Decriminalizing HIV: Governor Of California Lowers The Penalty For Exposing Partners To HIV

Mario Tama/Getty Images Jerry Brown Signs New HIV Legislation Starting January 1, 2018, it will no longer be a major crime in California to knowingly expose a sexual partner to HIV without disclosing the infection. Governor Jerry Brown signed legislation on Friday that lowers the offense from a felony to a misdemeanor. The California legislature passed SB 239 on September 11. The law previously punished people who knowingly exposed or infected others with HIV by up to eight years in prison, but this new legislation will lower jail time to a maximum of six months. The new law also reduces the penalty for knowingly donating HIV-infected blood from a felony to a misdemeanor. Bill sponsors Sen. Scott Wiener and Assemblyman Todd Gloria, both Democrats, argued California law was outdated and stigmatized people living with HIV, especially given recent advancements in medicine. Evidence has shown that a person with HIV who undergoes regular treatment has a negligible chance of spreading the infection to others through sexual contact. “The most effective way to reduce HIV infections is to destigmatize HIV,” Wiener told CNN. “To make people comfortable talking about their infection, get tested, get into treatment.” Because the previous law. Wiener said by destigmatizing HIV, the bill would encourage people to get tested, which will in turn lower HIV transmission in the state.

According to NBC Sports: Dallas Cowboys practice-squad linebacker Jerry Brown was killed in a one-car accident Saturday and teammate Josh Brent was charged with intoxication manslaughter. Irving police spokesman John Argumaniz said the accident happened about 2:20 a.m. Saturday in the Dallas suburb. Brent was speeding when the vehicle hit a curb and flipped at least once, Argumaniz said. Argumaniz said the 25-year-old Brown – also Brent’s teammate at the University of Illinois for three seasons – was found unresponsive at the scene and pronounced dead at a hospital. The police spokesman said officers conducted a field sobriety test on Brent and arrested him. The charge was upgraded after Brown was pronounced dead. “We are deeply saddened by the news of this accident and the passing of Jerry Brown,” Cowboys owner Jerry Jones said in a statement. “At this time, our hearts and prayers and deepest sympathies are with the members of Jerry’s family and all of those who knew him and loved him.” The team said in a statement that Brent was not on the team flight to Cincinnati, where the Cowboys play the Bengals on Sunday. Argumaniz said Brent was being held without bond. Brent is named as Joshua Price-Brent in the police news release. Argumaniz also said Brent missed a 10 a.m. Saturday booking session with a judge because he was intoxicated. He did not know if Brent had an attorney. The Cowboys signed Brown to their practice squad Oct. 24, but he hasn’t been on the active roster. He was released from the Indianapolis Colts’ practice squad Oct. 20. “On behalf of the entire Colts family, our sincerest condolences go out to Jerry’s family and friends, Colts general manager Ryan Grigson said in a statement. “He was a good teammate that was well liked by all. Today’s tragic news is just another reminder of how fragile life is and how everyday given is a gift.” Brown played for San Antonio in the Arena Football League this year. In 2011, he played for Jacksonville in the AFL and the Hamilton Tiger-Cats in the Canadian Football League. Wow. Extremely sad. R.I.P.

You know it's a bad sign when the outgoing California governor announces a fiscal emergency and everyone ignores him. Now incoming governor Jerry Brown has realized how screwed the state is and he's announcing his own budget emergency, according to the LAT. He said last night: “I'm going to try to get the budget agreements done within about 60 days. I don't think we have a lot of time to waste… It will be a very tough budget, but it will be transparent… We've been living in fantasy land. It is much worse than I thought. I'm shocked.” Hear that, last year's $20 billion budget cuts amounted to living in fantasy land. Brown implied he would apply major cuts to the education system and other programs.
