay.” That’s according to an excerpt from the filing released by Miami-based attorney Jeff Herman, who also represents two of the three previous Clash accusers. The offer appealed to the boy, “who was contemplating running away,” according to the suit. “These are all vulnerable boys,” Herman said at a Miami press conference. “None of them had father figures in their lives and they were looking for that father figure.” In a statement, Kevin Clash’s attorney, Michael Berger, said “the lawsuit is without merit and we will vigorously defend the case and Mr. Clash’s reputation.” Clash resigned from Sesame Street , where he worked as an executive producer and puppeteer for 28 years, on November 20, amid a slew of similar claims. He stepped down the same day as a second accuser stepped forward. Clash’s first accuser, Sheldon Stephens, made, then recanted, sexual abuse allegations. Stephens accepted a legal settlement with Clash, then disavowed it. The second accuser, Cecil Singleton , made similar claims about Clash and his relationship with him, which he says began when he was under the age of 18. It was at that point that Clash bowed out of Sesame Street . A third Kevin Clash accuser later claimed he was plied with booze. The puppeteer, now 52, is openly gay but denies he slept with any boys who were underage.

TALKBACK: Can Elmo Recover In The Wake Of Kevin Clash’s Resignation?

” Elmo  is bigger than any one person,” the producers of Sesame Street declared last week when Kevin Clash, who was the voice of the  furry and very famous red muppet, was first accused of having sex with a minor. That statement is about to be tested in the wake of Clash’s resignation from the venerable children’s show after a second allegation, this time, in a lawsuit, was reported by the Associated Press on Tuesday. Although Clash’s first accuser recanted his claims, a lawsuit filed in federal court in New York charges Clash with sexual abuse of a second youth, Cecil Singleton, then 15 and now an adult.  According to the AP (via Yahoo!) , the lawsuit, which seeks damages in excess of $5 million, alleges that Singleton was persuaded by Clash to meet for sexual encounters. A statement posted on the Sesame Workshop blog, also on Tuesday, noted that “the controversy surrounding Kevin’s personal life has become a distraction that none of us want.”  The statement additionally read that Clash had resigned after 28 years at Sesame Street , because he’d concluded that “that he can no longer be effective in his job.” “It’s a sad day for Sesame Street ,” concluded the statement. It’s also a thorny public-relations problem for Sesame Workshop. But while   Clash’s career won’t likely bounce back from this scandal  any time soon, the reality is that Elmo is going to be fine. Movieline ‘s offices are located in the Times Square and even as news of these new allegations were breaking, there were two people dressed as Elmo circulating among the tourists and making a few bucks by taking pictures with children. They did not seem to be having trouble attracting business and no one was taunting them about the Clash story.  In fact, when I approached one of the Elmos, who identified himself as Jose Segarro — that’s him in the picture with Hello Kitty — he was unaware of Clash’s resignation and told me that business was “the same.” In a recent piece on the growing scandal, The Grio.com interviewed Jim Silver, Editor in Chief of the online family site, Time to Play.com, who pointed out that while a small group of parents may be hesitant to buy an Elmo-related product for their kids in light of Clash’s problems, the brand remains strong. (He estimates that Elmo generates more than 50 percent of the $75 million in sales that Sesame Stree t toys generate each year. ) “Kevin [Clash] is the voice and is not Elmo the same way James Earl Jones is not Darth Vader.” Exactly.  Despite this scandal’s great potential as a media story, my experience as a father tells me that kids, who are in the Elmo-loving age bracket, aren’t going to spend a lot of time thinking about what the voice of Elmo does in his personal life, even if they’re savvy enough to understand that Elmo is a puppet voiced by an actor.  And even if there are a few preternaturally aware youngsters who watch a lot of cable news and grasp what’s happening here,  they’re probably going to grow up to be the kind of knowing pop-culture savants who will convert this unfortunate chapter in Sesame Street history into some form of art or journalism, whether it be a documentary, book or comedy routine. That may be cold comfort, but, at this stage in the story,  the silver linings don’t look all that plentiful.
