Michigan Gay Marriage Ban Struck Down By Judge; State Now 18th to Allow Same-Sex Weddings

A federal judge Friday struck down Michigan’s ban on gay marriage. As such, the state becomes the 18th in the nation to allow gays and lesbians to join in legal matrimony just like their heterosexual counterparts. Michigan Attorney General Bill Schuette immediately filed for an emergency request for a stay of the ruling in the late afternoon Friday. Schuette said that “Michigan voters enshrined that decision in our state constitution, and their will should stand and be respected.” “In 2004 the citizens of Michigan recognized that diversity in parenting is best for kids and families because moms and dads are not interchangeable.” It’s unclear if that stay will be granted. In his 31-page ruling, U.S. District Judge Bernard Friedman heavily criticized the state’s position that the will of the voters should have been upheld. “In attempting to define this case as a challenge to ‘the will of the people,’ state defendants lost sight of what this case is truly about: people,” Friedman wrote . “No court record of this proceeding could ever fully convey the personal sacrifice of these two plaintiffs,” the judge went on. “[They] seek to ensure that the state may no longer impair the rights of their children and the thousands of others now being raised by same-sex couples.” Two Hazel Park, Mich., nurses, April DeBoer and Jayne Rowse, filed their lawsuit in January 2012, saying Michigan has no rational basis for denying them the right. The women have been partners for eight years. “It’s just amazing,” said DeBoer, who wiped away tears and hugged Rowse after learning of Friedman’s ruling. “This is what we’ve wanted for our family and families like ours.” “We got our day in court, and we won.” Friedman did not follow the trend of other federal judges handling similar cases across the country because he did not stay his ruling pending appeal. Unlike most federal judges who have taken up the gay-marriage issue, Friedman opted last fall to hold a trial and give both sides a chance to present their arguments. Friedman’s ruling came two weeks after the trial.

Aaron Hernandez Denied Bail, Charged With Murder And 5 Gun-Related Charges According to TMZ reports : NFL star and murder suspect Aaron Hernandez has just been denied bail … meaning he’ll rot behind bars until his trial … and that could take forever. Hernandez was present in court today for a bail review hearing, where his lawyer begged the judge to release Hernandez from custody while he awaits trial. But the judge wasn’t moved by his arguments — that Hernandez is an upstanding citizen and family man with no flight risk — claiming the prosecution already had very strong evidence that Hernandez had committed the crime. As for the evidence … the prosecutor went through the entire timeline leading up to the murder of Odin Lloyd earlier this month, including matching shell casings found at the murder scene and inside Hernandez’ rental car. He also mentioned the photo TMZ posted last night — showing Hernandez brandishing a glock in the mirror 4 years ago — claiming it’s possible the murder weapon was also a glock. The prosecutor said they’d be seeking the max sentence for Hernandez … life without parole. Hernandez’ fiancee — who was also present in court — was inconsolable when the judge issued her decision to keep the NFL star behind bars. As we reported, Hernandez was remanded into custody yesterday following his arraignment and was ordered to be held WITHOUT bail. Hernandez has been charged with murder in the death of 27-year-old Odin Lloyd. He’s also been hit with 5 gun-related charges. It could be months — even a year — before Hernandez gets his trial. Welp, there you have it. Peace, playa, it’s been real.

The thickummms in Mississippi said ‘miss us with that slimmy trimmy bs’ and have passed a bill to keep restaurants from forcing them to be more healthy. Via NYDailyNews reports : Lawmakers in Mississippi — the most obese state in the nation — have overwhelmingly approved what they’re calling the “anti-Bloomberg bill.” It would ban communities from requiring restaurants to post calorie counts on menus or limit portion sizes, as Mayor Bloomberg tried to do with his proposed ban on large sodas. Also forbidden: any local rule banning toys from being distributed with kids’ meals. The governor is expected to sign it. Its author, state Sen. Tony Smith, owner of the Stonewall’s BBQ chain, which serves dishes like the Lil’ Piggy, said government has no business telling people what they cannot eat. “If we give government a little more control of our personal rights – where does it stop?” he said. Smith told the Daily News that Bloomberg‘s proposed ban on large sugary sodas in New York helped give impetus to his legislation. He said Bloomberg’s rule – which was written to attack obesity – doesn’t make sense. If customers “want to supersize, they’re going to figure out how to do it, whether that means buying two or whatever,” said Smith, whose restaurants only service sodas 20-ounces at a time, a serving size that Bloomberg‘s ban would outlaw. Smith‘s bill – which says nutritional requirements should only be decided at the state level – sailed through the Mississippi legislature with broad bipartisan support, overwhelming the arguments of a small group of opponents who said that local governments should be allowed to make their own rules. Smith said Mississippians trust the market to respond to demands for healthy food. “For a lady, if all you can buy are black shoes, well, that doesn’t go with every dress you may have,” he said. “Hey, if you want to buy baked fish, fine, I love it. But if I want fried fish, that’s my right.” SMH. Leave it to Mississippi — the state where ignorance is always bliss. Pro-Dorner Protestors Gather Outside LAPD Headquarters

A handful of protestors took to the streets outside LAPD headquarters in California yesterday, showing support not so much for the actions of Christopher Dorner, but for the arguments he made against the department. Dorner died on Tuesday of what authorities now say was a self-inflicted gun shot after he was cornered in a cabin in Big Bear, CA. He had been the subject of a massive manhunt following the alleged killing of at least three people, a rampage he claimed on Facebook was tied to his dismissal from the police force in 2009. The protestors say they do not condone Dorner’s killings, but do take issue with how the manhunt was handled, especially how police accidentally shot at two different trucks they believed to be Dorner’s. One woman hit in those incidents is still recovering. “How the police handled this — they were the judge, the jury and the executioner,” a protestor named Michael Nam told The Los Angeles Times . “As an American citizen, you have the right to a trial and due process by law.” The protestors also were rallying against corruption and racism in the LAPD, as the event was organized on Facebook, along with an announcement to keep it “peaceful” and the missive: “This is not a page about supporting the killing of innocent people. It’s supporting fighting back against corrupt cops and bringing to light what they do.”

Shaking It For Uncle Sam? NY Court To Decide If Dancing For Dollars Qualifies For Tax Exempt Status At Gentleman’s Club

Who knew there was a tax loophole for lap dances ? They may never be confused with “Swan Lake,” but an upstate New York gentleman’s club says its in the buff lap dances are every bit as much an art form and should be exempt from state taxes. So far, the state tax department and an appeals court disagree and want the Nite Moves club in Albany to pay up $124,000 it says it owes taxes. New York’s highest court gets a shot at the arguments Wednesday when the two sides face off at the Court of Appeals. Tax officials say sales taxes were paid on the club’s nonalcoholic drinks, but are also owed on admission and so-called “couch sales,” where patrons pay for private or lap dances. Nite Moves claims the dances are exempt under state tax law as “live dramatic or musical arts performances.” The exemption also applies to theater or ballet. The club is relying on testimony from a cultural anthropologist who has studied exotic dance and visited Nite Moves. W. Andrew McCullough, an attorney for Nite Moves, said the impact of the eventual court ruling probably won’t be widespread because most establishments featuring freaky dancers sell alcohol where other tax rules apply. An administrative law judge previously agreed with Nite Moves, saying that “the fact that the dancers remove all or part of their costume … simply does not render such dance routines as something less than choreographed performances.” But the state Tax Appeals Tribunal said the club didn’t present sufficient proof that it qualifies for the exemption, and a mid-level court upheld the tribunal ruling last year. “In our view, there can be no serious question that — at a bare minimum — petitioner failed to meet its burden of establishing that the private dances offered at its club were choreographed performances,” the Appellate Division court ruled. The four justices also found “no merit” to the club’s constitutional claims. The appellate court also noted that the club dancers are not required to have any formal dance training and that the anthropologist didn’t see any of the dances done in private rooms. Cary Ziter, a spokesman for the state Department of Taxation and Finance, said the agency is not aware of any other cases in state court similar to the Nite Moves case. He said the tax department doesn’t know how many so-called gentlemen’s clubs operate in New York. Angelina Spencer, executive director of the Association of Club Executives, told CNN recently there are about 4,000 adult nightclubs in the U.S. The top court typically takes about a month to issue a decision. Jennifer Hudson May Testify At Family Murder Trial

Jury selection continues in the murder trial of William Balfour. By Gil Kaufman Jennifer Hudson Photo: Jeffrey Mayer/ WireImage Jury selection continued on Monday (April 9) in the trial of William Balfour, who is accused of murdering three members of Oscar-winning singer Jennifer Hudson ‘s family. It is expected to take three days to find the 12 jurors and six alternates for the trial from among the 150 prospective jury members and, according to the Chicago Tribune, the shadow of Hudson’s fame could become a factor in the selection. Balfour 
 is accused of murdering Hudson’s mother (Darnell Donerson), brother (Jason Hudson) and nephew (Julian King) on October 24, 2008 and while the singer has rarely spoken out in public about the tragedy, her fame could have an impact on the proceedings. The judge in the case, Charles Burns, will attempt to purge the jury pool anyone who might be swayed by the star’s celebrity, while the lawyers on each side will strive to find a mix of deliberators who will favor their arguments, regardless of how they feel about the star. Balfour, 30, is facing a maximum life sentence if convicted, but Burns warned any would-be jurors who oppose the death penalty that he cannot be put to death because the state of Illinois outlawed capital punishment in 2011. Testimony is slated to begin on April 23 and officials expect Hudson to attend every day of the trial, which could last a month. She is also on a list of 300 potential witnesses, though it has not yet been confirmed that she will take the stand. Burns also instructed the potential jurors to avoid watching news coverage of the case, though it’s possible they will see Hudson on TV this Thursday, when she will return to sing on “American Idol,” where she finished in seventh place in 2004. Everyone involved in the case is aware of how Hudson’s presence could sway the trial, which explains why nine out of the 66 questions on the questionnaire filled out by would-be jurors last week were related to her career. Among them was one that asked if they’d ever seen her Oscar-winning turn in the movie “Dreamgirls,” as well as others about her work on television and if they’d ever read books by or about Hudson. Details emerged recently about the incidents leading up to the murders 
. At the time her career was peaking, Hudson made a point of calling or texting her mother at home in Chicago every day between 9 and 11 a.m., according to reports. But when she didn’t hear back by late in the morning of October 24, she texted and realized something was wrong when there was no response. A few hours later, the bodies of her mother and brother were found in the family’s Englewood home, followed three days later by the discovery of her young nephew’s body in a stolen vehicle abandoned on the city’s west side. Zuccotti Park Reopens To Occupy Wall Street Protesters

Nearly two months from the inaugural protest date, NYPD officers moved into the lower Manhattan park, forcing out protesters as cleaning crews moved in. New York City Mayor Michael Bloomberg addressed the matter on his website and assured that the move was only temporary. “Protesters have had two months to occupy the park with tents and sleeping bags. Now they will have to occupy the space with the power of their arguments.” Patrick Macleod, a member of the Occupy movement who arrived on site shortly after the police had cleared out the space, reported several skirmishes and use of tear gas by police in the early morning confrontation. It felt like we waited the cops out, but they may have just been teasing us or something.” After dispersing, the Occupy Wall Street website called for an assembly on nearby Canal Street. Around 10 a.m., hundreds of protesters returned to march around the still-police-occupied, privately owned park, claiming their right to occupy the space. On site, MTV News witnessed a few arrests of protesters who tampered with barricades or tried to invade the park; they were forcibly removed by police. “Earlier today, the Supreme Court of New York said they put a temporary injunction saying that we could go back into the park. Zuccotti Park Cleared By Police

Without warning, the New York Police Department swooped down early Tuesday (November 15) morning on the protester camp in the city park and ordered its residents to clear out or face arrest. The squatters, who had occupied the park since September 17 in a protest against economic inequality in the U.S. that helped spark a national and international movement, were told that the camp was to be “cleared and restored” by morning and that they could return at a later time. According to The New York Times the 200 protesters who remained in Zuccotti (which they’d renamed “Freedom Park”) initially resisted the police action and met officers with chants of “whose park? Our park!” But as police moved in and began tearing down tents and removing the encampment, the occupiers retreated to a central area and tried to barricade themselves behind tables and scraps of wood. The effort to clear out the public park in began around 1 a.m. and though dozens of occupiers left over the next few hours, a number refused, locking arms and ignoring police orders to evacuate. Two hours into the action helmeted officers moved in and pulled the remaining squatters out one-by-one and handcuffed them, with more than 70 arrested in the action. Mayor Michael Bloomberg’s office Tweeted about the removal around 1:19 a.m., saying, “Occupants of Zuccotti should temporarily leave and remove tents and tarps. Protesters can return after the park is cleared.” Bloomberg, who was scheduled to discuss the action on Tuesday morning, later issued a statement explaining the action. “I have become increasingly concerned — as had the park’s owner, Brookfield Properties — that the occupation was coming to pose a health and fire safety hazard to the protestors and to the surrounding community,” Bloomberg said. “We have been in constant contact with Brookfield and yesterday they requested that the City assist it in enforcing the no sleeping and camping rules in the park. But make no mistake — the final decision to act was mine.” Even as Bloomberg ordered the park cleared, he noted that protesters would still be able to gather there, but would be banned from setting up tents and sleeping bags. Residents of the area and workers who travel through the perimeter of the park have been complaining for weeks that the occupation has interrupted their lives due to noise, congestion and the barricading of sidewalks. “Protestors have had two months to occupy the park with tents and sleeping bags,” Bloomberg said. “Now they will have to occupy the space with the power of their arguments.” In addition to international headlines, the protests drew the attention of a number of celebrities who came down to the camp to visit and get a glimpse at the movement. Among the artists who made their way to Zuccotti over the past few months are Talib Kweli and Kanye West, Lupe Fiasco, Susan Sarandon, Tom Morello, folk icon Pete Seeger, actor Mark Ruffalo, film maker Michael Moore, Joan Baez, Jay-Z , Katy Perry, Russell Brand and Russell Simmons. The move in New York comes as other cities have begun cracking down on Occupy protesters, with police in Oakland , Salt Lake City and Portland, Oregon forcefully taking action against the sit-ins. According to My Fox New York , some occupiers moved to another city park around 10 blocks north of Zuccotti on Tuesday morning, setting up shop in Foley Square. Brandi Glanville Charged With DUI

Brandi Glanville, the slightly unhinged ex-wife of Eddie Cibrian, was officially charged for an October DUI arrest , the L.A. County D.A.’s office reports. The model, whose husband cheated and left her for LeAnn Rimes in 2009, was pulled over on Sunset Boulevard Oct.29 and failed a field sobriety test. Brandi has been at odds with Eddie over LeAnn’s parenting (and everything else) since their split. This isn’t likely to bolster any of her arguments. Brandi Glanville may have lost her mind … and shirt . She has now been charged with two misdemeanors: driving under the influence of alcohol or drugs and driving with a blood alcohol level above .08 percent. If convicted, she faces up to six months in jail and a $1,000 fine. The embattled Brandi Glanville has two sons with Cibrian: Mason, 7, and Jake, 3. “I messed up. I take full responsibility for my actions,” she tweeted. “I regret my bad choice, and am thankful to God that no one got hurt. I’m sorry.”
