#EbonyOwes Saga Continues, Former Employees File 2nd Class Action Lawsuit For Their Dough

Source: WENN / WENN Iconic African-American magazine Ebony is back in the news after former employees accuse the publication of unpaid wages and fraud. According to The Root , the historic publication is once again headed back to court after former employees claimed that they were unpaid for work, laid off unfairly and that their 401k was not company-matched per the employment agreement. The complaint, which was filed on Wednesday (Sept. 25), names Ebony Media Operations LLC; CVG Group LLC; Michael Gibson, CVG Group co-founder and chairman; and Elizabeth Burnett, vice president of operations of CVG Group, as defendants and accuses them of “betraying the magazine’s employees and readers” by “engaging in a consistent pattern and practice of laying off their staff and failing to pay them their final wages.” Additionally, Ebony is accused of failing to reimburse employees for work-related expenses or pay out their unused vacation days. The lawsuit also alleges that Ebony committed fraud by failing to match 401k contributions, in addition to failing to reimburse employees for payroll deductions that were never actually invested into 401k accounts. The lawsuit comes just one week after Linda Johnson-Rice , daughter of the magazine’s founder decided to step down effective immediately from the magazine’s board claiming that the direction of the magazine did not go according to what she had envisioned. “When I agreed to continue on with the companies after the sale to the CVG Group, I did so hopeful that the Ebony and Jet brands would continue to be a dominant and positive force in the African American community,” Johnson Rice said in the email obtained by the Chicago Tribune . “Obviously, despite my hopes, the last three years did not result in what I envisioned when the transition occurred, and because of that, I have made the decision to move on.” Although the reasoning behind the resignation is unclear, what is clear is that the publication has been having staffing and legal issues since the company was bought by Texas investment group CVG in 2016. As previously reported, in 2017 freelancers and former employees started the viral hashtag #EbonyOwes before filing a lawsuit for unpaid wages. The employees were awarded nearly $80,000 in 2018 and Ebony laid off its entire digital staff before going on a print hiatus in the Spring of this year.

Fernanda Flores: Desperate for Cash After 90 Day Fiance, Divorce?

Last month, Fernanda Flores posted a 44-minute video to explain why she and Jonathan Rivera split. She made it clear that they’ve both moved on. Jonathan has himself a new girlfriend and has not been shy about their adventures together. But it turns out that Fernanda’s new venture may be a little less glamorous than the modeling career that many had assumed. Fernanda is a gorgeous young model living in Chicago, she’s newly divorced, and she even has a boost to her name thanks to 90 Day Fiance fame. The world is her oyster, right? Maybe not. Earlier this week, reports began to circulate that Fernanda was spotted waitressing in Chicago. While it’s true that many bartenders and waitresses are hired in part for their looks, it’s definitely not the same as being a model. Now, the tales of her employment have been confirmed. An eagle-eyed fan spotted Fernanda and was actually served by her at The Shore Club in Chicago. This was on July 4 — the day on which Fernanda posted a photo of herself in red and blue beside a massive beach ball. The fan contacted 90 Day Fiance blogger and unsung hero John Yates and even DMed him some photos, which he shared to Instagram. That looks like Fernanda to us. What’s more is that the fan even volunteered an assessment of what Fernanda was like. “I don’t think she was thrilled I was taking pictures,” the fan confesses to John Yates. “But I was drunk,” the fan explains. “And had to prove it to my friends.” For the record, taking photos of a public figure — like a reality star — is not the same as Alex From Target -ing someone. Still, please be respectful. The fan had nothing but nice things to say about Fernanda. “Even more gorgeous in person,” the fan assesses. “And was working her ass off!” Fernanda didn’t come to America for the American dream, strictly speaking. She came here for love. (People love to accuse her of being a golddigger, but even Jonathan has dismissed those accusations) She lost that love, and now she’s living … well, not the American dream, but the reality of American life. Being a waitress or a bartender or working in food services in any capacity is hard. Customers , as a group, are the worst people on earth. Anyone willing to look them in their soulless eyes and smile is courageous and a dedicated worker. Good for Fernanda for finding gainful employment, particularly in an economy in which one job is so rarely enough to keep you afloat. Her primary goal, we’re sure, is to be able to pay her bills and continue to live her life. That’s how jobs work. But this will also go a long way towards showing people that she didn’t come to the US to lounge around like a princess. We’re sure that she’s still modeling — she’s too gorgeous to not be modeling, really. But if she needs a steadier income to keep a roof over her head or to keep her bills paid, she chose a fine line of work. Congratulations on the new job, Fernanda. As previously reported Massey was subjected to racial profiling by two employees at a Portland, Oregon Doubletree for talking on the phone to his mother in the lobby. Jermaine posted a video of the incident on Instagram and said a man named Luis told him he was a “safety threat” to other guests and accused him of trespassing. The Portland Doubletree has since apologized to Jermaine…. We sincerely apologize to Mr. Massey for his treatment this past weekend, and deeply regret the experience he endured. It was unacceptable and contrary to our values, beliefs and how we seek to treat all people who visit our hotel. Jax Taylor Gets Paid More Than the Rest of the Vanderpump Cast Because In 2018, Cruelty and Idiocy Are Virtues

If you're a fan of the long-running Bravo series Vanderpump Rules , then there are certain facts that you've come to accept about the life among West Hollywood's drunkest band of extremely caucasian sociopaths: For example, despite claims to the contrary, it is all about the pasta. But the most salient and inarguable truth about Lisa Vanderpump's ragged band of aging hedonists is that Jax Taylor is the most repugnant villain this side of The Situation circa 2010. Jax cheats on his fiancee , lies like it's his job (which we guess it sort of is), heaps abuse on his friends and former co-workers, then throws himself pity parties on the rare occasion that someone actually calls him out for being horrible. Of course, this is the kind of stuff that makes the world of reality television go 'round, so perhaps it should come as no surprise that Jax gets paid more than his co-stars. Take a look: 1. Stacks For Jax Obviously, at this point, it’s hilarious that the cast occasionally pretends to be reliant on the meager paychecks that they receive from serving and bartending at Lisa Vanderpump’s Sexy Unique Restaurant. (That name will never not be hilarious.) 2. The Grand Charade The show’s not even fully committed to that bit, as cast members get fired by Lisa and don’t even pretend to seek out other employment. 3. Slow Climb These days, the entire cast is sitting pretty from a financial standpoint, but it took them quite a few years to get to where they are. 4. Started From the Bottom In the early days, the cast wasn’t pretending to be poor. 5. That’s Like a Month’s Rent in LA A lawsuit that Tom Sandoval filed against his former talent agency revealed that the bartender made just $12,000 from the show’s first season. 6. Getting Somewhere … The same suit revealed that Sandoval brought home $25,600 for Vanderpump Season 2. A major raise, but still not that much cash. View Slideshow

Justin Bieber Shaves Off All His Hair for Some Reason

Justin Bieber is sporting a scary new haircut — just in time for Halloween! That’s right — he’s no longer sporting that long, dirty blond hair. Instead, he’s shaved his head. The results are, honestly, a little jarring. We hope Justin’s wife likes it. Take a look: Like we said, this boy went and shaved off all of his hair. Justin shared this selfie to his Instagram Stories. We don’t know what brought this on — perhaps some impulse. We also don’t know why he distorted the image from the selfie so heavily. (Are clearly visible photos boring, now?) It’s a pretty radical change from how his hair has looked earlier this year. In fact, back in May, Justin gleefully showed off his hair. “Long hair don’t care,” he told his followers on Instagram. “And my stash is gorgeous.” He meant to write “stache,” but we’ve all made typos, especially on social media. While his creepy mustache made him look like someone you’d cross the street to avoid, his hair could have looked nice. “I’m going to grow my hair down to my toes,” Justin wrote at one point on Instagram. It seems that his plans have changed. Justin didn’t really seem to do anything to style his hair. (Some openly wondered if he even showered on a daily basis, because his hair often looked … not so good) While women — especially celebrity women — are often expected to maintain their appearance, men are often given a free pass. Justin may find long hair to be a pain to maintain. He clearly didn’t want to put in the work. Since he’s already a celebrity — and he’s married — maybe he decided that looking good isn’t worth the effort. We guess that he can just rely upon his torso to catch people’s attention instead of his hair. Oh, wait, Justin plastered his torso with 100 hours of tattoos . Well, he still has a good shape. And, like we said, maybe he truly stopped caring about his looks because he’s married. That’s a shame, because Hailey is a model and you know that she’s going to keep putting effort into her own appearance — including her hair. This is probably just a taste of the impulsive decisions that Hailey is going to have to grin and bear. Just a few weeks ago, Justin and Hailey stopped by a salon and got their hair trimmed together. We guess that Justin isn’t up for repeating that experience. This is not the first time that he’s shocked fans by mowing off his mane. Back in 2016, Justin shaved his head. At the time, he had turned his then-platinum hair into controversial dreadlocks. (Some celebrities are so far in the bubble that they’ve never heard of cultural appropriation) Sometimes, celebrities find it freeing to cut their hair dramatically. Those stars are usually women, who are told by managers and by media that their hair needs to be styled in certain ways. We’re not sure that Justin was carrying out some grand act of rebellion. But at the end of the day, it’s his hair and hsi body and he can do whatever he likes to it. That said, you can still have an opinion about his new look. Some people will even like it. David Eason Attacks Kailyn Lowry on Instagram, Gets Absolutely Roasted In Response

David Eason is the type of person that we don't see in the public eye very much. He's an emasculated, unemployed bigot with nothing better to do but spend his wife's money and attempt to stir up fights on social media in hopes of distracting himself from his own uselessness. Generally, guys like David can only be found attempting to cadge free drinks at their local dive bars or cutting eyeholes in bedsheets in preparation for a late night “rally.” But David married Jenelle Evans , which means he actually has an audience for his loser-y online ramblings. Unfortunately for David, that audience really just wishes he would stick to flat-ironing his beard hair in his rapidly sinking house. Take a look: 1. Dipsh-t Dave It’s impossible to overstate how bored Eason is. These days, the 30-year-old spends most of his time on social media spewing bigotry and attempting to stir up fights with people who still have jobs. 2. Any Target Will Do Whether he’s spewing bizarre conspiracies about the “true” causes of the Civil War or simply attacking the appearances of his former co-stars, Dave has proven himself to be the ultimate snowflake. 3. Rage-aholic He’s addicted to his own outrage, and he needs conflict to distract him from the sad state of his own life. 4. Small Potatoes David LOVES stirring the pot with fans by making bizarre claims such as the slaves of the antebellum South were not actually from Africa, but he recognizes that fighting with non-celebs will only earn him so much attention. 5. Enter Kail And so, he occasionally focuses his attention on more famous targets, such as his wife’s Teen Mom 2 co-star, David Eason. 6. Why Kail? David might can justify his recent dislike for Lowry in a number of different ways, and if pressed, he would probably claim that it’s all because Lowry has feuded with Jenelle over the years. Megyn Kelly: I’ll Spill All the Tea on NBC, Unless…

Megyn Kelly is off the air. But she is not yet out of the building. Not yet, at least. Not officially, that is. The embattled reported is no longer appearing on NBC, as we’re sure most of our readers know quite well by now. She has been relieved of her duties as host of Megyn Kelly Today after anchoring a segment about controversial Halloween costumes… … which somehow devolved into Kelly wondering why blackface is considered racist . Despite a written apology and an on-air apology the day after this segment aired, Kelly was essentially fired by NBC not long after her initial comments went public and severe backlash quickly followed. However, while Kelly has no job to attend to this morning, she is still technically a network employee. The star and her legal team continue to negotiate a buyout, with many sources indicating that Kelly will be paid about $38 million to walk away. This is the approximate amount remaining on her contract. Now, though, TMZ cites another obstacle on the path to the full dissolution of this partnership. Insiders tell the website that NBC wants Kelly to sign a confidentiality agreement. This is standard operating procedure for this sort of situation — and executives are especially afraid of what Kelly might tell the world after she parts ways because she was unafraid to air NBC’s dirty laundry even while working for the company. Remember: Kelly interviewed one of Matt Lauer’s alleged sexual assault victims last year. She has also admitted that she knows about all of Lauer’s skeletons , which likely means she also has dirt of some higher-ups who may have covered up for these skeletons over the years. It makes sense for NBC to try and make sure Kelly cannot spill such damaging tea to the world after she signs a new deal with Fox News or whomever. Kelly’s lawyer, meanwhile, says his client is happy to sign this sort of nondisclosure agreement. For an additional $10 million. It’s also worth noting that Kelly wrote a book, “Settle for More,” in which she targeted Fox News Channel; and she has been very critical of that cable network since her departure in 2016. It’s certainly not beneath her to attempt to damage NBC after she settles her employment with the organization. The Today Show, for its part, is trying to move on. On Monday, Al Roker, Hoda Kotb and Craig Melvin greeted viewers during Kelly’s former timeslot, with Kotb opening the hour by saying : Today, as you know, we are starting a new chapter in the third hour of our show as it evolves. We want you to know that the entire TODAY family will continue to bring you informative and important stories, just as we always have. That’s great and all. Farrah Abraham Sues Viacom for Teen Mom OG Firing!

Before we get started, let’s take a moment to reflect on Farrah Abraham and the many, many hate crimes she’s endured these past few months. Let’s consider how hard it’s been for her, and how the things she’s been going through have definitely, without a doubt been hate crimes. … Are we good now? Yes, so our beloved Farrah has been in a bit of a tailspin since October, when she was fired from Teen Mom OG . It’s taken a while to get the full story, mostly because for the first couple of months after it happened Farrah had been the only one telling the story. And as you may have noticed, she’s not the most reliable narrator. And also she has a hard time with words and figuring out how they work. To hear her tell it, she was fired because of her work in the sex industry, and to be fired for such a reason was literally a hate crime . She was sex-shamed by Teen Mom producers, she and her family had been manipulated for years into ruining their lives for good storylines. She had a lot of accusations. As it turns out, the powers that be didn’t love all the porn stuff, but another very big issue was the way Farrah treated crew members. Because she honestly treated them like absolute garbage . There was a little confusion over whether or not she was actually fired though — MTV owns the show, obviously but a separate production company films it, and they were the ones who did the firing. But regardless, she hasn’t been filming, and it seems like she’s really and truly done with Teen Mom. Well, she’s done being on Teen Mom — she still has some loose ends to tie up, though. Yesterday, Farrah marched down to the courthouse and filed herself a lawsuit against Viacom, Teen Mom’s production company, and Teen Mom executive producer Morgan J. Freeman. Why? According to the documents, she’s suing “to hold defendants responsible for (1) harassing her because she did not conform to gender stereotypes; (2) wrongfully terminating her employment because she did not conform to gender stereotypes; and (3) terminating her employment in retaliation for complaining about the gender-stereotyping harassment she suffered.” It’s already amazing, right?! She also suing for “breach of contract, conversion, unjust enrichment, negligence, negligent hiring, retention, and/or supervision, tortious interference with business relations, defamation, and intentional infliction of emotional distress.” Now, we’re no lawyers, but you don’t really have to be a lawyer to see that she’s really just going for it with all of this. The documents also state that on the day she was fired, the production crew “harassed, humiliated, discriminated against, disrespected, ridiculed, degraded, and sex shamed” her for working in adult entertainment. She also claims here that Freeman threatened to sabotage any other deals she’d ever make with MTV, and that “given Freeman’s hostile tone, mannerisms, and body language,” she actually “feared for her life.” See what we mean about how she’s going for it? Farrah and her lawyers are suing for “emotional pain, emotional suffering, inconvenience, mental anguish, loss of enjoyment of life,” and the rest of the money she was supposed to earn for this season according to her contract. She’s suing for $5 million. Five million actual dollars. Actually, she’s asking for “an amount to be determined at trial but exceeding $5,000,000,” as well as her lawyer’s fees, so it’s even more ridiculous than that. There’s absolutely no doubt Viacom has an amazing team of lawyers, but there’s also no doubt that Farrah has zero sense and would keep pushing this until she bankrupts herself. Him Too? Tavis Smiley Suspended For Sexual Harassment Claims

According to Variety , PBS put out the following statement about the situation: “Effective today, PBS has indefinitely suspended distribution of ‘Tavis Smiley,’ produced by TS Media, an independent production company,” the public broadcaster said. “PBS engaged an outside law firm to conduct an investigation immediately after learning of troubling allegations regarding Mr. Smiley. This investigation included interviews with witnesses as well as with Mr. Smiley. The inquiry uncovered multiple, credible allegations of conduct that is inconsistent with the values and standards of PBS, and the totality of this information led to today’s decision.” Sources told Variety that the law firm in charge of the investigation took reports from 10 witnesses, a diverse men and women from different races and employment levels within Smiley’s organization. However, most of them former staffers. But what PBS found was eye-opening and they believe the following accounts are credible: Smiley engaged in sexual relationships with multiple employees who worked underneath him. Some witnesses interviewed expressed concern that their employment status was linked to the status of a sexual relationship with Smiley. In addition, witnesses described Smiley as creating a verbally abusive and threatening environment that went beyond what could be expected in a typical high-pressure work environment. Several expressed concerns about retaliation if they came forward or reported his behavior to higher ups. Of course, Smiley is denying all of these allegations. In a video he posted on social media on Wednesday night, he stressed that he respects women and he has never coerced them into sex. To be clear, I have never groped, coerced, or exposed myself inappropriately to any workplace colleague in my entire broadcast career, covering 6 networks over 30 years.” Smiley added, “If having a consensual relationship with a colleague years ago is the stuff that leads to this kind of public humiliation and personal destruction, heaven help us. The PBS investigators refused to review any of my personal documentation, refused to provide me the names of any accusers, refused to speak to my current staff, and refused to provide me any semblance of due process to defend myself against allegations from unknown sources. Their mind was made up. Almost immediately following the meeting, this story broke in Variety as an “exclusive.” Indeed, I learned more about these allegations reading the Variety story than the PBS investigator shared with me, the accused, in our 3 hour face to face meeting. My attorneys were sent a formal letter invoking a contractual provision to not distribute my programming, and that was it. Put simply, PBS overreacted and conducted a biased and sloppy investigation, which led to a rush to judgment, and trampling on a reputation that I have spent an entire lifetime trying to establish. This has gone too far. And, I, for one, intend to fight back. It’s time for a real conversation in America, so men and women know how to engage in the workplace. It is believed she was without oxygen for quite some time.  Sources say Bobbi was revived and rushed to North Fulton Hospital where she was stabilized, but was able to breathe only with the help of a ventilator with very little brain activity. But things took a turn for the worse when Bobbi was placed in a medically-induced coma. Her condition was described as “significantly diminished,” and tragically, only worsened from there. In April, Cissy Houston told the press that her granddaughter had “ global and irreversible brain damage .” On June 24, 2015 Pat Houston said the family would be moving her to hospice care. “Despite the great medical care at numerous facilities, Bobbi Kristina Brown’s condition has continued to deteriorate,” Houston said in a statement to the press. “As of today, she has been moved into hospice care. We thank everyone for their support and prayers. She is in God’s hands now.” A source close to the family later said that she had also been taken off her meds and the family was told she would pass at any moment. Bobbi Kristina’s eerie and untimely death came months after the third anniversary of Whitney’s death on Feb. 11, 2012 (which was ruled an accidental drowning).
