Órale! Motel 6 Agrees To $7.6 Million Settlement Over Claim They Shared “Latino Sounding” Names With Immigration

Getty Images Motel 6 To Pay 7.6M To Help Settle Claim It Called ICE On Latino Guests After a nationwide class-action lawsuit against  Motel 6 , the chain has agreed to pay as much as $7.6 million to guests who said their private information was given to U.S. immigration agents, according to court records. Former guests sued the motel chain over privacy violations earlier this year , alleging that the chain handed over their personal information to ICE agents, according to the lawsuit. This lawsuit came after a 2017  Phoenix New Times report that these agents made at least 20 arrests at two Motel 6 locations in Arizona. Under the new proposed settlement agreement, the hotel has also agreed not to share guests’ personal information without a warrant or subpoena, unless necessary to prevent “a significant crime,” according to the court document. “It’s very important in our minds that Motel 6 is putting in place policies and procedures that would prevent this from happening again,” Thomas Saenz–president and general counsel at the Mexican American Legal Defense and Educational Fund (MALDEF)–told The Washington Post on Tuesday. MALDEF is who represented the guests in the class-action lawsuit. Now, Motel 6 and MALDEF have announced in a joint statement that the hotel has prohibited employees from sharing such information about its guests. “Motel 6 fully recognizes the seriousness of the situation and accepts full responsibility for both compensating those who were harmed and taking the necessary steps to ensure that we protect the privacy of our guests,” it said. Despite this, the hotel chain still did not admit to any wrongdoing. MALDEF filed this lawsuit back in January, on behalf of seven class representatives from Arizona and one from Washington state. It alleged that employees at Motel 6 locations in Arizona gave Hispanic guests’ personal information, such as their Mexican passports and other forms of identification, to agents from the Department of Homeland Security and ICE without warrants being served. The  proposed settlement states that Motel 6 will pay up to $5.6 million (at least $7,500 per guest) to those who were placed in immigration-removal proceedings; up to $1 million (at least $1,000 per guest) to those who were interrogated; and up to $1 million (at least $50 per guest) to those whose personal information was given to federal authorities. Motel 6 will also cover the cost of the former guests’ legal fees.

Obama Budget Director Undermines Legal Case For ObamaCare

Here is the original post:

Part of the Obama administration’s legal defense of ObamaCare’s individual mandate to purchase health insurance rests on the argument that the penalty for not paying is justifiable under the conressional power to tax. ObamaCare doesn’t actually require anyone to purchase anything, the argument goes; the law just makes people pay a tax if they don’t. Courts have so far not been kind to this argument… Broadcasting platform : YouTube Source : Reason Magazine – Hit & Run Discovery Date : 15/02/2012 17:16 Number of articles : 2

Lindsay Lohan’s Probation Revoked After Failed Drug Test

A bench warrant has been issued in case actress doesn’t appear in court Friday morning. By Gil Kaufman Lindsay Lohan (file) Photo: Mark Ralston/ Getty Images Lindsay Lohan might soon have more than the embarrassment of a positive drug test to contend with. After admitting Friday to failing a test, TMZ reported Monday (September 20) that Lohan’s probation has been revoked and a bench warrant was issued for her arrest in the incident. Lohan has been ordered to appear in court Friday morning, which means that, although the warrant was issued Monday, it will be held until she comes before Judge Elden Fox or executed should she fail to appear. The gossip outlet claimed that the revocation came after Fox read about Lohan failing a drug test — the site has claimed she actually failed two recent tests — on TMZ. According to the site, one test showed the presence of cocaine in Lohan’s system and in another, she allegedly tested positive for amphetamines. Before she entered jail in July, it was revealed that Lohan had a prescription for the ADHD drug Adderall , which is an amphetamine, but it is unknown if it was that prescription medication that caused the positive test. Lohan’s lawyer could not be reached for comment at press time. On Monday, Robert J. Lindsey, president and CEO of the National Council on Alcoholism and Drug Dependency, told MTV News that, while it was not surprising that Lohan appears to have relapsed, he was encouraged by her ownership of the slip-up. “From what I’ve heard, the tone with which Lindsay talked about the fact that she tested positive was very encouraging,” Lindsey said. “She really recognized that what this is is a relapse into active addiction, and she is very committed to making sure that she gets back on track.” Over the weekend, Lohan admitted to failing her recent drug test. Hours after reports surfaced Friday that the “Mean Girls” actress didn’t pass her latest test, the troubled starlet conceded she was still struggling with addiction. “Regrettably, I did in fact fail my most recent drug test and if I am asked, I am prepared to appear before judge Fox next week as a result,” Lohan tweeted late Friday night. “Substance abuse is a disease, which unfortunately doesn’t go away over night. I am working hard to overcome it and am taking positive steps forward every day. I am testing every single day and doing what I must do to prevent any mishaps in the future. … This was certainly a setback for me but I am taking responsibility for my actions and I’m prepared to face the consequences.” According to the conditions of her post-rehab release, the actress could return to prison for 30 days if Fox confirms that she failed a drug and alcohol test. Lohan served 13 days of a 90-day jail sentence in July over a probation violation from a pair of 2007 DUI cases. Lady Gaga Motivates Her Monsters For ‘Don’t Ask, Don’t Tell’ Rally

The Servicemembers Legal Defense Network explains how Monday’s rally in Maine could help repeal the law. By Kyle Anderson Lady Gaga with her military friends on the VMA red carpet Photo: Kevin Mazur/ WireImage The normally mild-mannered city of Portland, Maine, will find itself at the crossroads of pop culture and American politics on Monday afternoon (September 20), thanks to Lady Gaga . The singer will be the special guest at a rally in the city to draw attention to Tuesday’s planned procedural vote in the Senate that will decide whether to break the filibuster over the repeal of “Don’t Ask, Don’t Tell” laws and allow the House-approved bill to come to a vote. The event, put on by the Servicemembers Legal Defense Network, seeks to prove to Maine Republican Senators Olympia Snowe and Susan Collins that there is enough fervor in their constituency to justify their breaking party ranks and voting to end the filibuster. But Gaga isn’t just a gun for hire. Rather, she is the whole reason the event is happening. “This has been a very organic process, and it all came from Lady Gaga,” SLDN’s Emily Sussman explained to MTV News via Skype. “She heard the stories of some discharged servicemen and women and insisted that she get involved.” That involvement has manifested itself in a number of ways over the past few weeks. Following a concert in Washington, D.C., Gaga got the chance to meet some former members of the military who were discharged because of “Don’t Ask, Don’t Tell” violations. She was so moved by their stories that she brought several with her to the 2010 MTV Video Music Awards in Los Angeles, where they accompanied her on the white carpet while she rallied for their cause. Gaga also recently produced a pair of YouTube videos instructing fans on how to contact their Senators and then showing off some of the responses she’d received. “Lady Gaga could not have gotten involved at a better time legislatively,” Sussman said. “The House has already acted, and now is the time the Senate has to act. She motivated her base, and her little monsters responded.” Not only have her actions brought about celebrity-assisted attention to the cause, but they have also yielded tangible results. “The response has been huge,” Sussman said. “All I ever want is for people to start calling their senators, and all of a sudden [Gaga] tweets it, and the phone lines start blowing up! One of the first videos we saw in response was of two girls in Boulder, Colorado. They picked up the phone and called Senator [Michael] Bennet, and within a couple of hours, he made a YouTube video responding to it. This is really personal democracy in action. It’s pretty exciting.” The event will not only feature Gaga (who will speak about her experiences with members of the military) but also several former military members — both gay and straight — who will recount their stories. Gaga has even started to rally around the Twitter hashtag “4the14k,” which represents the 14,000 members of the military who have been discharged because of “Don’t Ask, Don’t Tell.” Related Videos Lady Gaga Gets Involved With ‘Don’t Ask, Don’t Tell’ Related Artists Lady Gaga

Lady Gaga To Attend Maine Anti-‘Don’t Ask, Don’t Tell’ Rally

Singer will join Servicemembers Legal Defense Network’s #4the14k event Monday. By Mawuse Ziegbe Members of the Servicemembers Legal Defense Network join Lady Gaga at the 2010 MTV VMAs Photo: Getty Images Lady Gaga’s campaign against the U.S. Armed Forces’ “Don’t Ask, Don’t Tell” policy has been building the momentum in the past few weeks. The singer has publicly championed the repeal of the measure, by flying out members of the Servicemembers Legal Defense Network for the VMAs , an organization seeking to end DADT, tweeting her opinions to senators and releasing viral videos urging her fans to get involved in the cause. Now, after hitting the white carpet and taking to the Web, Gaga is heading to Maine to raise awareness at a large gay-rights event. The pop superstar is slated to appear at the #4the14k rally organized by the SLDN in Portland, Maine on Monday. The title references the approximately 14,000 citizens discharged under DADT and veterans affected by the military’s controversial measure will address attendees. The event is slated to kick off at 4 p.m. ET. “Meet me in Portland, Maine 2moro, 9/20 to help repeal #DADT. I’m holding a Rally + speaking live in Deering Oaks Park,” Gaga tweeted on Sunday (September 19). Aubrey Sarvis of SLDN maintains that the organization seeks to draw the support of Republican Maine Senators Olympia Snow and Susan Collins, who could significantly affect the passing of the “National Defense Authorization Act,” a bill which includes the repeal of DADT. “The votes to break McCain’s filibuster are not there. We need Sens. Snowe and Collins on board; they’re key to us breaking the filibuster. With the vote less than 48 hours away, we need everyone supporting repeal to call the Senate. We’re bringing gay and straight service members to Portland to help make the case,” Sarvis said in a press release . “And we’re proud to have the support of Lady Gaga to bring grassroots attention to repeal at a critical hour. Like Lady Gaga, all New England senators, indeed all 100 senators, Democrats and Republicans, need to engage in a real debate on this issue, and not just posture and spin this week over procedure and Senate rules.” Gaga has been working with the organization recently and detailed her views on DADT in a viral video released on Friday . “[The] SLDN’s advocacy proves that these soldiers are being searched; superiors are going through their e-mails and private belongings, calling family members and operating based on assumptions. Ultimately, the law is being enforced using gay profiling. … In short, not only is the law unconstitutional, but it’s not even being properly enforced by the government,” Gaga said. “I am here to be a voice for my generation, not the generation of the senators who are voting, but for the youth of this country, the generation that is affected by this law and whose children will be affected,” she continued. “We are not asking you to agree with or approve the moral implications of homosexuality; we’re asking you to do your job, to protect the constitution.” What do you think about Lady Gaga and “Don’t Ask, Don’t Tell”?
