Gabriel Aubry Avoids Criminal Charges in Nanny Case

Finally some good legal news today for Gabriel Aubry. Sources tell TMZ the Canadian model will NOT be charged criminally for allegedly shoving his daughter’s nanny a few weeks ago, an act that has resulted in numerous hearings and court battles between Aubry and ex-girlfriend Halle Berry. While a battery report was filed by the nanny in question, a Los Angeles County Attorney spokesman says there’s “insufficient evidence” against Gabriel to pursue any charges. However, there is still plenty to work out between Aubry, Berry and the L.A. Department of Children and Family Services, especially after Nahla told officials that she’s often frightened of her father, due to his outbursts of anger. For now, Aubry can only see his child under the supervision of a monitor, while Berry has petitioned a court to allow her to move to France with Nahla and fiance Olivier Martinez. [Photo: WENN.com]

When will the baby daddy drama end !? The Los Angeles County of Department of Children and Family Services is recommending that Halle Berry’s ex-boyfriend, Gabriel Aubry, have another adult present during his custodial time with their three-year-old daughter, Nahla. According to Radaronline : “Case workers are recommending that a nanny be present with Gabriel during his visitation times. Halle’s nanny had been with Nahla when Gabriel had his custodial time from noon until she went to sleep. However, after the alleged incident between the nanny and Gabe, that hasn’t been in place, and he has been alone with Nahla. “It will be up to the judge to implement the recommendations. Gabriel is fighting having another person with him, he feels that Halle is trying to make his time with their daughter as uncomfortable as possible,” the insider says. “The report does recommend that Halle and Gabriel attend parenting classes together, so that they can co-parent Nahla more harmoniously. The classes will give them the tools to work through their issues, and hopefully become better parents for it.” Meanwhile, “Gabriel Aubry is unlikely to be charged with any crime in relation to the police report the nanny filed,” a law enforcement source revealed. Cheers??? According to TMZ reports : Social workers from the LA County Department of Children and Family Services will arrive at Mariah Carey’s house any moment to conduct a formal interview with the singer — after receiving an anonymous complaint that she drank a beer while breast feeding … TMZ has learned. DCFS launched the investigation after someone complained Mariah drank a Guinness in the hospital after giving birth to her twins about a month ago. We’re told DCFS social workers will ask Mariah about the widely reported incident and interview others in the house as well. The investigation is curious because hospital workers were closely monitoring Mariah and fully saw what was going on in her room. Sources tell us someone from the hospital told Mariah it would be beneficial to drink a dark beer — like a Guinness — to assist her in lactating. We’re told Mariah took the advice and drank a Guinness and in no way hid what she was doing from hospital staff — assuming it was fine to do. Several people connected with DCFS are privately critical of the agency for honing in on anonymous tips against celebrities … and devoting “extensive resources” when the agency should be looking at serious cases of abuse. How the hell you JUST have your babies and already find yourself in trouble with child services?!? You’re walkin’ a very fine line Mrs. Cannon, better lay off the sauce ma’am…

Before Dave Meyers stepped into Pink’s “Funhouse” video, he led Sophia Bush through the bloody terror of “The Hitcher.” There’s long been a connection between feature-length movies and music videos, and Lawrence and Meyers — both of whom are nominated for Best Direction at the 2010 MTV Video Music Awards — are just two of the folks who have worked in both mediums. Perhaps in the future, we might see Hype Williams, another of this year’s nominees, traveling from Jay-Z’s New York-centric “Empire State of Mind” to Tinseltown. Before the show goes live on Sunday, September 12, and we see which helmer triumphs, let’s take a look back at some of the most successful Hollywood directors who have won Best Direction at the MTV Video Music Awards. David Fincher Almost two decades before Fincher nabbed an Oscar nod for directing “The Curious Case of Benjamin Button,” he won the VMA directing award for Madonna’s “Express Yourself.” The next year he won again — this time for Madge’s “Vogue” — becoming the only director in MTV history to win Best Direction two years in a row. After collaborating with the Queen of Pop, Fincher went on to make his feature-film debut with “Alien 3” and then establish his own dark identity with the Brad Pitt-starring “Se7en.” His “Social Network,” a film about the founding of Facebook, is one of the fall’s most anticipated releases. Spike Jonze “Buddy Holly” begat “John Malkovich.” Jonze won his first Best Direction VMA for Weezer’s iconic “Happy Days”-inspired “Buddy Holly” video in 1995, then made his feature debut a few years later with the trippy “Being John Malkovich,” for which he received an Oscar nomination. Jonze has gone on to direct “Adaptation” and “Where the Wild Things Are,” which grossed over $100 million last year. Marc Webb Webb is the man whose job it is to rescue Spider-Man . Following the collapse of the Tobey Maguire-starring franchise earlier this year, Sony turned to Webb to reboot the boy wonder series. Last year, Green Day turned to the director to helm “21 Guns,” a somber take on their hard-charging tune. His feature debut, “(500) Days of Summer,” was nominated for two Golden Globes, including a Best Actor nod for Joseph Gordon-Levitt. Mark Romanek Romanek has directed videos for everyone from David Bowie to Janet Jackson, earning himself MTV’s Video Vanguard Award in 1997. Then in 2004, thanks to Jay-Z’s “99 Problems,” Romanek won his first Best Direction VMA. By then he’d already directed Robin Williams in the thriller “One Hour Photo.” His latest, “Never Let Me Go,” an adaptation of Kazuo Ishiguro’s creepily elegant novel, starring Keira Knightley and Carey Mulligan, premiered at the Telluride Film Festival last week. Jake Scott The images of sullen drivers stuck in an endless traffic jam set to the mournful sounds of R.E.M.’s “Everybody Hurts” are among the most indelible of ’90s-era music videos. Scott is the guy behind that vid, for which he won Best Direction. He’s also the guy behind Kristen Stewart’s upcoming drama “Welcome to the Rileys,” a troubling take on a runaway-turned-New Orleans stripper. Jonathan Dayton and Valerie Faris There hardly seems to be a connection between the Red Hot Chili Peppers’ 3-D gaming-style video for “Californication” and the Steve Carell-starring dark comedy “Little Miss Sunshine” … except that Dayton and Faris directed them both. The video won them Best Direction in 2000 and the movie was honored with four Oscar nominations in 2007, winning Best Original Screenplay and Best Supporting Actor for Alan Arkin. Samuel Bayer Bayer will forever be part of music history for directing Nirvana’s “Smells Like Teen Spirit” video. But he didn’t win his first Best Direction VMA until 2005, when he helmed Green Day’s “Boulevard of Broken Dreams.” He won his second direction Moonman two year later, thanks to Justin Timberlake and “What Goes Around.” This past spring, he resurrected the “Nightmare on Elm Street” franchise, guiding the horror flick to an impressive $32.9 million opening. The 27th annual MTV Video Music Awards will be broadcast live from the Nokia Theatre in Los Angeles on Sunday. The party starts with MTV News’ VMA Pre-Show at 8 p.m., followed by the main event at 9 p.m. ET. Britney Spears Responds To Sexual Harassment Suit

Statement on Spears’ website claims bodyguard is trying to ‘make a name for himself.’ By Kyle Anderson Britney Spears Photo: Christopher Polk/ Getty Images On Wednesday, a bodyguard named Fernando Flores, formerly in the employ of Britney Spears, filed a lawsuit against the singer alleging that she not only sexually harassed him but also abused her two young sons Sean Preston and Jayden James. Eager to clear the air, Spears responded to the suit and the allegations today via her official website . “This lawsuit is another unfortunate situation where someone is trying to take advantage of the Spears family and make a name for himself,” the post reads. “The Department of Children and Family Services conducted a proper investigation surrounding Mr. Flores’ accusations and have closed the case without any further action. Ms. Spears and her attorneys have every expectation that this matter will be dismissed by the courts.” Prior to the formal lawsuit (which was filed in Los Angeles Superior Court on Wednesday), Flores had previously filed a complaint with the Department of Children and Family Services that accused Spears of physically abusing her two young sons in the bodyguard’s presence, including one incident where she supposedly struck one of them with a belt. Kevin Federline, Spears’ ex-husband and father to both Sean Preston and Jayden James, also denied the child abuse accusations put forth by Flores. Through his attorney, Federline declared the allegations “baseless,” according to The Associated Press. Spears — who at one point lost custody of her two kids — now shares joint custody with Federline. Flores, who claims Spears would often expose herself to him and engage in sexual acts while in his presence, is seeking damages for the alleged sexual harassment. Violet Kowal Claims Possession of Mel Gibson Text Messages, Says He Wanted Her to "Disappear"

It looks like Oksana Grigorieva may not have been the only Mel Gibson mistress to receive incriminating text messages from the insane actor in January. Violet Kowal, who claims to have been Gibson’s mistress while he was nailing Oksana (he is still technically married to wife Robyn), says he texted her too. The significance of said text messages? Kowal, an alleged Polish porn star, says she was told by Mel’s bodyguard to keep her mouth shut about the January 6 altercation between Oksana and Mel. This is according to sources who have been in touch with Violet Kowal, who claims she was communicating with Gibson about that very fight with Oksana. In the days following – January 7-9 – Kowal claims she was contacted by one of Mel’s bodyguards, telling her she wasn’t allowed to discuss the incident. Moreover, he suggested she “disappear” for a price. Kowal, who recently lawyered up (she is repped by Gloria Allred, of course) has phone records and text messages from Mel to prove all of this happened. Also, Kowal claims to have an email she received recently from the L.A. County Department of Children and Family Services, the Sensitive Case Unit. That office informed her they wanted to speak with her, presumably in regard to Mel and Oksana’s custody fight over eight-month-old daughter Lucia. Kowal has not met with DCFS … yet.

BP ‘cuts payments to 40,000′ over incomplete claims forms

BP plans to reduce payments to some 40,000 oil-spill claimants, potentially making life more difficult for individuals and businesses affected by the Gulf oil spill, a Louisiana official has said. The Associated Press reports that Louisiana's secretary for children and family services, Kristy Nichols, found “a significant cut in daily payments” during a recent review of claims against BP, which appears to be related to incomplete forms. Britney Spears is the subject of a new investigation following a former bodyguard’s alleging that she abused her two sons, Sean Preston and Jayden James. However, inside sources say that the troubled pop star and her management are not concerned over the claims made by Fernando Flores in the UK’s Sun . Flores says he told investigators that Spears beat one of her sons with a belt and fed them food they were allergic to which in turn made them violently ill. He also claimed he had no choice but to resign from the job as a result of her “erratic” behavior (he said he was subject to Britney Spears nude come-ons). Team BS says the child abuse allegations are … well, BS. “(Flores’ claims) are simply not true,” says a Spears source. “There are always people around Britney, nannies and such. She is never alone with the boys .” “She would never have the opportunity to do something like that. She’s very loving of the kids. Neither she nor [manager] Larry Rudolph, are worried.” Another source, who previously worked with the starlet, agreed that Britney Spears is the target of a bitter former employee upset by the loss of his job. “Britney may have been a little out of control sometimes but never would harm her babies, never in a million years would she hurt them,” said the insider. Although the Department of Children and Family Services were regulars at Britney’s home years ago, she is now “totally clean” with the department. Also, as of Wednesday, they were unaware of Flores’ request for investigation into the matter, despite the former bodyguard’s claim that he told them. Suspect as Britney Spears’ parenting skills are, it’s hard to give this credibility. Instead, let’s focus on happier topics, like her new Candie’s clothing line !
